Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract ofhire, express or implied,oral or written." An employer is defined as"an individual,partnership,association, corporation or other legal entity,or any two or more of the foregoing engaged in'a joint enterprise,and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer." MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required." Additionally,MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." The petitioner contends that this parcel of land is located in a Highway Business zoning district. The petitioner proposes to construct a two-story addition to the rear of an I existing one-story building. The two-story addition will contain a total of 3,200 square feet of space. The existing one-story building contains 1,440 square feet in space. The current use of the existing building is and has been a frame shop. The first floor of the new addition will also be used solely for retail space in addition to the existing building. The second floor of the building is to be used as a single apartment. The petitioner's currently own and operate Butler Sporting Goods on the adjacent lot and have recently acquired the property for which relief is being sought. The existing building upon locus is 36' x 40' . It is set back at its closest, 58 feet from West Main Street. In a Highway Business zone, a 60 foot setback is required. The side yards of the building are respectively 15 feet and 13 feet from the existing structure. In a Highway Business zone, the minimum total sideyard setback required is 30 feet. An undated and unsigned plan showing locus indicates that 15 parking spaces are provided to the front of the lot. Seventeen parking spaces are required under the zoning by-law. However, the petitioner represents to the Board that his clients will continue to have control over the adjacent property which has twenty five (25) parking spaces on it. They have agreed to allow such additional parking spaces as are necessary to accommodate the newly acquired property to be utilized on their existing property. Furthermore, they would require their employees to use their adjoining land to park as well as their one tenant. Although there will be 3,000 square feet on the first floor itself, 400 square feet would be utilized only for storage and office space. In that the property is located in a Highway Business zoning district, the petitioner feels that a special permit for the renovations is required under Section 3-3.6. Furthermore, the petitioner seeks to extend the existing non-conforming structure which would require a special permit under Section 4-4.2. Counsel for the petitioner has .indicated that the surrounding area is highly commercialized and consists of other retail stores as well as an adjoining condominium complex. By letter dated December 3, 1987, the Department of Public Works voted unanimously, at its meeting of December 1, 1987 to approve a finding of no adverse affect upon egreja ingress, pedestrian and vehicular safety and traffic flow and control regarding the proposed petition. FINDINGS ` Dexter Bliss made the following findings: 1. The existing building is non-conforming by virtue of the fact that it is set back 58 feet from West Main Street as opposed to the required 60 foot and by virtue of the fact that it does not conform with the present zoning requirements pertaining to side yards in that a total of 30 foot setback is required from both sidelines. Furthermore, he found that the are is a highly commercialized area consisting of several retail stores as well as a condominium , complex. The petitioner contends that this parcel of land is located in a Highway Business zoning district. The petitioner proposes to construct a two-story addition to the rear of an existing one-story building. The two-story addition will contain a total of 3,200 square feet of space. The existing one-story building contains 1,440 square feet in space. The current use of the existing building is and has been a frame shop. The first floor of the new addition will also be used solely for retail space in addition to the existing building. The second floor of the building is to be used as. a single apartment. The petitioner's currently own and operate Butler Sporting Goods on the adjacent lot and have recently acquired the property for which relief is being sought. The existing building upon locus is 36' x 40' . It is set back at its closest, 58 feet from West Main Street. In a Highway Business zone, a 60 foot setback is required. The side yards of the building are respectively 15 feet and 13 feet from the existing structure. In a Highway Business zone, the minimum total sideyard setback required is .30 feet. The proposed footprint of the building I is shown on a Plan of Land entitled "Proposed Addition in Hyannis, MA. , scale: 1" = 20' , Date: June 8, 1987, prepared for: BUTLER SPORTING GOODS WEST MAIN ST. , HYANNIS, MA." Although this Plan does not bear an engineer's seal, the petitioner has submitted such a plot plan also containing Title V information to the Board bearing an engineer's seal confirming the layout of the building. The apartment use proposed on the second floor of the addition would be 40' x 40' inside, it would be utilized as a single one-bedroom apartment used by the petitioner's father. An undated and unsigned plan showing locus indicates that 15 parking spaces are provided to the front of the lot. Seventeen parking spaces are required under the zoning by-law. However, the petitioner represents to the Board that his clients will continue to have control over the adjacent property which has twenty five (25) parking spaces on it. They have agreed to allow such additional parking spaces as are necessary to accommodate the newly acquired property to be utilized on their existing property. Furthermore, they would require their employees to use their adjoining land to park as well as their one tenant. Although there will be 3,000 square feet on the first floor itself, 400 square feet would be utilized only for storage and office space. In that the property is located in a Highway Business zoning district, the petitioner feels that a special permit for the renovations is required under Section 3-3.6. Furthermore, the petitioner seeks to extend the existing non-conforming structure which would require a special permit under Section 4-4.2. The Board of Appeals found sought on this lot, it is questionable as to the whether the provisions of Section 3-2.1 (J) dealing with multi-family dwellings applies. Counsel for the petitioner has indicated that the surrounding area is highly commercialized and consists of other retail stores as well as an adjoining condominium complex. By letter dated December 3, 1987, the Department of Public Works voted unanimously at its meeting of. December 1, 1987 to approve a finding of no adverse affect upon egreg* ingress, pedestrian and vehicular safety and traffic flow and control regarding the proposed petition. FINDINGS Dexter Bliss made the following findings: 1. The existing building is non-conforming by virtue of the fact that it is set back 58 feet from West Main Street as opposed to the required 60 foot and by virtue of the fact that it does not conform with the present zoning requirements pertaining to side yards in that a total of 30 foot setback is required from both sidelines. Furthermore, he found that the are is a..highly commercialized area consisting of several retail stores as well as a condominium complex.
