Venezia. First I should state a fact that you well know;there is-d change in the character of the neighborhood. Although in a Business District this area was. once a resi- dential community. It is changing to a business related district. Prior to construction of this complex the original owner Dr. William Jones did, although not required, contact his neighbors to inform them of his plans. - I believe I did advise you that Dr. Jones had a kennel license. The property and business transferred to a new owner. Notification to abutters is not a re- quirement and this is in a business district. In order to control the noise of barking dogs Dr. Venezia has installed .air- conditioning and a ventilation system in the kennel. In his conversation Dr. Venezia said he adheres to his agreement with you of letting the dogs out for exercise at 8:30 a.m. and housing them again at 6:00 p.m. ` The latest addition is, of course, the pigeons. Dr. Venezia has raised pigeons as a hobby since he was twelve years old. He breeds pigeons at home and brings them to his place of business for proper daily care and training. The birds are trained to stay on the property. I witnessed the birds on the roof of the pigeon house. He showed me how he coached them into the pen. When they fly, they fly in circles, which does go over your "air space". Otherwise, they. are trained for long flights. Notification to abutters is not a requirement in a business zone. Having lived in your home since 1944 I can understand the frustrations as the area changes with varied business uses. Must you live with noise and barking dogs? . Finally, I did express the concerns of your family. Dr. Venezia did state that although you have made several complaints it is his desire to avoid any problems. He installed the fence so you wouldn't have to look at the sheds. He will continue-with his hobby until the pigeons are grown and will abide by . the agreed schedule. The building itself has been on Yarmouth Road for many years , and was previously owned by Dr. Jones , a veternarian. Dr. Jones had contacted the abutors previous to the animal hospital being built, and in all his years there never caused any problems. The building was bought by Lawrence Venezia, who then put up a kennel and began to board dogs . The abutors were never notified that a kennel was being built, or that any changes were taking effect on the existing license+ . I, Dorothy M. Brito, visited your office initially in the Spring of 1985 , to inform you of the increased noise due to the kennel and to see what could be done about the situation. You said you would attempt to resolve the problem by regula- ting the hours that the dogs could be outside to control the noise factor. That seemed to work for a short time , and we overlooked any variances in the times that the dogs were out- side, barking incessantly. Last month, June 1986, Dr. Venezia had a new structure built to house homing pigeons . Once again the abutors were not notified. I then went to your office again and spoke to your assistant who said he knew of the pigeons and also knew that they were let out once in the norning and once in the after- noon. This is correct, but what he failed to realize is that Page 2 r the pigeons are being let out for hours at a time. The pigeons c� land on our property and create a nuisance with their droppings. While we cannot prove this is due to the pigeons in question, the amount of bird droppings has increased substantially since their arrival. We're sure you can realize it is extremely an noying to have to re-wash clothing and constantly wash our cars and patio furniture. We attempted to discuss the pigeons with Dr. Venezia directly, who was very unopoperative. After that, he began to leave the dogs outside practically all day , barking constantly. On June 28, after a whole morning of barking, we called the Barnstable Police who informed us that nothing could be done, as Dr. Venezia had a court order allowing him to keep the dogs out as long as he wanted to. We have lived in our home since 1944, and as long time resi- dents and taxpayers we would like to know what can be done to resolve this situation? What are our rights regarding the noise problem? What was necessary for Dr. Venezia to obtain a kennel license? Is there such a court order that allows a dog to remain outdoors and bark incessantly? Are the pigeons part of the profession or a hobby? If it is a hobby, why isn't it done at his home instead of his place of business?
