We spoke on the telephone approximately two weeks ago relating to
the variance at 280 Winter Street, Hyannis , MA. The current owner
of the property is Martin J. O'Malley, Jr. He is selling the
building and the prospective buyers are wondering if they could put
a dormer on the building and make the upstairs their residence and
keep the downstairs office space.

Appeals found
Jonathan D. Fitch, Esq. appeared in behalf of the Petitioner who was
requesting permission to use an existing single family dwelling,
premises being located on Winter Street, Hyannis, in a Residence A-1
area. The Attorney stated that this particular property is identified
as Parcel 169 on plan attached to petition. Mr. Fitch said the Peti-
tioner proposes to use this building with very minor, if any, exterior
alterations, and changing the interior to conform to their proposed
use as an administrative office building. The same use as they are
presently operating at 290 Winter Street. The Attorney said they have
outgrown their present building and are in need of parking, and this
parcel has offstreet parking in the rear.
Mr. Fitch said there are conditions affecting this locus that do not
affect the district generally and it is in an area where there is
encroaching business. The character of the neighborhood has been
changed; this particular area abuts a business district. The Attorney
said that the character of Winter Street is that it is a through street
to downtown Hyannis, not an isolated street. The hardship affecting
this petition comes as a result of checking available and desirable
office space in the Town of Barnstable and finding that it is practi-
cally non existent. The only type of space available was a second
floor and less desirable location. Another hardship is that this lot
is no longer suitable as a sound residential type of investment.
The Attorney said that the desirable relief the Petitioner is requesting
can be granted without derogating from the intent of the by-law, the
proposed use is administrative offices and not offensive. He said
they are there mostly in the evening and only 1-2 days a week when
"trictians;m osad
there is any number of people going in and out. This does not attract
customers and there will be no additional traffic to the neighborhood.
The Attorney said the long range effect will be beneficial to the Town
and the neighborhood because it will relieve traffic congestion with
offstreet parking. The premises will be maintained in good condition.
Mr. Fitch said that several of the neighbors are concerned about the
parking and the Attorney assured them that the parking would be taken
care of. He asked that the Board consider this as a request for a
Variance and act favorably on the petition

parking plan, which they did.
The Board finds that there are conditions especially affecting
this parcel not affecting the zoning district in which it is
located generally; and that a literal enforcement ofthe pro-
visions ofthe by-law would involve substantial hardship; and that
relief may be granted without substantial detriment to the
public good and without derogating from the intent or purpose
of the by-law.
The Board unanimously voted to grant a Variance subject to the
following restriction: }
that entrance to parking area be from Winter Street
and exit to Barnstable Road at rear of the locus.

Background Information:
The request is to modify Use Variance No. 1994-110 to remove the restriction that limits the use of
the premises to one professional office. The application is seeking to allow for more than one
professional office within the structure. The locus is a 0.34 acre lot developed with a one story office
building of 840 gross sq. ft. The building was originally built in 1961 as a residence and converted to
offices by the original Use Variance No. 1972-08. That Variance was subsequently modified by
Appeal No. 1994-110. The lot is accessed from Winter Street in Hyannis.
Procedural Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
March 24, 1995. A Public Hearing before the Zoning Board of Appeals was duly advertised and
notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on May
24, 1995 at which time the Board found to grant the appeal with conditions. Board members hearing
the appeal were: Ron Jansson, Richard Boy, Emmett Glynn, Dexter Bliss and Chairman Gail
Nightingale. The Chairman cited that the advertisement and notices sent did contain an inaccuracy of
two dates for the hearing. The second date at the end of the legal was incorrect. She noted that it is
a 90 day appeal on procedural defects. The applicant agreed to proceed with the hearing.
Attorney Russell Wilkins represented Forty Two Ten Realty Trust. He cited the history of the site and
its evolution into an office from a residence which was initiated in 1972 when the Board of Realtors
occupied the structure. It was later sold to Attorneys Marty O'Malley and Peter O'Keefe and then in
1995 to Forty Two Ten Realty Trust. The 1994 Variance modification included a condition that the
structure could only be utilized for"one office suite only" (Variance No. 1994-110, Condition No. 4).
The applicant cited that the condition is too restrictive.
Parking on the site can accommodate up to 7 cars which is sufficient for the size of the building and
two suites or offices under the provisions of zoning. Permitting the two office suites would not
increase the numbers of clients coming on the property in that the building is not being expanded and
the division into offices does not intensify the use only the way it is utilized within. The total number
of employees that could be accommodated would not change because the space is limited to what
exists. Attorney Wilkins concluded that to remove the condition would not be detrimental to the
neighborhood nor in derogation of the Ordinance and the original Use Variance.
The public was asked to comment and no one spoke in favor or in opposition to the request to modify
the Variance.
The Board discussed the request citing that the 1994 modification found sufficient on-site parking was
provided at six spaces but seven spaces were installed including the one handicapped space
(Variance No. 1994-110, Finding No. 5). It was also found that only one office use was reviewed and
at that time only one office was requested (Variance No. 1994-110, Finding Nos. 8 & 9). They
discussed the need to limit the offices to professional uses that generate less traffic, the limit of two
suites and the limit of employees to four. The petitioner agreed that the structure was not capable of
handling more than four employees at any one time.

Finding of Facts:
Based upon the testimony given during the public hearing on this appeal,the Board unanimously
found the fol!owing findings of fact:
1. Forty Two Ten Realty Trust has appealed to the Board to modify Variance No. 1994-110 to
remove the restriction that limits the use of the premises to one professional office. The
application is seeking to allow for more than one office within the structure.
2. The property is a 0.34 acre lot located at 280 Winter Street in an Residential B Zoning District
and-has the benefits of a previous issued Use Variance that allows for professional office use.
3. The plans presented provide for a total of seven on-site parking spaces, 6 regular and one
handicapped space.
4. The relief sought in the 1994 modification was for one professional office use and was granted for
one suite only within the structure.
5. To permit two professional offices or suites with a total of four employees at any one time would
not be detrimental to the neighborhood nor derogate from the intent of the Ordinance or the
original Use Variance granted.
Decision:
Based upon the positive findings a motion was duly made and seconded to grant a modification to
Use Variance 1994-110 as requested in Appeal No. 1995-63 with the following conditions:
1. On-site parking shall be provided for seven (7) vehicles as on the plan submitted to the Board
titled "Plot Plan" and drawn by Yankee Survey Consultants and dated 1/24/95.
2. The use of the building is limited to a maximum of two professional office suites.
3. There shall be no further addition to the building without approval from the Board.
4. No medical or dental use is permitted in view of the sites proximity to downtown Hyannis and the
possibility that those uses could add to the congestion in the residential neighborhood.
5. The number of employees at any one time is limited to a maximum of four

Appeal Number 1995-63 has modified the Use Variance 1994-110 with conditions. This decision

must be exercised in one year. Appeals of this decision, if any, shall be made to the Barnstable
Superior Court pursuant to MGL Chapter 40A, Section 17,within twenty(20) days after the date of the
flin is dec' 'on in the office of the Town Clerk.
