Assessor's Map/Parcel: Map 269, Parcel 052 Zoning: Highway Business and Residence B Relief Requested and Background: In Appeal 2007=033, Hyannis County Gardens, sought to construct and operate a wind turbine atop a120 foot high monopole for wind generation of electricity. The primary use of the electricity generated was to service the garden center that purports to be an exempt agricultural use under MGL Chapter 40A, Section 3. The property consists of 6 acres located on West Main Street in Hyannis. The front portion, to depth of 300 feet, is zoned Highway Business. The back portion is zoned Residence B. The location of the proposed monopole tower is in the center area of.the lot situated approximately 530 feet off West Main Street and within that-area zoned Residence B. There are a total of 8 buildings on the site. Six of those structures are greenhouses. The other two structures are a 13,169 sq.ft., retail sales building and a 6,085 sq.ft. metal garage/office building. The applicant has proposed the installation of the 120 foot monopole upon which a three bladed wind generator will sit. The blades are approximately 34 feet in length. The overall height including generator and blade measures 154 feet above grade. Although it has been stated that the electricity generated for the wind turbine is to be used for the agricultural'use of the property, it has been identified that the turbine is to be connected to the electrical grid and, at times, may feed into the grid. The applicant sought a "modification permit" pursuant to Section 240-8.A(3) of the zoning ordinance to permit the structure that exceeds the 30 foot height limitation and its use as a wind energy conversion'facility. That section provides for the issuance of a "Modification Permit" from the Zoning Board of Appeals for "use of land or Structures exempt" under MGL CH. 40A, Sec. 3 that does not comply with "reasonable regulations of bulk,...". Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 14, 2007.
