CZ,ayton represented the petitioner, David Ehart, who is requesting a Special Permit/Variance for Lot 123 at the corner of W. Main and Straightway, Hyannis in a Highway Business zoning district. The Lot contains 23,435 square feet and the Laundry Room building containing 3400 square feet to w1M ch the petitioner intends to construct a building of 1440 square feet for a total of 4800 square feet and "Got coverage of Less than one third. The new addition will house Laundry machines, however, these will not be for use by the general public - so that this will not increase the traffic at the site. The ..petitioner needs a variance from setback requirements and also area requirements. The petitioner intends to employ about six people during the busy season, and will connect to. the Town sewer. Dexter Bliss made a motion to approve, with the restriction that the building be constructed per the Plan presented and not to be for use by the public, seconded by Ronald Jansson. The Board therefore, voted unanimously to grant the relief requested by the petitioner. EHART APPEAL NO. 1989-30 At a regularly scheduled hearing of the Zoning Board of -Appeals, held on April 6 , 1989, notice of which was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of Massachusetts , David D . Ehart - appealed to the Zoning Board of Appeals to consider on remand from the courts , materials relating to denial of the Special Permit and Variance, Appeal Numbers .. 1986-44 and 1987-22 , for the property located on Assessor' s Map 269 , Lots 123 and 223 , 497 West Main Street, Hyannis , MA in a Highway Business Zoning District . n At thi's time , the petitioner is proposing to construct a smaller addition to the existing commercial laundry . The former petitions are now remanded back to the Board of Appeals for consideration of that proposal . The petitioner has submitted plans prepared by the BSC . Group, dated, January 26 , 1989 , indicating the proposed two- story addition of 1 , 000 square feet to the laundry building at the back of the property. The second story will be used for storage only. The retitioner contends that he does not have adequate space In the present building to operate the existing commercial laundry business . This addition will allow him to install automatic towel folding equipment and will not create additional traffic as it is intended to be serviced only by two delivery trucks which pi-ck-up and deliver laundry from motels and other similar businesses in the area. There are five people presently employed between the two buildings with .a potential of a total of seventeen during the summer months . The petitioner contends that there will not be any increase in the hours or volume of the present operation . The petitioner' s laundry business is connected to the Town sewer system. • 1 - ,;. FINDINGS OF FACT Based on the evidence submitted, made the following findings of fact : e Zoning Board of Appeals I . With regard to the Remand to the Zoning Board of Appeals for David Ehart , Appeal No. 1989-30 , under negotiated settlement of the change of intensification of the use., desirable relief may be granted for the r square foot addition without detriment tothes Public g and without nullifying or substantially derogatin gfrom�tthe intent or purpose of the bylaw. t 2 .
