DEFINITION OF HOMEOWNER Person(s)who owns a parcel,of land on which he/she resides or intends to reside, on which there is,or is intended to be, a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit.'(Section 109.l.l) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes,bylaws,rules and regulations. Signatu a of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 12.7.0 Construction Control HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.].1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." 1 Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that_he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. Smith. Sec. A should be ` clarified by requiring the proposed leach pit to be a standard 1000 gallon precast pit surrounded by 4 feet of stone and supplied with a standard frame and grate. Section D refers to drainage lot #5. The lot will be kept in its present state as the outflow pipe i directs the runoff water to the low area of the lot and natural percolation dissipates the water effectively. Section E is ac- ceptable as long as the following stipulations are met: The side slopes should be graded to an approximate 2:1 slope and stabilized by seeding or sodding. 2. The drainage lot should be fenced in with a standard we chain link fence the design of which should be O.K'd by the Engineering Department prior to construction -------- Shrubs should be planted around the perimeter of the fence to beautify the area and the entire disturbed area should be loamed and seeded around the perimeter of the drainage basin. 4. Upon receipt of notification of recording, the Board shall file one print of the Definitive Plan with the Building Inspector. Where approval with covenant is noted thereon, he shall issue no permit for the construction of a building on any lot within the subdivision except upon receipt from the Board of a copy of the certificate of performance (Form G) releasing the lot in question. 10. Revision of Definitive Plan No revision or change of the Definitive Plan can be made C hout the prior approval of the Planning Board. This includes revision of any nature whatsoever of the Definitive Plan. If applicant desires to make revisions due to field conditions or any reason whatsoever, he shall submit a print of the defint- plan or plans to be revised with a colored pencli representa- of the changes he proposes to make. Evidence of Satisfactory Performance Before the Board will release the interest of the Town in a performance bond or deposit or, in the case of approval with a covenant,.issue a release of covenant: (a) The applicant shall furnish the Board with satisfactory evidence of compliance with the provisions of 3-C-9. (b) The applicant shall be responsible for filing with the Plan- ning Board as-built plans of the ways of the subdivision, clearly marked as such. The as•built plan shall include the profile plan and shall meet the requirements as to format and content as given in Section 3-C-Q) for the Definitive Plans. The as-built plans may be cloth reproductions of the Definitive Plans. The as-built plans shall represent the as-built conditions of all work and appurten- ences constructed as a requirement of the subdivision and shall show with a reasonable degree of accuracy all municipal services installed as.part of the subdivision. As a condition precedent to the preparation of the as-built plans, the applicant shall engage the necessary engineering services to properly record the location of the municipal services installed, and the as-built plans shall con- tain a certification by such engineer that the municipal services were installed in the location as shown on the plans. The as-built plans shall be submitted as a condition of the release of the Bond or Covenant, as required for the approval of the Definitive Plan, and as a condition of approval by the Planning Board of accep- tance of the ways by the Town Meeting. The "blow out" pipe located on the north, northeasterly corner of Bridget 's Path and Taramac Road will be connected to a pit with stone frame and and grate. i B. The connected basins at the junction of Skunkn.et and Ta ramac will be altered to eliminate the discharge on the west side ' of the road and a new 10" storm drain connected on the east side to allow excess flow to gravitate to the low spot east of Skunknet Road. C. In conjunction with "B" Smith agrees to grant a drainage easement along that portion of Lot 1 (Five Corners Village A.N.R. Plan) . necessary to allow for drainage, 'D. -'Opposite `the drainage lot (##5) on Bridget 's Path a berm will be installed 'to direct the overspill to the storm basins. The eroded shoulder will be repaired. F. Finally, the drainage lot on Ames Way needs extensive work a. done. The present "hole" was dug to alleviate the flooding at the junction of Sean's & Ames caused by three th'ngs : 1) the large amount of surface area being drained 2� the _ general flatness of the terraine 3) poor engineering with regard to the initial drainage plan. Since "the hole" has corrected the problem to the point where not even a puddle exists I would like to propose that we alter the original drainage .plan to call for an upgrading of the present open drainage pit.
