MA File#40/54A - 95-21 Dear Mr. Crossen: I am writing with respect to your request for my confirmatory consent to the issuance of a Building Permit #639 issued November 10, 1977 for an existing wooden building located at,519 Yarmouth'Road_;Hyannis,aMassachusetts. A hearing was held at the Executive Office of Transportation and Construction on Monday, October 16, 1995; after publication of notice in The Barnstable Patriot of Barnstable, MA on September 14, 1995. Massachusetts General Laws, Chapter 40, Section 54A provides that a city or town must obtain the concurrence of the Secretary of Transportation and Construction prior to the issuance of a building permit for any structures on lands formerly used by any railroad company in the Commonwealth as a railroad right-of-way or lands appurtenant thereto. The explicit purpose of the statute is to preserve former railroad property in the Commonwealth for present or future transportation-related uses. - As the executive officer responsible for comprehensive planning in the areas of transportation and construction, I have the obligation under the statute to protect such property for transportation-related uses. It has been determined that the existing building does not adversely impact any existing transportation uses. However, the development of the Hyannis Intermodal Center, and related improvements to be made to both Yarmouth Street and the parallel railroad corridor may have a bearing on the parcel in question. This confirmatory consent should not be construed as concurrence with future building activity on this site. This being the case, I hereby concur with issuance of the building-permit.
