Bruce Macgregor to apply for a demolition permit to remove two structures located at 210 Yarmouth Road as they have been determined by you to be unsafe and in violation of 780 CMR of the Massachusetts State Building Code Chapter 1 SECTION 116 AND M.G.L. C. 143 6-12. Mr. Macgregor has decided he will demolish the two buildings instead of boarding them up provided Mr. Macgregor is provided a letter in writing from the appropriate board or boards to rebuild the demolished buildings within at least three years of issuance of the demolition permit. Said new buildings if rebuilt, shall be the same as what exited prior to said demolition. There are two buildings situated on this lot. The applicant seeks to establish a small daycare and office in addition to the sanctuary. Health inquired about the trash disposal method. This is done daily, the applicant responded. Mr. McKean asked about the water and sewer lines. The applicant was unsure about the sewer connection. The water is connected, he noted. Planning noted that this is a permitted use but expressed concern regarding the parking provisions. There are 14 , Pastor Abraham stated. We can fit 10 comfortably. Currently, the parishioners utilize a total of 7 cars. It is a very small congregation. The meetings are Tuesday and Thursday evenings and Sundays. Engineering commented that the overflow parking (in the lot across the street- Appliance Mart)would be adequate for the times that the services do not overlap the extended store hours. The Building Commissioner asked the applicant about the history of the building as he had been informed that there was a fire in one of the structures. The applicant indicated that this was true but the damage was to one side of the building and adequate repairs have been made in order to allow the use. In response to a question about the number of members, the Pastor replied that there are currently 10 - 15 members. Currently, they are leasing this building but they would eventually like to purchase it. The Commissioner questioned the applicant regarding the size of the area in front of the stage. Discussion ensued during which it was estimated that the church has six, 12' pews. (six on each side of the aisle). There could be over 100 people there the Commissioner exclaimed. Approval would be conditional; a restriction on the number of parishioners would be imposed. Health interjected to inform the panel that town records indicate that this property is not on town sewer. The applicant was ultimately limited to 50 members. It was determined that there is a cess pool on this site. If the system is not failing the church will be allowed to utilize as is until a threshold/or failure triggers Title 5 upgrading. The applicant must have an inspection performed and provide documentation to the Health Department. Conclusion: Continued pending the results of the septic inspection.
