Attorney John Thibbitts represented the petitioner, David Allen Sauro, who is
requesting a use variance for the property currently under a purchase and sale
agreement located at 221 Winter St. , Hyannis in an RB zoning district. The
locus consists of 5,000 square feet and contains a two-story, residence and garage.
The petitioner desires to convert the existing building into two professional
offices and remove the garage to the rear of the existing structure. Six parking
spaces will be available, and the petitioner also seaks_.relief from parking. com-
pliance as seven spaces are required for the proposed use. The petitioner will '
install fencing at the sides,and rear o£.the property. The existing building is
approximately 24'x 35' - about 800 square feet, given the size of the building
the petitioner does not anticiapte a large operation. Ron Jansson made the
finding that the change in use being sought is not in conformity with the uses
allowed in the area, therefor, the type of use proposed would, in his opinion,
substantially derogate from the spirit and intent of the zoning by-laws.
Variance conditions as defined in Section 10 of Chapter 40A, M.G.L. do not exist
at the site. Any hardship would be self-imposed - Gail Nightingale seconded the
findings. Gail Nightingale made a motion to deny the petition based on the findings
Dexter Bliss seconded the motion to deny. The Board voted unanimously to deny
the petition for a use variance at 221 Winter St. , Hvannis.
