RE: Tastebud's Restaurant
West Main Street, Hyannis
Dear Mr. DaLuz:
On Monday morning, January 4, , Ron Jansson and I had a meet-
ing with you to discuss the renovations to the existing
Tastebud's Restaurant. At present, Tastebud's is a two-
story wood frame restaurant, approximately 50' x 62' in
size incorporating 4,304 s.f., 50 restaurant seats and 15
parking spaces. The restaurant has been in operation for
at least 40 years and has become outdated with respect to
applicable codes.
It was originally the owner's intention to gradually modi-
fy and update the restaurant, but in the recent months it
has come under scrutiny by the Fire Department and the
Board of Health for a significant number of long-standing
code deficiencies prior to the new ownership, and has found
it best to do all the code upgrading at once, along with
building modernization. Some of the deficiencies include:

Improper location of kitchen equipment for fire safety
reasons.
Improper finishes in the kitchen as per Board of
Health.
Improper use of storage.
Unattended leaking roofs causing dryrot over many pre-
vious years.
Unenclosed staircases.
No direct means of egress for second floor.
No handicapped toilets.
Inadequate "fire protection of structure.

It is the owner's intention to correct all these and up-
grade to present standards of modern construction and
safety. In doing so, we intend to do the following:
1. Remove all storage on the second floor above the res-
taurant dining and relocate to the first floor by
squaring off the corners of the building.
2. Remove kitchen from second floor and relocate to the
first floor.
3. Provide proper means of egress from the second floor
with enclosed staircase.
4. Provide full sprinkler system throughout the building.
5. Provide updated alarm systems throughout the building.
6. Provide entrance air lock.
7. Install insulation on the building envelope (presently
has none) .
8. Install thermopane glass (presently has none) .
9. Install handicapped entrances throughout.
10. Provide all new 5/8" fire code gypsum board on all
walls for fire safety and protection.
11. Provide proper finishes in the kitchen areas as per
Board of Health.
12. Provide new cooking line-up according to Board of
Health and Fire regulations.
Enclosed is one copy of the Site Plan as it exists today
showing the building being squared off, its existing park-
ing lot and setbacks, existing floor plans and elevations,
and proposed floor plans and elevations.
In doing the renovations to the existing building, restau-
rant capacity will remain as at present capacity of 50;
parking will remain at present capacity of 15; lot coverage
will change from 25-29% which is under 30% maximum; front,
rear and side yard setbacks will remain the same, which are
within code approval; and building height will increase
from 18-191, which is within code approval.

Although you have agreed that the building and lot are both
presently non-conforming, these renovations will only
result in a slight increase in the overall square footage
of the building as we had previously discussed. It is our
understanding that you agree with our interpretation of
Section 4-4.2 of the Town of Barnstable Zoning By-Laws,
that a special permit is not needed in this instance
because we are not seeking to extend or modify a non-
conforming use in that the current restaurant use is an
allowable use in the district in which this project is
located. Based on this meeting, we have proceeded with
working drawings and anticipate visiting with you for the
purpose of obtaining a building permit for renovations
during the end of January as we are only able to close the
restaurant during February, March and part of April for
these reno- vations and code upgrades prior to the busy
season.

ing review and permit application.

INTENT: It is the intent of this section to allow the residents of the Town of Barnstable to operate a home occupation
within single family dwellings,subject to the provisions of Section 4-1.4 of the Zoning ordinance,provided that the activity
shall not be discernible from outside the dwelling: there shall be no increase in noise or odor,no visual alteration to the
premises which would suggest anything other than a residential use;no increase in traffic above normal residential volumes;
and no increase in air or groundwater pollution.
After registration with the Building Inspector,a customary home occupation shall be permitted as of right subject to the
following conditions:
•- The activity is carried on by the permanent resident of a single family residential dwelling,unit,located within
that dwelling unit.
• Such use occupies no more than 400 square feet-of space.
• There are no external alterations to the dwelling which are not customary in residential buildings,and there is
no outside evidence of such use.
• No traffic will be generated in excess of normal residential volumes.
• The use does not involve the production of offensive noise,vibration,smoke,dust or other particular matter,
odors,electrical disturbance,heat,glare,humidity or other objectionable effects.
• There is no storage or use of toxic or hazardous materials,or flammable or explosive materials,in excess of
normal household quantities.
• Any need for parking generated by such use shall be met on the same lot containing the Customary Home
Occupation,and not within the required front yard.
• There is no exterior storage or display of materials or equipment.
• There are no commercial vehicles related to the Customary Home Occupation,other than one van or one
pick-up truck not to exceed one ton capacity,and one trailer not to exceed 20 feet in length and not to
exceed 4 tires,parked on the same lot containing the Customary Home Occupation.
• No sign shall be displayed indicating the Customary Home Occupation.
• If the Customary Home Occupation is listed or advertised as a business,the street address shall not be
included. ,
• No person shall be employed in the Customary Home Occupation who is not a permanent resident of the
dwelling unit.

Dear Mr. Trovato:
You are granted temporary permission to install 12 seats, (3 tables) outdoors at
474 West Main Street, Hyannis, with the following conditions:
(1) The chairs and tables shall be at least ten(10) feet from the parking lot
and other public access ways. Fencing, cinder block walls, or some other
barriers (which cannot be easily moved by customers) must be installed to
clearly indicate the location of the 10 feet setback.
(2) Patrons shall have access to two bathrooms without walking through any
food preparation areas.
(3) All the other regulations contained in 105 CMR 590.000: State Sanitary
Code, Chapter X- Minimum Sanitation Standards for Food Establishment
and of the Town of Barnstable Board of Health sanitation regulations shall
be strictly adhered to.
(4) No waiter or waitress service is authorized to the outdoor dining area.
(5) This variance may be revoked anytime unsanitary conditions are observed.
(6) This variance is not transferable to another owner or lessee of this unit.

RE: Tastebud's Restaurant

Dear Mr. DaLuz:
On Monday morning, January 41 Ron Jansson and I had a meet-
ing with you to discuss the renovations to the existing
Tastebud's Restaurant. At present, Tastebud's is a two-
story wood frame restaurant, approximately 50' x 62' in
size incorporating 4,304 s.f., .50 restaurant seats and 15
parking spaces. The restaurant has been in operation for
at least 40 years and has become outdated with respect to
applicable codes.

It was originally the owner's intention to gradually modi-
fy and update the restaurant, but in the recent months it
has come under scrutiny by the Fire Department and the
Board of Health for a significant number of long-standing
code deficiencies prior to the new ownership,. and has found
it best to do all the code upgrading at once, along with
building modernization. Some of the deficiencies include:
Improper location of kitchen equipment for fire safety
reasons.
Improper finishes in the kitchen as per Board of
Health.
Improper use of storage.
Unattended leaking roofs causing dryrot over many pre-
vious years.
Unenclosed staircases.
No direct means of egress for second floor.
No handicapped toilets.

Inadequate fire protection of structure.

It is the owner's intention to correct all these and up-
grade to present standards of •modern construction and
safety. In doing so, we intend to do the following:
1. Remove all storage on the second floor above the res-
taurant dining and relocate to the first floor by
squaring off the corners of the building.
2. Remove kitchen from second floor and relocate to the
first floor.
3. Provide proper means of egress from the second floor
with enclosed staircase.
4. Provide full sprinkler system throughout the building.
5. Provide updated alarm systems throughout the building.
6. Provide entrance air lock.
7. Install insulation on the building envelope (presently.
has none)
8. Install thermopane glass (presently has none) .

9. Install handicapped entrances throughout.
10. Provide all new 5/8" fire code gypsum board on all
walls for fire safety and protection.
11. Provide proper finishes in the kitchen areas as per
Board of Health.
12. Provide new cooking line-up according to Board of
Health and Fire regulations.
Enclosed is one copy of the Site Plan as it exists today
showing the building being squared off, its existing park-
ing lot and setbacks, existing floor plans and elevations,
and proposed floor plans and elevations.
In doing the renovations to the existing building, restau-
rant capacity will remain as at . present capacity of 50;
parking will remain at present capacity of 15; lot coverage
will change from 25-29% which is under 30 o maximum; front,
rear and side yard setbacks will remain the same, which are
within code approval; and building height will increase
from 18-191, which is within code approval.

Although you have agreed that the building and lot are both
presently non-conforming, these renovations will only
result in a slight increase in the overall square footage
of the building as we had previously discussed. It is our
understandingthat you agree with

Section 4-4.2 of the Town of Barnstable Zoning By-Laws,
that a special permit is not needed in this instance
because we are not seeking to extend or modify a non-
conforming use in that the current restaurant use is an
allowable use in the district in which this project is
located. Based on this meeting, we have proceeded with
working drawings and anticipate visiting with you for the
purpose of obtaining a building permit for renovations
during the end of January as we are only able to close the
restaurant during February, March and part of April for
these reno- vations and code upgrades prior to the busy
season.
