Main St. , Hyannis/Centerville on a parcel of land zoned for residential and business use. At the present time, four bdildings exist on .this lot; a residence, two sheds, and a rental cottage. Both the residence and rental cottage have commercial use as summer rental property .and .in this respect, do not conform to the requirements of the zoning district. The petitioner has a purchase and sales agreement on this property contingent upon permission being granted for the office use. Under special permit requirements, Mr. Boudreau said that the proposed use would be less detrimental to the neighborhood than the existing use inasmuch as the property would be upgraded by the new construction, landscaping etc. There would be no derogation of the spirit and intent of the zoning by-laws. The structures now existing on this property, which would be removed, are in a state of disrepair and the architectural style of the proposed building is residential in appearance and would be in keeping with the character of the neighborhood. Plans showing the exterior architecture of the building were presented to the Board. On=site parking for 22 cars would be provided and ingress and egress to this property would be from Strawberry Hill Rd. This lot is divided into three zoning districts, RD-1, RB, and Business. An expansion of the business zoned portion of the property with access to and. from W. Main St. could result in additional congestion on an already overly congested roadway. Mr. Boudreau explained that the petitioner in the alternative, seeks a variance to allow the office building use which is a permitted use in the business zoned portion of. this parcel of land and a 30ft. intrusion is allowed into the residentially zoned portion of the lot. This lot is nearly equally divided between the business zone and the residential zone and for all practical purposes, neither use can be accomodated on this parcel. Mr. Boudreau stated that the economic viability of the proposed use demands that the entire lot be used to the extent indicated on the petitioner's plans and the conditions affecting this lot are similar to those affecting a nearby lot on which the Board granted a variance in 1975. David Thomas spoke in objection and said that there is plenty of office space available on West Main St. and as a resident of Strawberry Hill Rd. , he did not want any additional traffic on this street. Mr. Scott Jordan spoke as the representative of the condominium owners at Fisherman's Village. The condominium owners are concerned that a dumpster would be located at an obvious place on the .petitioner's property and asked that screening be utilized to shield a dumpster from view or that some other type of trash collection be used. Mr. Jordan said that outside lighting should be diffused so that it will not reflect onto the condominium property. In addition, a landscaped buffer should be installed between the locus and the property line of the condominiums. If these recommendations are followed, Mr. Jordan said that his association at. Fisherman''s Village would have no objection to the proposed j use. In rebuttal, Mr. Boudreau said that office building use at this location would have no great impact on the traffic on Strawberry Hill Rd. and his petitioner is willing to provide the buffer zone, install non-glare lighting, and screen the dumpster as recommended by the Fisherman's Village Association. The matter was taken under advisement and the hearing was closed. The Board found that this parcel of land and the buildings thereon are .unique to the area since this lot is divided into three zoning districts; one a business zone and the remaining two, residence districts. The area zoned for business has limited frontage on West Main St. which is the only access to this portion of the lot. The area zoned for residential use has frontage on West Main St. and access from either West Main St. or Strawberry Hill Rd. The Board found that there are many commercial uses in the immediate area of the business zoned portion of this lot which make residential use of the property undesirable.. The very limited access to the business zoned'.portion of the lot makes commercial use of this area of the locus impractical and therefore, the lot, although zoned for residential use and business use, cannot be utilized in a reasonable way for residential use or business use, in the manner in which it is presently divided. The Board found that variance conditions as outlined in Sec. 10 of Chapter 40A.., M.G.L. do exist at this site since this parcel of land is bisected by two zoning districts and has-a shape unique to the area in which it is located. The Board further found that the proposed -office building which has .the architectural style of a residence would not be detrimental to the neighborhood nor in derogation of the spirit and intent of the zoning by-laws. The Board voted unanimously to grant the petitioner a variance to ,construct an office building on this parcel of land in accordance *with the. following restrictions, 1. Dumpsters or trash receptacles located on this property shall be screened in a manner that shall make them visually inoffensive, 2. COMMERCIAL LEASE This lease made and entered into on this l st day of November, 2010 by and between Bentley Partners, as the owner of 889 West Main Street in Centerville, with a usual place of business in Massachusetts located at 1291 Main Street, PO Box 390, Chatham,MA 02633 by its Manager, James E. Gable (said partnership hereinafter referred to as"Landlord"), and Premier Commercial, of Centerville MA. ,hereinafter referred to as Tenant. The Landlord and Tenant, in consideration of the promises and covenants contained herein, agree as follows: 1. The Landlord represents and warrants that: a. The Landlord is the owner of the leased property and has the right to make this lease. b. The Tenant, on paying the rent herein reserved and upon performance of all the.terms and conditions of this Lease on his part to be;performed, shall at all times during the term herein, demise peacefully and quietly have, hold and enjoy the leased property. 2. DESCRIPTION OF LEASED PREMISES The Premises consists of-1,600+/-square feet with all rights to common,areas and- common parking areas. The Landlord and Tenant, in consideration of the rents, covenants, and agreements herein specified to be paid,kept, and performed by the Tenant hereby Lease the Premises consisting of 1,600 +/- square feet. Said unit being known as Unit 2 at 889 West Main St. Centerville, MA. 3. MAINTAINING COMMON AREAS Including Real Estate Taxes The Landlord shall maintain in good condition, free and clear of ice and snow and reasonably free of rubbish caused by office center traffic, throughout the lease term or any extension thereof, all parking areas, walkways, grounds and exterior common areas which shall be available to the.tenant, its employees and business invitees, as:well as to other tenants and their customers. The use of such parking facilities shall, at all times,be. subject to such reasonable rules and regulations as the Landlord may promulgate uniformly for all the Landlord's tenants in the building. It is understood by Tenant that any vehicles, motor vehicles or trailers not in service or being diligently used shall be deemed abandoned and be removed from the premise within seven (7) days,upon written notice from the Landlord at Tenants sole cost and expense. The Tenant shall pay as additional payment for the CAM expenses based on $3.50 per square foot or$466.00 per month due on the 1" of every month. The Tenant shall be responsible for his own trash removal and utilities for Unit 2. 4. TERMS OF THE LEASE The term of this lease shall be for Three years. The commencement date shall be November 1", 2010. The lease shall terminate on October 31 St, 2013. The Tenant shall have the option to extend the Base Term for one additional two (2) year period ("Extension Term")In the event the Tenant elects to exercise its option to extend,the Tenant shall deliver written notice thereof to the Landlord within three (3)months prior to the expiration date of the Base Term or then extended term whereby the Lease shall be extended. Rent for the extension term shall be a mutually agreed upon rent. 5. RENT' The monthly rent for year one shall be$1,700.00 per month.or$20,400.00 annually, year two $1.,800.00 per month or$21,600 annually, and year three$1,900.00 per month or$22,800.00 annually. Monthly payments are due and payable on the 1 st day of the month. A service charge of 1.5%will be added to the total rent and outstanding balance due that is not received within ten(10) days of the due date. The lease rent does not include the cost of any utilities, liability.or property insurance, the cost of which are the Tenants sole responsibility. Upon execution of this lease agreement, Tenant shall provide Landlord.with a deposit of Three Thousand Six Hundred($3,000.00) US Dollars.Said amount shall constitute first and last month's rent. The Tenant shall also pay$1,900.00 at time of signing the lease as a security deposit which shall be held by the Landlord, in.his escrow account. The Tenant shall have the first right of refusal to purchase the property for the term of the lease, if the Landlord decides to sell the property. Tenant shall notify the Landlord Within two 1 weeks of a bona fide offer that he intends to purchase said unit and must close with sixty(60) days after notice is given. 6. OUTDOORS STORAGE It is understood and agreed between the Landlord and the Tenant,:that there shall be no accumulation of garbage, rubbish, waste, toxic or hazardous waste, contaminants, scrap metals or materials of any kind. There shall not be outdoor storage of Any Kind without.the written permission from the Landlord. Any such items stored shall be removed within seven (7) days of written notice by Landlord at Tenants sole cost and expense. If Tenant does not remove it within seven (7) days, Landlord has the right to have it removed and charge the Tenant for all reasonable cost. 7. LEGAL FEES In case the Landlord shall, without fault on its part,be made a party to any Litigation commenced by or against the Tenant, the Tenant shall pay all costs and reasonable attorneys' fees incurred by or against the Landlord, or in connection with such litigation. The Tenant,shall (also) pay all costs and reasonable attorney's fees incurred by or against the Landlord in enforcing the covenants, terms and provisions of this lease, or in terminating this lease by reason of the Tenant's default. 8. IMPROVEMENTS No alteration, addition,or,improvement of the leased property shall be made by The Tenant without the written consent of the Landlord and consent will not be unreasonably denied, delayed or withheld. Any alteration, addition or improvement made by the Tenant after such consent shall have been given, and any other fixtures installed as part thereof, shall become the property of the Landlord upon the expiration or other sooner termination of this lease: provided, however, that the Landlord shall have the right to require the Tenant to remove such fixtures at the Tenant's cost, upon such termination of this lease. For the purpose of this paragraph,the term "fixtures"will not include movable personal property, which is merely attached to water or utility outlets on the premises. 9. INSURANCE The Tenant shall, at all times during the term of this lease, at its own expense, Obtain and keep in effect on the leased property liability insurance in the amount of FIVE HUNDRED THOUSAND DOLLARS ($500,000.00). Such insurance policy shall take effect on the date the Tenant begins occupancy of the leased property,must meet the approval and satisfaction of the Landlord, and must name the Landlord on the policy as the Landlord payee. The Landlord, except for loss or damage caused by Landlord's neglect or breach of any of Landlord's covenants hereunder, is not liable for any loss or damage to any of Tenant's property or persons at any time by reason of theft or any action of the elements or arising from fire, wind, explosion, snow, water,rain, steam, gases, or electricity, no matter from what sources the same may come; and the Landlord shall not be liable to the Tenant for any damage of the premise, providing such repairs are performed promptly and in a reasonable and workmanlike manner. 10. SIGNAGE All signs to be approved by the Landlord to maintain uniformity, and all signs shall be lighted including a suitable sign on or near the outside of the leased premise door as may be permitted by the Town of Barnstable. The Tenant shall have space on the sign in front of the building on West Main Street, Centerville. IL BROKERAGE During tenancy of the Tenant, Landlord agrees not to engage any other brokerage firm to put signage on the properties other than the Premier Commercial and John/or John Ciluzzi. Landlord shall have the right to lease same properties out to.tenants. Any brokerage agreements are to be mutually agreed to by all parties. - 12. SECOND FLOOR Landlord shall have the right to lease the second floor of Unit 2 for one year periods, but will give the Tenant the first option to lease said space. 13. FURNITURE i i Rental includes the use of existing furniture in offices and conference room. All furniture is owned by the Landlord 14. REPAIRS Landlord warrants and represents that the heating system and utility system on the leased premises are now in good repair and functioning properly. It is the responsibility of the Tenant.to maintain these systems at the Tenant's expense. If through neglect these systems fail or need replacing it shall be the Tenant's responsibility to replace them at their sole expense. The original cost of such improvements to.the Tenant multiplied by a fraction, the numerator of which is the balance of the term of this lease remaining as of the date of the taking (including all extended terms), and the denominator of which is the balance of the term remaining as of the date such improvements were made. Upon the written demand of the Landlord, the Tenant shall notify the Landlord in writing of the original cost of any such improvements installed by the Tenant. The Tenant shall also be entitled to make claim in his own name to the taking authority for the value of any furniture,trade equipment, merchandise, or personal property of any kind belonging to the Tenant and not.forming part of the real estate, or for the cost of moving all of the same; and any such award made directly to the Tenant shall belong entirely to the Tenant.. Tenant shall have the right, at his sole cost and expense, to assert a separate claim against the taking authority for Tenant's improvements. 16.
