Work on the cottage was done without a building permit, although a permit was issued to replace the foundation of the main building. 37 Washington St., Hyannisport is listed as a contributing building (and garage) within the Hyannisport National Register District. As such, demolition of any portion of the building is subject to review by Barnstable Historical Commission acting pursuant to Section 112 of the General Ordinances. Substantial change of such a building may also be subject to review by the Cape Cod Commission Based on a review of the inventory file, photos and site visits, the Commission found that the change to the roof of the cottage building does not detract from the historic, architectural value of buildings on this site, and voted NOT to hold a public hearing pursuant to Ordinance 112, Historic Properties. Summary: Granted with Conditions Petitioner: Carol A.Lyons Property Address: 37 Washington Ave,Hyannisport,MA Assessor's Map/Parcel: Map 287 Parcel 086 Zoning: Residential F-1 Zoning District Relief Requested &Background: In Appeal 2006-23,the applicant seeks to expand an existing accessory cottage structure. Use of the structure constitutes a second living unit on the lot and is located not in conformity to the required setbacks. According to the Assessor's Record,the property is a 0.11-acre lot developed with two structures. The principal building is two-story, 1,990 sq.ft.four-bedroom single-family dwelling. That structure dates to 1880 and is listed as a contributing historic structure to the Hyannisport National Historic District. The accessory cottage is a one-story,440 sq.ft.structure that contains a kitchen,bathroom,and bedroom. The applicant purchased the property in 1984. On September 14,2005,the Building Division issued Building Permit No. 86878 for the renovation of the •principal structure. In early November,the Building Division noted that work was being done on the accessory cottage structure. On November 09,2005, the Building Division issued a stop work order on the cottage.It was determined that the work exceeded the current permit issued. Alterations on the cottage included a new roof which created an open loft area. This construction added a .new building area within the required setbacks and an expansion of the living area in a nonconforming use. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 25, 2006: A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on March 01,2006,at which time the Board found to grant the special permit subject to conditions herein. Daniel M. Creedon III,Ron S. Jansson,Randolph Childs,James R.Hatfield,and Chairman,Gail Nightingale were the Board Members deciding this appeal. Attorney Paul R.Tardif represented the applicant. Carol A.Lyons,the applicant,was also present at the hearing. Mr.Tardif described the property and the proposed alteration and expansion to the accessory N cottage.Both buildings are considered historic,by the Hyannisport National Historic District. Therefore, The Barnstable Historic Commission reviewed the principal dwelling and the cottage structure.The newly added loft area will not exceed the 440 sq.ft. footprint of the building nor did the structure infringe into the setbacks.The loft area is only accessible by ship ladder stairs and as livable area,the loft is very limited. Bk 20876 Pg 83 #19820 Mr.Tardif testified that the accessory building is not rented. It is used only by the owner and for family and friends when they visit.The property is that of a single-family. Public comment was requested and no one spoke in favor or in opposition to the request. The Board and Mr. Tardif discussed the nature of the relief being requested.It was determined that the relief under Section 240-92 nonconforming buildings or structures used as single-and two-family residences would be sufficient and all that would be required. Findings of Fact: At the hearing on March 01,2006,the Board unanimously made the following findings of fact: 1. Appeal 2006-23 is that of Carol A.Lyons. Her property.is located at 37 Washington Ave,Hyannisport, MA. The property is shown on Assessor's Map 287 as parcel 086. It is in a Residence F-1 Zoning District.The applicant has applied for a Special Permit pursuant to Section 240-92 nonconforming .buildings or structures used as single-and two-family residences. The applicant seeks to construct a peaked roof on an existing"cottage"accessory building located on the property not in conformity to the required setbacks for the district. 2. The property is a 0.11-acre lot developed with two structures.The principal building is two-stories and 1,990 sq.ft.. It is a four-bedroom single-family dwelling. The accessory cottage is a one-story,440 sq.ft. structure that contains a kitchen,bathroom,and bedroom. Use of the accessory structure constitutes a second living unit on the lot.That unit is located not in conformity to the required setbacks. The principal structure dates back to 1880 and is listed as a contributing historic structure to the Hyannisport x National Historic District. The applicant purchased the property in 1984. 3. On September 14, 2005,the Building Division issued Building Permit No. 86878 for the renovation of the principal structure including the installation of a new foundation. The permit also cited that the number of bedrooms would be reduced from 4 to 3 in the main dwelling. Sometime in early November the Building Division noted that work was also being done on the accessory structure. On November 09, 2005, the Building Division issued a stop work order on the accessory building as it was determined that the work exceeded the permit issued. 4. The alteration to the roof line of the cottage constituted a structural expansion of the pre-existing nonconforming building and increases the area of the building created by the addition of an interior loft area. 5. Both the accessory structure and its use were legally created and established in conformity to zoning at ,hat time,they date back to 1949.This area of Town was initially zoned for one single-family residence. Cited in Article 75 and adopted on March 7, 1949. 6. Section 240-92 authorizes the Zoning Board of Appeals to issue a special permit upon the finding that the proposed alteration or expansion will not be substantially more detrimental to the neighborhood than the existing building or structure. 7. Based upon the evidence presented the proposal fulfills the spirit and intent of the Zoning Ordinance and does not represent a substantial detriment to the public good or the neighborhood affected.The proposed alteration and expansion will not be substantially more detrimental to the neighborhood than the existing building or structure. 2 { - Bk 20876 Pg 84 #19820 Decision: Based on the findings of fact,a motion was duly made and seconded to grant the special permit with the following conditions: 1. This permit is issued for the alteration and expansion of the accessory cottage structure located on the property.The alteration and expansion of the structure shall be in accordance with plans presented to the Board and entitled"Plan View/New Loft Area/Cottage"revised date of 9/3/05,and Plan View/ Cottage/Proposed Changes"last revised date of 9/3/05. 2. Use of the cottage structure shall only be that of accessory to the main dwelling.It shall not be rented separate from the main structure and the ownership of the cottage shall not be transferred separately from the principal dwelling. 3. The accessory structure is limited to a one bedroom dwelling,defined by the Board of Health. 4. The accessory structure shall not be further expanded in area nor increased beyond one bedroom without permission from the Board. 5. All construction shall conform to all applicable Building Codes,Fire regulations and Health requirements. Ordered: Special Permit 2006-023 is granted with conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Appeals of this decision,if any, shall be made pursuant to MGL Chapter 40A,Section 17,within twenty(20)days after the date of the filing of this decision,a copy of which must be filed in the office of the Town Clerk.
