Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire, express or implied,oral or written." MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required." DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is, or is intended to be, a one or two-family dwelling; attached or detached structures accessory to such.use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing,Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. The two parcels have a total of 1.29 acres and contain a 756 sq. ft. commercial building, a miniature golf course, and supporting parking and golf shed in the BB - Highway Business Zoning .District. The Site Plan Review Committee has approved for purposes of submitting to ZBA a "Site Plan of land for #455 West Main Street, Hyannis, Mass. prepared for Steve Fedele" dated March 10, 1994. Procedural summary: The petition was filed in the office of the Town Clerk and at the Zoning Board of Appeals office on April 21, i994. A public hearing, duly noticed under M.G.L. Chapter 40-A was opened on. June 15, 1994 at which time the Board heard evidence and rendered a decision. Board members sitting on this appeal are Gail Nightingale, R. Jansson, D. Bliss, E. Glynn and R. Thorne as alternate and R. Boy, Chairman. Attorney Michael Stusse representing the petitioner introduced Mr. Fedele and his daughter Stacy who is managing the site presently. He explained that in permit number 1975-20 this Board had .allowed a mini- golf course on the site.- Now Mr. Fedele would like to include bumper boats which are- tiny boats for children ages 3 years to 7 years to I I Staff Report - Appeal No. 1994-50 Special Permit - Conditional Use - Recreation: Fedele entertain the younger children who are too little for mini-golf. The boats are battery operated and re-charged overnight. The Board and applicant discussed the 1987-75 special permit that was denied, the history of the. HB Zoning District and the development. of the site. Mr. Stusse continued that in a Highway Business Zone outdoor amusements are a conditional use allowed by special permit in section 3.3-6 so long as it is not substantially detrimental to the neighborhood or community and is not adverse to the health or convenience of the public. Site Plan Review had conditionally approved pending this Boards decision. Parking would remain the same and since the boats were designed for children, it would not generate any further traffic. The boats will be stored inside the existing building at night and plugged into a battery for recharging. The Board and applicant discussed the 1987-75 special permit that was denied. History of the HB .Zoning District and development of the site. Chairman Boy asked for Public Comment. None was given. FINDINGS: In Appeal Number 1994-50 , the Board unanimously found to allow a Modification of Special Permit 1975-20 to: Include the recreational use of bumper boats would not be in derogation of the spirit and intent of the zoning ordinance and would not be detrimental to the neighborhood. This business has existed for 20 years. It is located on 1.3 acres of land and already has the benefit of an ice cream shop and mini-golf course. This application would not substantially increase traffic. Cloutier, have appealed to the Board of Appeals and petition for a Special Permit under Section PA10 of the Barnstable Zoning By-Law as revised December 18,. 19740 to allow a miniature golf course at West Main Street, Hyannis in a Business Zoning District. Attorney Charles McDermott represented Petitioners. Petitioners propose to construct a miniature golf course with small office building in front in a business zone under Section PA 10 of the by-law. Locus has a tows drainage easement on it but some arrangement can be worked out with the Town Engineering Department in regard to its use for parking or travelling over. The business zone extends back from West Main Street 200 feet and locus probably has. an exit in the business district onto Straight Way, which is substantially zoned residential►. Adequate parking can be provided. Play would be mostly at night with a maximum of 60 persons at ene time. Peak activity would be at approximately 8 or 8t30 pm and the establishment would be open until 10 or 11pm. There would be approximately 20 .to 25 care maximum at one time. Locus contains approximately 2 acres and any space necessary will be allocated for parking. There will be exterior lighting which shines down onto the area of play. The abutting properties on West Main Street are businesses. An entrance or exit could be provided onto. Straight Way to alleviate problems of traffic congestion on West Main Street. The course would be open only three months out of the year. Opposition was based on traffic flow into a residential area if an exit is provided onto Straight Way and the already existing parking problem attendant to theibutting laundromat, which would be further aggrivated and that-this would lower property values in the abutting residential area. The Board found that this was a routine application for an amusement under Section PA 10 of the Barnstable Zoning By—Law. The Bcard found that there would be no detriment nor derogation of the By—Law provided the following restriction on parking are meta 1. Parking will be on parcel indicated as D5 on plan submitted. 2. Entrance will be off West Main Street with a right hand turn to parking area as shown on plans submitted. 3. Parking shall not be allowed in the parcel marked for parking on the plan submitted. The Regional Transit Authority insists that the commonwealth of �` Massachusetts who owns a parcel to the rear, has rights in the way to access its as does the owner of Parcel #1 and #2. Attorney Ford cited that property his research reveals the right-of-way was granted back in 1926 as a part a land swap that occurred between Mr. Baldin and the Old,Colony and New Haven Hartford Railroad Company. The question raised at Site Plan Review was if the rights were for the benefit of the petitioners property, or is it exclusively the states. Attorney Ford contended it is a right-of-way in common with others who have a right to use it. Attorney Ford submitted his documentation to the file. Attorney Ford also posed the questioned that these rights may have been extinguished, citing that twenty years -120) of non-use may result in extinguishment of the easement rights. It was also noted that this easement is a public way that can not necessarily be extinguished without town action. Attorney Ford also noted that the applicant has done nothing inconsistent with anyones easement rights - the clients own a fee in that property and clearly have a right to grant an easement over Lot- 2 for the benefit of Lot 1. No one present spoke in either opposition or support of the. petition as presented. FINDING OF FACTS: Base upon the. evidence 'submitted and the.Testimony given at the public hearing on Appeal No 1992-59, The Zoning Board of Appeals unanimously found: 1. The modification requested is to allow 16 electric bumper boats to operate .in conjunction with the miniature golf course. This would not be detrimental or objectionable and would not be a substantial change from the original Special Permit #1989-22 that the Board granted. 2. The applicant has provided in excess of the parking requirements mandated by this Board previously, and no evidence has been presented that the new activity would create any increase in traffic at the site. 3.
