On ............................_................_.........._........ . ......................................................... 19 ............ the Board of .. i Appeals found Mr. Olander appeared in his own behalf and stated he was seeking permission to remodel an existing dwelling with an addition of 40 sq.ft. for use as professional offices; premises being located at A 258 Winter Street, Hyannis, in a Residence Al area. He identified the property as the old Baptist Parsonage. He said the lot con- tained approximately 19, 000 sq. ft. , which is one of the largest lots on the street. Mr. Olander said he would like to divide this ; into two office areas, which in turn would be subdivided and in . accordance with plan, the parking would be along side and back of the building, a total of 22 spaces. He said the building and the parking occupies 72% of the lot and the remainder would be grass. The dwelling is sdt back 56' from the street. Mr. Olander referred to plans and said that the front will remain basically the same, except on one side where there is a window for a dining room, this would be replaced by a door. At the rear a bedroom would be extended out to be flush with the house, a 41x10' addition. The left side of the rear would remain the same. The two car garage will be remodelled with an entrance. He said there would be two entrances on the front, two on the side and one at the back. Mr. Olander says he owns this property and plans to retain it. It is now a single family dwelling which he would like to convert to 100% offices. Procedural Provisions: MGL Chapter 40A,and Town Ordinance, Section 5-3.2(3): Variances Background Information: The property is located on the east side of Winter Street three blocks south of the intersection with Barnstable Road. According to the Assessor's Field Card,the lot has 0.34 Acres and has a one story office building of 840 gross sq.ft. The structure was built in 1961 and has gas plus public water and sewer. Variance No. 1972-08 was granted for the purpose of "obtaining permission to use an existing single family dwelling as an office for Cape Board of Realtors,Inc." It was granted subject to the restriction "that the entrance to parking area be from Winter Street and exit to Barnstable Road at the rear of the locus". Apparently the public way as indicated on the assessor map was never actually taken as a public way by the Town. The subject property has been using Winter Street as both entrance and exit. Further research has established that the way is private(paper only from a previous subdivision plan)and the Town has no ownership. A 1950 taking of Grove Street(to Lewis Street)shows only Grove Street as it is now configured,with no taking of the land indicated as"Way"off of Grove Street. Site Plan Review 37- 1994 approved this request on September 22, 1994. Procedural Summary: The application was filed on October 20, 1994;and scheduled for hearing before the Zoning Board of Appeals Meeting on December 14, 1994. Sitting on this appeal are Board members:Robert Thorne, Elizabeth Nilsson,Ron Jansson,Emmett Glynn and Chairman Gail Nightingale Attorney William Beard representing the applicant said the Trust has a contract with the present owner, Attorney Martin J. O'Malley who is present. Attorney Beard said they came before the Board tonight for a modification of a Variance number 1972-08. Cape Cod Board of Realtors owned the property when the variance was granted. The permit has a restriction requiring ingress to be from Winter Street and egress to Barnstable Road. Additionally the Zoning Ordinance requirement for parking is 4 spaces for one office or 5 with two suites;6 spaces are provided; Section 4-2.7 is met. The staff report recommends a back out area be provided at the rear(East)end of the parking area. The property was used as offices since 1972. Somehow the ingress and egress both came to be on Winter Street. Zoning Board of Appeals Decision and Notice—Appeal Number 1994-110-Forty Two Ten Realty Trust Attorney Beard informed the Board that Fred Gralinski owns the land marked"way"on the map. He continued that administrative uses need clarification of whether that includes professional uses. If the requirements of 40A section 10 apply here,consideration should be given to the business zone that runs in back of the property including properties around the Barnstable Road area. Each lot is unique,because many have variances. This property has been used as offices for about 22 years. Converting it back to a single family house is not feasible due to the lack of a tub or shower. He feels a modification could be granted without substantial detriment to the intent or spirit of the Zoning Ordinance. The Board is bothered that this went through site plan review without an engineered plan. Also the entrance is only 10 feet and that may be why that condition was imposed. Wm.Beard said it's a mortgagee plan with parking spaces sketched by themselves and measured to be fairly accurate. He said it has been used for professional use for 22 years and the new proposed use(law offices and maybe an accountant)is less than the Board of Realtors utilization of the property. The staff report says there is adequate parking for two suites. Ron Jansson said 840 sq.ft is too small for two suites because of congestion. The proposal sounds like an expansion of use not just a modification. The variance runs to the land. Attorney O'Malley said he bought the building in 1975 and for almost 10 years he and another attorney had separate offices there. Only a few times was the office and parking lot overcrowded but it was never really an issue. In 1984 or 1985 the building was rented to a psychiatrist and there were no problems. When the psychiatrist moved,Winter Street had been in decline and hardships ensued. He attempted to rent it but there were payments for mortgage and upkeep negating profits. Attorney DeYoung and Beard want to buy it. That appears to benefit the neighborhood. He urged the Board to allow a bookkeeper, accountant or another attorney. The use would not be as intense as in the 70s when the Cape Cod Board of Realtors had their offices there with forty person meetings. It would be a financial hardship if the Variance were not granted. He is willing to be subject to having no medical offices. The Board asked if they would consider extending the right hand driveway to the curb of Winter Street making it less problematic. This would extend the driveway to the curb. Wm. Beard said he supposed they could do that. Ron Jansson asked the Building Commissioner,Ralph Crossen to comment on site plan review. He asked how we know what we are voting on with no engineered plan. He asked if of the six spaces if one is handicapped parking. Wm.Beard said yes but it is not officially designated. Ralph Crossen said ADA requires only municipal and government buildings to have handicapped spaces now. The second phase was requiring retail stores to have it. The third phase will be office uses which begin this year. It is enforceable by the Attorney General's Office and not the building commissioner. Public Comment: None in favor or opposed. The Board said they are not comfortable with two offices in such a small building. They asked the applicant if they could have one legal office there. Wm.Beard said no. Chairman Gail Nightingale said she is inclined to postpone this for them to get a certified plot plan.It might be fine for office use but if this Board permits it now the building could be sold and then it may be used for a much more intensive use. 2 7Aning Board of Appeals Decision and Notice—Appeal Number 1994-110-Forty Two Ten Realty Trust Ron Jansson said when the original variance was granted,there was an ingress and egress in place.He quoted from the Zoning Ordinance section 4-7.5,"site plan will include plan to scale by engineer". Wm.Beard advised that the ingress and egress on Winter Street had been used that way for 22 years. Even though there is a restriction,no one has ever questioned it. Ralph Crossen said during site plan review process they only requested to lift the restriction of the two road ingress/egress. They wanted to take it out of real estate office use and clarify the administrative use. This is the first he had heard about two businesses. The Board said a 10 foot driveway is supposed to be for one way traffic. They felt a need for further site plan review. The parking and exit plan was accepted because of one business. More than one office use is a change and not a modification. They clarified that the original permit granted them one office and if they want two the Board would need to see an engineered plan. The"way"on the map is on the assessor's legal status of way. The Board needs to know what rights people have to pass there and what rights you have to use it or to block it. Attorney O'Malley remarked that the way does not exist. Chairman Gail Nightingale remarked that the applicant has no proof of that. She suggested that the hearing be continued until January 18, 1995 with the applicant providing at that time a scaled plan by an engineer and the applicant will go back to site plan review for two office spaces;not just one. Argument ensued from Attorneys O'Malley and Beard who objected and wanted the Board to grant the requested relief. Therefore: FINDINGS: In appeal number 1994-110 William J.Beard,Trustee for Forty Two Ten Realty Trust the following findings were made by Ron Jansson. 1. The property is located in a Residential B District which consists of.34 acres. 2. The property is located at 280 Winter Street and is subject to a variance which allowed for one professional office use. 3. The property at currently has one usable access and egress off of Winter Street which is approximately 21 feet in width. 4. The building is,according to the plan submitted and the assessor's map, 840 gross square feet of area. 5. The proposed plan calls for six parking spaces of paved parking and although there is a space for handicap parking it has not been designated for exclusively handicapped parking. 6. Granting the relief to remove the restriction being sought regarding the ingress from Winter Street and egress to Barnstable Road would not be substantially detrimental or objectionable to the neighborhood effected provided that the amount of use generated at this site be limited. 7. The term administrative use as it was intended by this Board back in 1972;when the original variance was granted contemplated a broader use than merely administrative use and that use contemplated perhaps a general office use excluding high intensity office use. When the Board says high intensity use, they mean a medical use. 8. Granting relief for one professional office based upon the site plan before us would not be in derogation of the Spirit and Intent of the Zoning Ordinance. 9. The relief being sought is one professional office use. That is what the application was for.
