HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a persons)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q. Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. Daniels, Architect Design and titled"Donna Nightingale, 12 Walley Court,Hyannis, MA" dated 2/11/06; and has determined the following A W 12 x 26 steel beam is required to support the Garage Attic area. The W 12 x 26 beam is designed for a dead load of 15#/sq.ft. and a live load of 20#/sq.ft. In addition, (2) 3 '/2"Lally columns with Springfield plates are required at each end of the beam. To construct an attached two-car,garage located partly within the required front and side yard.setbacks Summary: Granted with Conditions Petitioner: Donna Nightingale and Richard R.Bacchiocchi Property Address: 12 Walley Court,Hyannis,MA Assessor's Map/Parcel: Map'324 as parcel 021 Zoning: Residential B Zoning District Relief Requested &Background: According to the Assessor's Record, the property at issue is 0.58=acre parcel developed with a one-story, 1,294 sq.ft.,four-bedroom,.single-family dwelling, originally constructed in 1948. The lot is an irregular "L" shaped parcel. According to the plot plan submitted, the existing structure is located 12.4 feet off Walley Court where a 20- foot front yard setback is now required. There is also an existing shed shown on the plan that does not conform to the required side yard setback for this district. . In Appeal 2006-010,the applicants seek a variance to permit an' addition of an attached two-car garage. This addition will intrude into the required front and side yard setbacks for the zoning district. Procedural &Hearing.Summary: . This appeal was filed at the Town Clerk's Office and at the Zoning Board of Appeals on December 22, 2005. A public hearing before the Zoning Board of Appeals was duly advertised and notices were sent to all abutters in accordance to MGL Chapter 40A. The hearing opened on February 01, 2006, at this time the Board found to grant the variance subject to additional conditions herein. Ron S. Jansson,Randolph Childs, James R. Hatfield, Sheila Geiler, and Chairman Gail Nightingale were the Board Members who granted this appeal. Mr. Richard R. Bacchiocchi represented the appeal before the Board. He intents to construct a two-car attached garage. However, given the lot configuration and the location of the existing dwelling the only possible location would intrude into the required front and side yard setbacks. Photographs have been submitted to show the dwelling and conditions of the property. He also submitted an option to site the garage flush with the existing line of the porch noting that it would infringe less into the required front yard. The Board and applicant discussed the situation and option noting that wetlands exist to the rear of the property and the proposed location would be outside the jurisdiction of the Conservation Commission. The issue of the detached shed was discussed. The applicant noted the shed was on blocks and approximately 8 by 10 feet. It had been located on-site by the prior owner. Public comment was requested and no one spoke in favor or in opposition to the request. The Chairman cited that the abutting neighbor,most affected by the proposal,Ruth A. Norris at 16 Walley Court submitted a letter to the file. That letter states that Ms.Norris has no objection to the grant of the variance..She perceives it would"relieve the congestion on the street." Findings of Fact: At the hearing of February 01, 2006, the Board unanimously made the following findings of fact: 1. Appeal 2006-10 is that of the petitioners Donna Nightingale and-Richard R. Bacchiocchi, for property addressed 12 Walley Court,Hyannis,MA,as shown on Assessor's Map 324 as parcel 021. The property is zoned Residence B. The petitioners seek a Variance to Section 240-1 LE Bulk Regulations, Minimum Front Yard Setback and Minimum Side Yard Setback to construct an attached two-car garage located partly within the required front and side yard setbacks. 2. According to the Assessor's Record,the property at issue is a 0.58-acre parcel developed with a one- story, 1,294 sq.ft.,four-bedroom single family dwelling. That record cites the dwelling as having been constructed in 1948. The lot is an irregular"L" shaped parcel and the plot plan submitted only shows the westerly side of the parcel on which the dwelling is situated: 3. According to the plot plan, the existing:structure is located.12.4 feet off Walley Court where a 20-foot front yard setback is now required. Given that the structure predates the enactment of zoning with regard to dimensional requirements,that infringement is assumed to be a legal pre-existing non- conformity in the structure. There is also an existing shed shown on the plan that does not conform to the required side yard setback for the districts. 4. The applicants seek a variance to permit a one-story,24 by 24 foot attached two-car garage that intrudes into the required front and side yard setbacks for the zoning district. The applicants have presented-an option to locate that garage flush and in line with the existing porch. That location will intrude less into the front yard setback than the plan submitted with the application. 5. In consideration for the grant of the Variance, unique conditions of wetlands and the location of the existing building on the property exist that affect the locus but not the zoning district in which it is . .located. 6. In this instance a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner, as no other location exists for an attached garage. This variance can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the variance with the following , conditions: 1. The garage shall be located as proposed in a plan entitled "Plot Plan Showing a Proposed Garage# 12 Wally Court,Barnstable;MA" as drawn by Canal Land Surveying&Permitting Inc.,dated November 3, -2005,except the plan should be modified to show the 24 byL24 foot proposed addition-to be moved.back7 - - - on the lot, situated flush and in line with the existing front porch of the dwelling: 2 r 2. The garage addition must be limited to 24 by 24 feet one-story attached structure built as per elevations submitted entitled, "Donna Nightingale, 12 Walley Court,Hyannis,MA"..This addition should only be used as a garage or storage unit and cannot be converted in the future to a habitable area. 3. The shed shown on the plan shall be moved into conformity to the required setbacks for the district. 4. This variance must be recorded and a copy of that recorded document must be submitted to the file prior to any building permit application for the structure. 5. No outdoor parking for vehicles shall be created within the paved roadway surface area of Walley Court. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction_Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor.
