We recently installed a vinyl pool for Giorgio Bonmassar of 98 Walnut St. As part of the conditions of the permit, you required an as built plot plan locating the pool in the backyard. It has been brought to my attention that 'thei`location of the pool is beyond the 4' rear setback that the town allowed us, and is more like 2' from the rear of the property. I would like to explain to you how this occured. First, I would like to mention that this was in no way intentional. I have been in the pool business for over 35 years, and we would never intentionally ignore a town's setbacks. On the day of the excavation, my installer used the plot plan that was provided to us by the homeowner to stake out the pool. This is the same plan that was used to file the permit application. There were no rear property line markers, however, the plan shows that the front of the house is 30, from the front of the lot so we used this as our point of reference. The house is 25' from front to back, and the deck off the back of the house is 181 . The plan shows that the lot is 100' long by 100' wide; this left us 27' , 20' for the width of the pool, and 7' for the setback- more than what we thought we needed. We .proceeded with the installation under the premise that we had more than the 4' setback. It wasn't until the homeowner's surveyor informed us that the original plan was inaccurate that we were aware of the discrepancy. After being made aware of this, I thought it was best to be proactive about the situation and bring it to your attention .immediately. I asked the homeowner to bring in a copy of his as built plan and explain the situation to you. He went to the office today, but you were not available. A clerk told him to have us call you directly. I left you a message earlier this afternoon, but have not heard back from you yet. I thought it would be best to also send this email so that I could inform you of the situation as soon as possible.
