Procedural Provisions: Section 5-3.2(2): Special Permits
Background Information:
The property is located on the east side of Winter Street two blocks south of the intersection with .
Barnstable Road. According to the Assessor's Field Card,the lot has 0.24 acres and contains a one story
office building.of 1,004 gross sq. ft.(GFA). The structure was built in 1962 and has gas service plus
public water and sewer.
This application is being presented for consideration in the alternative to Appeal No. 1994-73.
Site Plan Review[SP-20-94] approved the proposal on June 23, 1994 as shown on an enlarged plot plan
received by the Town of Barnstable BuildingDepartment June 1, 1994 containing a colored key to
"parking,handicapped parking,building,driveway,blue stone(surface),grass-shrub(area),sign
(location),slate walk,and ramp/porch".

Filed with Town Hall and Zoning Board of Appeals on July 8, 1994- and scheduled for hearing on August
3; 1994. Board Members sitting on this appeal are:E. Glynn,R.Boy,D.Bliss,E.Nilsson and Chairman

Attorney O'Malley representing Paul J. April explained that Mr. April would like to purchase a vacant
building and open an accounting and payroll service office. The property is rather distressed from being
empty so long and from a fire that had beset the property.
Previously a stable neighborhood,it now experiences a multi sectored environment. The middle section is
zoned RB,another contains business. The zones have changed several times and non-conforming uses.
and variances have allowed a psychiatrists office,a dentist and stock brokers resulting in a mixed office
and professional use area..It is`difficult to define where the RB zone line ends.'
In 1985,Bronstein and Cohen bought the property and then there was a fire in.1987 and since has been
vacant. A general decline insued in the neighborhood due to poor economy. The neighborhood is
experiencing some urban blight presently. Mr. April would like to try to bring it back to life with his new
three suite office.
The zoning ordinance maintains that after five years a non-conforming status benefit is lost however due
to mitigating circumstances including the fire and the economy Mr. O'Malley would like the Board to
grant a continuing non-conformance for the property. Mr. O'Malley argues that the building had been for
sale at all times as a commercial property and therefore perhaps did not fall into the category of being
abandon. This property has been taxed as an office building for twenty five years. .
Chairman Nightingale asked.for Public.Comment:
None was given but she read a letter written to the-file from Walter and Helen Piknick,an abutter
requesting the Board to maintain the residential aspect of this neighborhood and that they would be
opposed to any further changes.
Findings:
1:There was no intention to abandon the office use of this property and it was never used during that time
for residential purposes. It had continued to be advertised as a sale or lease of a commercial property and
there were mitigating circumstances due to the fire and the economy.
2. If the Board were to re-establish this property as an office it would not be substantially detrimental to
the neighborhood.
3. Site Plan Review approval has been obtained for a parking lot,walkaway and a ramp.

AYE: E. Nilsson,D.Bliss,R Boy,E. Glynn and Chairman G.Nightingale.

Conclusion:
A Motion was made by D.Bliss and seconded.by R.Boy to grant appeal no 1994-72 with the following
conditions:
1. Improvements to be made as per Site Plan Review
2. Office use only and not medical or banking use to be allowed.

Activity Request: To permit professional office use by two(2)principal occupants in
existing non-conforming use pre-existing zoning and which use has
not been abandoned. Interior improvements only-no change to the
foot print is being requested.
Procedural Provisions: Section 5-3.2(2): Special Permits
Background Information:
The property is located on the east side of Winter Street two blocks south of the intersection with
Barnstable Road. According to the Assessor's Field Card,the lot has 0.24 acres and contains a one story
office building of 1,004 gross sq.ft.(GFA). The structure was built in 1962 and has gas service plus
public water and sewer.
This application is being presented for consideration in the alternative to Appeal No. 1994-73.
Site Plan Review[SP-20-94] approved the proposal on June 23, 1994 as shown on an enlarged plot plan
received by the Town of Barnstable Building Department June 1, 1994 containing a colored key to
"parking,handicapped parking,building,driveway,blue stone(surface),grass-shrub(area),sign
(location),slate walls,and ramp/porch".

Special Permit for a Non-Conforming Use-Profession Office
Attorney O'Malley representing Paul J. April explained that Mr. April would like to purchase a vacant
building and open an accounting and payroll service office. The property is rather distressed from being
empty so long and from a fire that had beset the property.
Previously a stable neighborhood,it now experiences a multi sectored environment. The middle section is
zoned RB,another contains business. The zones have changed several times and non-conforming uses
and variances have allowed a psychiatrists office,a dentist and stock brokers resulting in a mixed office
and professional use area. It is difficult to define where the RB zone line ends.
In 1985,Bronstein and Cohen bought the property and then there was a fire in 1987 and since has been
vacant. A general decline insued in the neighborhood due to poor economy. The neighborhood is
experiencing some urban blight presently. Mr. April would like to try to bring it back to life with his new
three suite office.
The zoning ordinance maintains that after five years a non-conforming status benefit is lost however due
to mitigating circumstances including the fire and the economy Mr. O'Malley would like the Board to
grant a continuing non-conformance for the property. Mr. O'Malley argues that the building had been for
sale at all times as a commercial property and therefore perhaps did not fall into the category of being
abandon. This property has been taxed as an office building for twenty five years.
Chairman Nightingale asked for Public Comment:
None was given but she read a letter written to the file from Walter and Helen Piknick,an abutter
requesting the Board to maintain the residential aspect of this neighborhood and that they would be
opposed to any further changes.
Findings:
1. There was no intention to abandon the office use of this property and it was never used during that time
for residential purposes. It had continued to be advertised as a sale or lease of a commercial property and
there were mitigating circumstances due to the fire and the economy.
2. If the Board were to re-establish this property as an office it would not be substantially detrimental to
the neighborhood.
3. Site Plan Review approval has been obtained for a parking lot,walkaway and a ramp.

Conclusion:

Background:
The property is located on the east side of Winter Street two blocks South of the intersection with
Barnstable Road. According to the Assessor's Field Card,the lot has 0.24 Acres and contains a one story
office building of 1,004 gross sq.ft.(GFA).
The applicant seeks to construct a free standin sign(4' 4') 16 square feet. No drawing of the sign has yet
been provided.
Procedural Summary:
Filed with Town Hall and Zoning Board of Appeals on May 17, 1994,scheduled for hearing on July 6,
1994 and continued until August 3 by a signed extension at which time the Board denied this appeal.
Board members sitting on this appeal are:E. Glynn,R.Boy,D.Bliss,E.Nilsson and Chairman G.
Nightingale.
Attorney O'Malley representing Mr. April requested a sign variance for the property at 290 Winter Street
for a 12 square feet sign whereas the zoning ordinance 4-3.5(5)requires: "Where a legal non-conforming
business exists within a residential district,one(1)sign may be permitted by the Building Commissioner
if it is determined that the appearance,placement,size and lighting of the proposed sign will not be
detrimental to the residential character or visual quality of the area. In no instance shall such signs
exceed eight(8)feet in height or eight(8)square feet in area". However Attorney O'Malley stated that
because of soil, shape and topography this parcel is unique and would create a financial hardship for his
client if a sign was not big enough for the passing traffic to view. As example Mr.O'Malley states that
Mycock has a 10 sq.ft sign in the same neighborhood. Mr. O'Malley states that there will be no lights on
the sign. Mr.O'Malley said he has been through Site Plan Review for the sign.
Public Comment was requested by Chairman G.Nightingale but none was given.

FINDINGS:
1. The plan that has been submitted before the Board is for a sign,four (4)square feet and by our zoning
ordinance section 4.3 (5)the request is in excess of the eight(8)square feet maximum.
2. The excessive size is needed because of the uniqueness of the design and shape of the sign.
3. The sign will not be a detriment to the neighborhood.
4. The sign will have no lighting.
