The Petitioner was represented by Attorney Richard C. Anderson, who stated- that due to the commercial activities on the easterly side of winter Street, the of mer of the property in question, Mirs. Gillies, has been unable to sell or rent this property Cor residential purposes ani.. it has remained vacant for six months; that the property is surrounded -by comercial or semi-professional and professional enterprises and is.in close proximity to a business district; that almost all of the professional activities on the easterly side of Winter Street-have been established as a result of similar variances. Attorney Anderson stated that the Petitioner proposes to use the building,- without structural change and with no change to the exterior, for his sole use, with one employee; that interior changes will be minimal; that office hours will be from 9 am to 6 pm; that a variance restricted to the petitioner personally could be granted; that the Petitioner would not live there but would use the premises for an office only; -and that the property is presently under a conditional purchase 'a-rid sales a-,regiment. The Board found that this petition fell under the definition of hardship and of uniqueness as defined in Chapter 40A of the Massachusetts General Laws Ter. ed. 40A as amended', since the major part of lTinter Street on this side abutts a business area and, by non-conforming use and variance all properties on this side, except three, naw rave`a professional type use. Because of this change in the character of the neighborhood, the present owner has found it impossible to sell this property as a residence. The proposed parking arrangement for the office use does not meet the requirements of zoning. The applicant seeks to change a two-family dwelling to professional office use. The property is show on Assessor's Map 310,Parcel 180, addressed 270 Winter Street,Hyannis,MA in a Residential B Zoning District. Background& Review: According to the Assessor's record,the property at issue is a 0.33-acre parcel developed with a 1 story two- family dwelling of 2,910 sq.ft. and a detached garage of 400 sq.ft. The property is located on Winter Street adjacent to the applicant's existing law office at 266 Winter Street.' The applicant purchased the subject property in October of 2000. The structure located on the property is in deteriorating condition and is vacant at this time. The applicant is seeking to restore and improve 2,780 sq.ft. of the existing structure for office use. The plans propose outdoor parking for 10 vehicles and 2 additional parking spaces within the accessory garage structure. Access to the site will be from a single existing 12.8 feet curb cut on Winter Street. Associated site improvements include drainage and landscaping. Although not drawn on the plan,the possibility exists for the site to work with the neighboring law offices. To accomplish the proposed plan, the applicant has requested two forms of relief: 'Note: 266 is the assigned 911 address of the neighboring building. The address given in the phone book and used on the application is 258 Winter Street. Planning Division-Staff Report 1. The first is that of a special permit to allow for the change iri use from a two-family dwelling to an office. Appeal 2001-101 is that request as provided for in Section 4-4. 5 Change of a Nonconforming Use to.Another Nonconforming Use. 2. In preparing the plans for the redevelopment of the site,insufficient area existed to meet the landscaping requirements for office parking lots. Specifically,parking is proposed to be located in the side yard setback area and within the required 10-foot perimeter building buffer. In Appeal 2001-102,the applicant has applied for a variance to Section 4-2.6 Landscape Requirements for Parking Lots. The applicant seeks to reduce the required 10-foot building perimeter landscape buffer to 5 feet,and to locate parking 4 feet within the once-required 10-foot side yard setback.z - Site Plan Review: In June of 2001, the applicant was before the Site Plan Review Committee with plans for the conversion of the two-family dwelling to office use. The proposed plan was found approvable and a July 02,2001,letter was transmitted to the applicant and board documenting that approval(see attached notes and Approval Letter). Zoning History: The subject site was issued a use variance in 1970 (Appeal 1970-17) to permit a portion of the dwelling to be used as a real estate office. The variance is recorded at the Registry of Deeds in Book 270,page 103 (see attached Decision). The subject site was initially zoned Residential A in 1951 by Article 97 approved on March 5, 1951. That article established the residential zones for north and south Hyannis permitting single-family and two-family as-of- right. Article 40 rezoned the locus to Residential A-1 in 1956,The Comprehensive Rezoning approved March 5 of 1956. That rezoning permitted single-family as-of-right and two-family only by special permit. Article 126 approved April 05, 1972,rezoned it to its present Residential B in 1972. With reference to the grant of the special permit for the change in use,Section 4-4.5 requires several criteria to be met and apprised in terms of impact to the neighborhood (see attached copy of Section). In review of that criteria,the Board should note that: • The site is served by public water and is connected to the Town's Wastewater Treatment Facility. • The Institute of Transportation Engineers (ITE)Trip Generation manual would project for Single Tenant Office Buildings of this size an average weekday traffic volume of 32 vehicle trips or 16 cars into and out from the site3. The peak A.M. and P.M.hours would see an average 5 vehicle trips or rounded up to 2.5 cars in and out. For a two-dwelling unit,using the manual figures, staff projects from 14 to 20 vehicle trips or 7 to 10 cars entering and exiting during the average weekday. For the peak hour,it would be 2 trips or one car in and out.4 2 Note: Town Council Item No.2001-036 amended Section 4-2.6(2)(A)on August 19,2001,after the submission of this appeal. In that amendment it appears that the required 10 foot side yard parking setback requirement for all non- single and two-family uses in residential districts may have been inadvertently dropped from the text. 3 Note: For the single office use,Land Use Code 715 was used. The range calculations would be from 7 vehicles to 49 vehicles per day entering and exiting the site. 4 Note: For the two-family use,staff used a combination of Single-family,Land Use Code 210 and Apartments,Land Use Code 220. Neither land use exactly fits the two-family situation located on this site. The range calculations would be from 2 vehicles to 12 vehicles per day entering and exiting the site. 2 Planning Division-Staff Report • The applicant is not increasing the floor area of the building and there is no proposed expansion of the structure. • The proposed use of the structure does not include any residential use and nighttime and weekend use of the property would be limited or nil. This meeting was called to order at 9:05 AM and adjourned at 10:30 AM SPR 048-01 Wilkins & DeYoung,270 Winter Street,Hyannis (R310-180 & 182) Attorney Russell Wilkins and Vito Maurda, Surveyor appeared before the panel seeking approval to convert an existing residential building into professional offices. The existing 2,715 sf building consists of two dwelling units. At this time, Mr. Bill advised all present at he hearing of a previous business relationship with Mr. Wilkin's firm a number of years ago. Attorney Wilkins stated that he had no objections to Mr. Bill's remaining on the panel ; nor did the other the panel members. Parking calculations were discussed. The applicant determined that eleven spaces would be necessary. They propose twelve. Two spaces are located inside the existing garage. Health questioned the applicant regarding the refuse disposal. It was agreed that the applicant would relocate the dumpster in order to achieve compliance with the 10' setback requirement imposed by the Board of Health. Engineering inquired about the width of the door. The applicant indicated that there are two 8' doors. Those two spaces are reserved for the two attorneys thus leaving the remaining accessible parking available for others. Discussion ensued regarding site elevations. The lot was declared to be virtually flat. Leeching provisions were also discussed. The applicant will revise the plan to include Mr. Burgmann's suggestion on the leeching field. Planning noted this location to be a residential zone (RB). The use is an accessory use as indicated by a ZBA decision (1970-17) on file, which allowed for a den to be converted into a real estate office. This (proposed) use is being expanded to encompass the entire structure. This applicant must file with the ZBA, Mr. Bill declared. II At this time the increased landscaping requirements were discussed. Mr. Bill advised that a 10' landscaped buffer between the structure and the parking area is necessary in addition to a 10' perimeter buffer. The inclusion of the buffer between the building and parking area may trigger a modification of the proposed parking area. Ensuing discussion regarding the relocation of the cement pad (for the dumpster) and preserving the set-backs led Mr. Bill to inquire about the applicant's intent to combine both lots. Attorney Wilkins responded that the proposal is limited to the residential dwelling and only this site is before the panel for consideration. The two parcels are under separate ownership. One is owned by the applicant and one by the applicant's firm. Ultimately,the conversation returned the interior landscape buffer. Attorney Wilkins advised that compliance would be very difficult and the options would be limited. Mr. Bill advised the applicant to address this issue with the ZBA. The Building Commissioner declared that the plan requires some revision before this panel could approve it for referral to the ZBA. The Commissioner reiterated that the plan is remanded for landscape requirements,setback issues, relocation of the dumpster, and identification of ground coverage ratio. Debate followed regarding the proposed use as a legal office necessitating a use variance. Setbacks, landscaping and variance conditions were also addressed. Ultimately,the Commissioner advised the applicant that if the dumpster impacts the proposal in such a negative way"Get rid of it. You don't need it". He alluded to the fact that if the trash pick up is scheduled for 3 AM the abutters may not appreciate the cover slamming down in the stillness of the early morning. "After all,this is still a residential zone". He declared. "Eliminate (spaces) 8 & 9 and kick it down",the Commissioner advised: When the Commissioner was advised that the applicant seeks to keep the garage he suggested that the applicant seek a reduction in parking. "You have to go to the ZBA anyway",he concluded. Before dismissing the applicant the Commissioner attempted to determine whether or not the property is subject to dual overlay districts. The applicant confirmed this. Conclusion: Continued. The applicant will submit a revised plan.
