Parcel Number 011 fronts on Yarmouth Road (Willow Street) and Ferndoc Street and Parcel Number 022 fronts on Old Yarmouth Road and Ferndoc Street. The site totals 1.37 acres and is developed with a one-story, 44 by 60 foot(2,640 sq.ft.) industrial/commercial building built in 1965. Presently the site is unused but was previously occupied by the"Willow Street Feed and Garden" shop. The site is owned by Willow Street Feed & Garden, Inc. and is under agreement for sale to the applicants. The applicant, Mid Cape Tire, is presently operating a tire and auto repair shop at 372 Yarmouth (Willow Street),just south of the subject locus. The applicant is proposing to improve the site with 7,514 sq.ft. one-story, 7-bay garage building and associated site improvements including improved parking, landscaping, septic system ,site drainage and containment improvements. Procedural Summary:: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 24, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on May 24, 2000 and continued to June 07, 2000, at which time the Board granted the Variance requested. Hearing Summary: Board Members hearing this appeal were Gail Nightingale, Gene Burman, Richard Boy, and Chairman Ron Jansson. Attorney John Alger represented the applicants, Frank Klucevsek and John D. Kmetz, who were present along with David C. Thulin, Professional Engineer. Attorney Alger submitted a Purchase and Sales Agreement to establish standing. He also submitted a letter defining the applicant's right to incorporate half of the area within the roadways as they are owned by the applicant. Attorney Alger reviewed the proposal before the Board. The applicants are seeking permission to transfer their business 300 yards up the street and conduct the same business there that they are conducting on their current site. Both the current location and the new location are within the wellhead protection overlay district which does not allow for the repair.of automobiles which is an essential part of their business. If Town of Barnstable-Zoning Board of Appeals-Decision and Notice Mid Cape Tire-Appeal Number 2000-42 Variance-Section 3-5.2(7)(B)(b)WP Wellhead Protection Overlay District&Section 3-5.2(6)(B)(m). the applicants relocate their business, they are proposing to install a state-of-the-art septic system and will comply with all regulations related to the business. The proposal received Site Plan Review Approval.. The applicants have indicated they will restrict[by deed] any new business on the current site from any use that is prohibited in the wellhead protection overlay district. The move to the new site 300 yards away would be a benefit to the public safety as it is safer to enter and exit from the site further down the street. David Thulin, Professional Engineer, addressed the Board. He reviewed the existing conditions and explained the new plan, the impervious and pervious conditions, wastewater disposal, and stated they meet all Title V criteria. All drainage on site will be self contained in an open infiltration basin. The building will have no floor drains. As to containment on site, the tires will be stored in a 12'x 20' structure. The applicant has weekly and/or biweekly pick-up so this size structure is adequate. A 21 E inspection was done at both the current site and the new site with no hazardous materials found. The Board asked about hazardous materials. The applicant stated there would be engine oil, used engine oil,antifreeze, and batteries. The issue of storage has never come up before and the applicant did not have a definite answer. If the Board would like, the applicant stated he would look into the different types of storage.systems for containment to make sure all the hazardous material is contained on site. As to the business use; the auto repair portion is a minor portion of the business. The principle use is tires, brakes, shocks, and alignment. They will comply with all Board of Health regulations. The Board was concerned that the auto repair use was fully addressed at Site Plan Review. Attorney Alger indicated he would have the applicants return to Site Plan Review to make sure the committee is aware of all the uses proposed for this site. Public Comment: No one spoke in favor or in opposition to this appeal. The appeal was continued to June 07, 2000. At that continuance, the Board received a letter'from the Building Commissioner dated May 31, 2000, which states, in part, "The panel was acutely aware that a minor portion of.the applicant's business includes oil changes and the repair of radiators" and "...You should be aware that it is the position of the Site Plan Review panel that this innovative solution works for both the applicant and the town and is enthusiastically supported." Roy Catignani, ConSery Group, Inc., presented a plan entitled, "Proposed Facility for Mid Cape Tire Company, Oil Containment Area." This addresses where hazardous materials are proposed to be stored on the site. It is an area to the rear, center of the building, which will include a 300 gallon motor oil tank, a 300 gallon waste oil tank and six 55 gallons for anti-freeze and waste anti-freeze. This will be on a 12" deep concrete slab with a concrete curb. Mr. Catignani explained the containment calculations, safety factors, and storage plans and that even under catastrophic events all hazardous materials on the site - «would be contained. Findings of Fact: At the hearing of June 07, 2000, the Board unanimously found the following findings of fact as related to Appeal Number 2000-42: 1. The applicants, Frank Klucevsek and John D. Although Barnstable's Zoning Ordinance does not include any provisions for moving a non- conforming use or exchanging of uses, the applicant has volunteered to abandon the non-conformity in use that exists at their present location at 372 Willow Street in exchange for this site. The benefits to the Town would be that the facility would be improved with the latest in technological advances to contain any possible hazardous wastes from entering into the groundwater, a vacant site would be improved to current zoning and engineering standards and the new location is further away from the public wells. The applicant in turn would be securing a larger site with better access. 8. The site plan was found approvable by the Site Plan Review Committee on March 02, 2000 with conditions: 9. Unique conditions exist that affect the locus but not the zoning district in which it is located. To move this existing business to the proposed location -further from the.wellhead protected area-would be a plus for the Town. 10. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner. 11. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in Appeal Number 2000-42 subject to the following terms and conditions: 1. The site is to be developed in accordance with plans submitted entitled "Proposed Site Improvements 426 Yarmouth Road Willow Street, Barnstable, (Hyannis,), MA for Mid Cape Tire and Auto Service Center" dated February 17, 2000 drawn by David C. Thulin, PE, PLS, and consisting of 3 sheets. Use of the site is limited to tire and brakes (including shocks) repair, replacement and alignment, which shall be the major uses on site and sales and oil changes which shall be accessory (minor uses). Ultimately, the applicant proposes to relocate two doors away from the existing location and further away from the well head. The largest unresolved issue.from the previous hearing concerns the 330 regulation. Calculations offered at that time showed that the applicant was unable to comply. In response to this, the applicant submitted water meter readings to support their claim regarding actual use. Engineering commented on the status of a"way"designated on the site plan. Dave Thulin advised the panel that Attorney John Alger determined that the applicant's property is to the centerline of the way. If this in fact is true, then the calculations may be reconfigured to show compliance with the DEP standard. The Building Commissioner advised the applicant to work out the details with Tom McKean, the Board of Health and the DEP. At this time, he expressed that it appears to be in the best interest of the town to allow the applicant's unique proposal to transfer their granderfathered right to another location, while also providing & enforcing a restriction of use on the original site. Planning advised the applicant to file with the ZBA. Discussion ensued about the provision of a spill system and types of products stored on site. The applicant informed the panel that all storage tanks are above ground and a retention system shall be installed. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on May 24, 2000 and continued to June 07, 2000, at which time the Board granted the Variance requested. Hearing Summary: Board Members hearing this appeal were Gail Nightingale, Gene Burman, Richard Boy, and Chairman Ron Jansson. Attorney John Alger represented the applicants, Frank Klucevsek and John D. Kmetz, who were present along with David C. Thulin, Professional Engineer. Attorney Alger submitted a Purchase and Sales Agreement to establish standing. He also submitted a letter defining the applicant's right to incorporate half of the area within the roadways as they are owned by the applicant. Attorney Alger reviewed the proposal before the Board. The applicants are seeking permission to transfer their business 300 yards up the street and conduct the same business there that they are conducting on their current site. Both the current location and the new location are within the wellhead protection overlay district which does not allow for the repair of automobiles which is an essential part of their business. The proposal received Site Plan Review Approval. The applicants have indicated they will restrict[by deed] any new business on the current site from any use that is prohibited in the wellhead protection overlay district. The move to the new site 300 yards away would be a benefit to the public safety as it is safer to enter and exit from the site further down the street. David Thulin, Professional Engineer, addressed the Board. He reviewed the existing conditions and explained the new plan, the impervious and pervious conditions, wastewater disposal, and stated they meet all Title V criteria. All drainage on site will.be self contained in an open infiltration basin. The building will have no floor drains. As to containment on site, the tires will be stored in a 12'x 20' structure. The applicant has weekly and/or biweekly pick-up so this size structure is adequate. A 21 E inspection was done at both the current site and the new site with no hazardous materials found. The Board asked about hazardous materials. The applicant stated there would be engine oil, used engine oil, antifreeze, and batteries. The issue of storage has never come up before and the applicant did not have a definite answer. If the Board would like, the applicant stated he would look into the different types of storage systems for containment to make sure all the hazardous material is contained on site. As to the business use, the auto repair portion is a minor portion of the business. The principle use is tires, brakes, shocks, and alignment. They will comply with all Board of Health regulations. The Board was concerned that the auto repair use was fully addressed at Site Plan Review. Attorney Alger indicated he would have the applicants return to Site Plan Review to make sure the committee is aware of all the uses proposed for this site. Public Comment: No one spoke in favor or in opposition to this appeal. The appeal was continued to June 07, 2000. At that continuance, the Board received a letter from the Building Commissioner dated May 31, 2000, which states, in part, "The panel was acutely aware that a minor portion of the applicant's business includes oil changes and the repair of radiators" and "...You should be aware that it is the position of the Site Plan Review panel that this innovative solution works for both the applicant and the town and is enthusiastically supported." Roy Catignani, ConSery Group, Inc., presented a plan entitled, "Proposed Facility for Mid Cape Tire Company, Oil Containment Area." This addresses where hazardous materials are proposed to be stored on the site. It is an area to the rear, center of the building, which will include a 300 gallon motor oil tank, a 300 gallon waste oil tank and six 55 gallons for anti-freeze and waste anti-freeze. This will be on a 12" deep concrete slab with a concrete curb. Mr. Catignani explained the containment calculations, safety factors, and storage plans and that even under catastrophic events all hazardous materials on the site would be contained. The benefits to the Town would be that the facility would be improved with the latest in technological advances to contain any possible hazardous wastes from entering into the groundwater, a vacant site would be improved to current zoning and engineering standards and the new location is further away from the public wells. The applicant in turn would be securing a larger site with better access. 8. The site plan was found approvable by the Site Plan Review Committee on March 02, 2000 with conditions: 9. Unique conditions exist that affect the locus but not the zoning district in which it is located. To move this existing business to the proposed location -further from the wellhead protected area --would be a plus for the Town. 10. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner. 11. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. To accomplish the plan the applicant would require a Variance for the Section 3-5.2(7)(B)(b)-WP Wellhead Protection Overlay District Regulations, Prohibited Uses, Motor Vehicle Service and Repair., Although Barnstable's Zoning Ordinance does not include any provisions for moving a non-conforming use or exchanging of uses, the applicant has volunteered to abandon the non-conformity in use that exists at their present.location at 372 Willow Street in exchange for this site. The benefits to the Town would be that the facility would be improved with the latest in technological advances to contain any possible hazardous wastes,from entering into the groundwater, a vacant site would be improved to current zoning and engineering standards and the new location is further away from the public wells. The applicant in turn would be securing a larger site with better access and an expanded business opportunity. Public Notice Concern: The application and the Public Notice for this appeal all cited the Zoning District to be an "RB Residential B Zoning District".- The correct district is "B Business B Zoning District". SPR 05-00 Mid Cape Tire,426 Yarmouth Rd.,Hyannis,(344-011 &012) Dave Thulin reviewed this application continued from 1/20/2000. Ultimately,the applicant proposes to relocate two doors away from the existing location and further away from the well head. The largest unresolved issue from the previous hearing concerns the 330 regulation. Calculations offered at that time showed that the applicant was unable to comply. In response to this,the applicant submitted water meter readings to support their claim regarding actual use. Engineering commented on the status of a"way"designated on the site plan. Dave Thulin advised the panel that Attorney John Alger determined that the applicant's property is to the centerline of the way. If this in fact is true, then the calculations may be reconfigured to show compliance with the DEP standard. The Building Commissioner advised the applicant to work out the details with Tom McKean,the Board of Health and the DEP. At this time,he expressed that it appears to be in the best interest of the town to allow the applicant's unique proposal to transfer their granderfathered right to another location,while also providing&enforcing a restriction of use on the original site. Planning advised the applicant to file with the ZBA. Discussion ensued about the provision of a spill system and types of products stored on site. The applicant informed the panel that all storage tanks are above ground and.a retention system shall be installed. There is no gasoline stored on site and the only products used are lubricants and petroleum products. The•business is devoted to brake replacement,shock absorbers and replacement and alignment of tires. A 12 X 20 shed is proposed to store the tires. The applicant uses only mineral oil for cleaning,no chlorine, or chemical products. The applicant was advised to produce a manifest and supporting documentation. Planning also inquired about the lighting provisions. It was determined that the building mounted lighting shall be sufficient. Engineering commented that the revised plan appears to address most of the concerns issued during the previous hearing. The applicant was questioned'regarding the arrival of deliveries. The response indicated that deliveries occurred at approximately 6:30 AM in order to avoid conflicting with the daily schedule. During discussion,Steve Pisch issued concern regarding the gravel area. Conversation revolved around the parking needs of the applicant. The applicant claimed to need 20 parking stalls due to the scheduling of clients. Some automobiles are dropped off over night in advance of the day's appointment. They seek to retain the gravel employee parking area along Ferndoc. Conclusion:Approved with the following conditions: • Attorney John Alger shall submit a letter defining the applicant's right to incorporate the area to/from the designated property line to the centerline of the "Way"thus allowing the applicant to reconfigure the flow. • The applicant shall confer with the Board of Health(and DEP if necessary)regarding the computation of said flow. • The applicant shall restrict the use of the original site by maintaining control of this property or by creating a deeded restriction. Be advised that the panel ultimately agreed with the applicant's contention that allowing this grandfathered use to be relocated away from the well heads effectively reduces the potential environmental hazard. The panel was acutely aware that a minor portion of the applicant's business includes oil changes and the repair of radiators. In order to comfortably approve this unorthodox decision, the panel required the ' applicant to record a deed restriction on the former site. The applicant(and landlord)was also mandated to maintain environmentally friendly tenants. You should be aware that it is the position of the Site Plan Review panel that this innovative solution works for both the applicant and the town and is enthusiastically supported.
