The Purchaser has requested that I provide an opinion ("Opinion") related to your purchase financing of the Property, specifically, concerning whether recently ©� acquired building permits to.remodel the site building remain valid. J � The Property is currently improved with a building and accessory, paved parking, constituting the restaurant use currently operated on-site. The Purchaser intends to use the Property in the same way. .The,purchase of the Property was contingent upon receiving local building permits to allow for remodeling of the existing restaurant building. Building permits have recently been acquired to accomplish the same. You have asked whether, if eight (8) parking spaces might now be unavailable for use by - the Purchaser in its proposed restaurant operation, the building permits secured are still valid. Bog 2569 Fall River,MA RE: Compass Bank Wall Crack Investigation-Hyannis,MA Dear Jim: On Thursday, February 11, 1999, Field Engineer Paul Wilkinson proceeded from this Office to the aforementioned project site in Hyannis, MA. The purpose of the visit was to investigate a large'crack in a masonry block wall at the northeast corner of the Bank. Upon arrival at the site, the Field Engineer met with Collins Construction representative, Ms. Sue Coble. Ms. Coble removed the exterior sheathing materials that were partially obscuring the wall crack. The wall crack was initially observed on the north wall of the northeast corner of the Bank. This wall is a gable end wall and supports minimal roof loads. As the exterior sheathing was removed,it was found that the crack continued, and extends the full length of the east wall at the northeast corner of the Bank. This east wall is a load-bearing wall, supporting the eastern end of the full span roof trusses. The crack then continues, for a short distance, onto the north wall of the Bank foyer. The north foyer wall supports a point load located some distance away from where the crack was observed. Closer inspection of the north masonry wall at the northeast corner of the Bank showed that the wall contained one-major crack and several smaller cracks. The major crack was observed by the Field Engineer to emanate from a crack in the concrete foundation. The wall crack steps diagonally upward, toward and beyond the window masonry opening in this wall. The wall crack increases in size from approximately 1/16" wide near the foundation to V/a"wide near the roofline. The smaller cracks in the north wall included a continuous, horizontal crack, at the top of the eastern end of the foundation wall and the bottom of the first course of masonry block. Also noted at the north wall was a 1/16" to 1/8" wide crack in the foundation wall at the western end of the wall,adjacent to the return wall at this location. The crack in the east wall of the northeast corner of the Bank extends the full length of the wall. This crack is located in the masonry block joint one course below the roofline. The crack is a hairline crack at the southern end of the east wall. The crack widens as it extends north. The crack eventually measures approximately 1" wide where it meets the return wall and connects with the crack in the north wall. Also noted were two significant diagonal cracks at the top of the east foundation wall. i The small crack in the north wall of the foyer is a continuation of the crack in the east wall and extends upward one course and over one block before terminating at the roofline. The crack is a hairline crack. The Field Engineer also observed a significant crack in the floor slab of the room at the northeast corner of the Bank that is enclosed by the referenced walls. This floor slab crack runs in a north-south direction, measuring from hairline to 1/8" in width, and located adjacent and parallel to the west interior wall of this room. Based on all of the above observations,it is the conclusion of Odeh Engineers, Inc. that the wall and foundation failures are most likely the result of settlement of the foundation system. Odeh Engineers recommends that test pits be excavated adjacent to the failing foundation walls in order to document the existing soil conditions at these locations. Odeh Engineers further recommends the removal and reconstruction of the foundation walls and the exterior walls located at the northeast corner of the Bank. Soil improvement under the new foundation system will likely be required prior to reconstruction. Brown, B&L DISCUSSION: 1. R. Crossen presented letter declaring building to be unsafe in accordance with 780 CMR, Section 121.0 (copy enclosed). 2. Reviewed procedures of exploration which have taken place; removal of northeast corner wall, foundation and footing and excavation of material down to 1 F-0"; existing demolished foundation and building debris was encountered from a level of 2'-0" below footing to the 11'-0" depth; debris included wood lumber, plumbing pipes, electrical debris, concrete and brick. - q 3. The nature-of-the' cracking.and settlement of the building indicates that the construction debris may not extend under the entire building, therefore, request was made to conduct certain exploratory measures in an attempt to determine if debris described above is localized, or indeed wide spread. 4. Exploratory measures will consist of test pits excavated around the perimeter of the building; these will be performed on Tuesday, 23 March 1999; Collins will perform excavations; soil analysis will be made by D. Geisser; all excavations will be inspected by R. Crossen and T. Perry prior to backfilling. 5. If the test pits described above, indicate generally satisfactory soil conditions, it is proposed to take a series of approximately 7 soil borings inside the building; these are intended to determine the extent of the unsuitable material under the building, and to indicate the feasibility of it's removal; R. Crossen, D. Odeh and D-. Geisser determined, in the field, the locations for the borings; Collins will do the preparatory work necessary to provide clearance for the drilling; D. Geisser will provide soil analysis; copies of boring logs will be given to all parties. 6. If the.,above procedures;prove that soil conditions are satisfactory for remediation, Briggs Engineering/Odeh Engineering will prepare designs to restore the building to it's usable status; all designs will be submitted to the Town of Barnstable Building Department for. review and approval prior to implementation. As you know, major settling under the footing was discovered under the front right corner of the building a week ago. Since then, I met with your engineer and a decision was made to investigate under the footing by removing that portion of the foundation and footing. Today that excavation was completed and the results show major deposits of construction debris under the footing area as well as under the slab and interior sections of the building. A truck load of old debris was already removed from that hole and trucked away. The debris which is.also under the building as described before, is unstable and must be removed completely. As I see it you have two options: 1) to move the building in order to clean out all old construction debris from under the structure or 2) to raze the building and start over. At the present time. (Briggs) has completed our Subsurface investigation at the above captioned location (herein of referred to as the "Site"). The investigations consisted of test pits excavated around the perimeter of the building and test borings advanced inside the building. These j investigation results are detailed in our letters dated March 25 and. April 5, 1999. These investigations encountered unsuitable soils along the northeast edge of the existing building. This letter docurnents Briggs recommendations regarding remedial measures to remove unsuitable soils and replace them with suitable fill in the northeast part of the building area. Previous Investigations The test pit investigation encountered unsuitable soils including debris and organic i tatter extending under the right front portion of the building under the existing exterior wall footings, slab and 'interior haunch wall footing. The unsuitable soils were a fill layer with organic matter and debris extending as deep as 8 feet below existing grade. This corresponds to a depth as deep as 4 feet below footings. The test borings were advanced inside the building to determine if the unsuitable fill extends in toward the middle of the building. A very dense undisturbed gravelly sand layer was encountered at depths of 1 to b feet below the slab grade in the test borings. Based on the conditions observed in the test borings an allowable soil bearing pressure of 2.5 tons per square foot is recommended for foundations to be supported on the undisturbed gravelly sand or compacted Structural Bill. Excavation Briggs recommends complete excavation of the organic and debris laden fill from beneath the footings and floor slab stress zone. ne stress zone is the volume of soil extending down and out from the outside edge of footing at a 45 degree angle. Given that the existing slab, foundations and building require support during this removal, shoring and temporary support will be required. It is our understanding that David Odeh, Structural Engineer will present a design for support of the existing foundations and building during the unsuitable soils removal. This design may include removal of the existing floor slab in the unsuitable soils area to allow access for the soil excavation. Briggs will not develop the foundation and building support systemm. The support system will be designed by the Structural. Engineer. Backfill and Compaction The excavations may be backfilled using Structural Fill anal/or flowable fill. The Structural Fill must meet the gradation recommendations rioted below. The flowable fill must have a compressive strength adequate to safely support the building prior to removal of the temporary support systems. Briggs therefore recommends the flowable fill specifications be developed by the Structural Engineer and that compressive strength testing be accomplished on flowable fill cylinder samples to verify adequate strength. Within the areas excavated for footings, walls, and other limited areas where large compaction equipment cannot work, we recommend that the fill be placed in loose lifts no more than six inches in thickness and be compacted with small hand manipulated machines such as pneumatic compactors, vibratory compactors, etc. Within more open areas where access is better, larger equipment such as a double drum self propelled walk-behind vibratory roller can be utilized for loose lift thickness not exceeding 8 inches. Sampling was continuous in all borings with split spoon sampler penetration and un-cased hole drilling methods. Refer to Appendix A for Test Boring Logs. I Soil samples from the test borings and test pits were classified in the field by a Briggs, Geotechnical Engineer based on visual and textural examination using the Unified Soil Classification System (USCS). i The borings were advanced through pre-cored concrete core holes throught the existing floor slab. The floor slab is approximately 5 inches higher in elevation than the surrounding exterior grades. The explorations generally encountered a thin layer of gravelly sand fill over i undisturbed inorganic gravelly sand with cobbles. Coring was required in places to advance into the gravelly sand laver as shallow refusals were encountered at depths ; of approximately 7 to 9 feet below the existing top of slab grade. The fill layer consists of fine to coarse sand with up to 30 % gravel and 15% non- plastic fines (silt). The fill extends to depths of 2.5 to 4.5 feet below the slab grade except at B-2A and B-7 where the fill is 6 ft. and 1 ft. thick. The fill is well compact with SPT N-Valued ranging from 16 to 30 except in a few locations vdhere higher N-Values were recorded, likely due to cobbles in the fill. The undisturbed gravelly sand layer consists of fine to coarse sand with up to 30% gravel and 10% non-plastic fines (silt). This layer extends to the full depths of explorations which range from. 7 to 15 feet below the slab grade. The gravelly sand is well compact with SIFT N-Values ranging from 34 to greater than 100. Generally the iV-Values were in excess.of 100. Tltis is likely due to cobbles in this stratum. A three inch thick very desne laver of sand with a trace of organic content was encountered in B-5 at 8.7 feet below the slab. This laver has an N-Value of 200 and was very dense throughout the entire penetration of the sampler penetration. The thin layer was observed to be very densely compacted in the sampler. Groundwater was not encountered in any of the test borings o., test pits at the site. The anticipated extent of the unsuitable soils is delineated on the attached Figure 1. 1 The undisturbed gravelly sand layer is very dense. Based on the conditions observed in the test borings an allowable soil bearing pressure of 2.5 tons per swquare foot is recommended for :future foundations to be supported. Remedial options are presently being considered by Briggs, the contractor., and the structural engineer. Possible options- to support the existing building include underpinning the existing wall and paunched footings and remox al of the unsuitable soils from below the slab area or the use of helical piles to suppoprt foundations during the unsuitable soils excavation. Cozzone, Compass Bank; R. Crossen, T. Perry, Barnstable Bldg. Dept.; J. Collins, M. DaCosta, Collins Construction; D. Odeh, Odeh Engineering; D. Geisser, Briggs Engineering; P. Brown, B&L DISCUSSION: 1. R. Crossen presented letter declaring building to be unsafe in accordance with 780 CMR, Section 121.0 (copy enclosed). 2. Reviewed procedures of exploration which have taken place; removal of northeast corner wall, foundation and footing and excavation of material down to 1 F-0"; existing demolished foundation and building debris was encountered from a level of 2'-0" below footing to the 111-0" depth; debris included wood lumber, plumbing pipes, electrical debris, concrete and brick:- ' 3. The nature of the cracking and settlement of the building indicates that the construction debris may not extend under the entire building, therefore, request was made to conduct certain exploratory measures in an attempt to determine if debris described above is localized, or indeed wide spread. 4. Exploratory measures will consist of test pits excavated around the perimeter of the building; these will be performed on Tuesday, 23 March 1999; Collins will perform excavations; soil analysis will be made by D. Geisser; all excavations will be inspected by R. Crossen and T. Perry prior to backfilling. 5. If the test pits described above, indicate generally satisfactory soil conditions, it is proposed to take a series of approximately 7 soil borings inside the building; these are intended to determine the extent of the unsuitable material under the building, and to indicate the feasibility of it's removal; R. Crossen, D. Odeh and D. Geisser determined, in the field, the locations for the borings; Collins will do the preparatory work necessary to provide clearance for the drilling; D. Geisser will provide soil analysis; copies of boring logs will be given to all parties. 6. If the above procedures prove that soil conditions are satisfactory for remediation, Briggs Engineering/Odeh Engineering will prepare designs to restore the building to it's usable status; all designs will be submitted to the Town of Barnstable Building Department for review and approval prior to implementation. As you know,major settling under the footing was discovered under the front right corner of the building a week ago. Since then, I met with vour engineer and a decision was made to investigate under the footu-i2 by removing that portion of the foundation and footing. Today that excavation was completed and the results show maior deposits of construction debris under the footing area as well as under the slab and interior sections of the building. .A truck load of old debris was already removed from that hole and trucked away. The debris which is* lsb under the building as described before. is unstable and must be remove completely. As I see it you have two options: 1) to move the building in order to clean out all old construction debris from under the structure or 2) to raze the building and start over. At the present time.
