However,there is nothing to stop us from sending a reminder that a B&B Use is prohibited in the zoning district and provide copy of the most recent advertisements that you provided us. As an example of this, in June I called the police for some guidelines for what is going on next to me as I did not feel safe. They said to call the Town Manager. Which I did. Town Manager Office said it was a Board of Health issue and transferred my call there.... This scenario repeated itself several times. Believe me, we were not trying to `bog this system down' or spend our time unnecessarily. i Speaking at Town Council provided the Councilors a chance to hear my voice and see me. Meeting with Britt Beedenbender allowed me to express the neighborhood concerns face to face with a real person. There is no way I can guess what is going on at the Town government level. As to the "disheartening assumption that town officials were not addressing the matter", you are correct. It is disheartening to not hear or be informed if something is being done and I think a quite natural conclusion that in the absence of comment, perhaps that nothing is being done. Not wanting the issue to be dropped, we persisted. This isn't a fault, it was the only way we have to keep our neighborhood concerns alive. This never started out being an"Airbnb complaint". It started out with a request to enforce current residential zoning. Being lumped in with other, more broad-based home rentals could do a disservice to our issue. We are not talking of an entire home being rented. We are talking about an owner using a residential home to rent one, two or three bedrooms, host events and parties and serve food to strangers. On a small cul de sac street with closely spaced homes and little parking. One of the strangers has already come into our yard leaving us very concerned about what might come next—i.e. strangers coming into the house. Waiting months for a resolution to this is very difficult. We haven't had any semblance of comfort at home for months. This is exhausting. Yes, the on-line website of VRBO is the marketing method used by the owner of 31 Babbling Brook Road, where they advertise as a B and B. But our issue never `morphed'. This misunderstanding coupled with your seeing this issue as being `frivolous' and `flip-flopping' stun me. Communicating via e mail does not allow the reader(me and my husband in this case) to understand the tone of voice of the writer(you in this case). I'd like to develop a feeling of respect and trust as we go through this process. If we can meet in person perhaps you can judge for yourself the level of my sincerity and level headedness. The fact of the matter is that this issue is entered into our code compliance system as I have explained to Ms. Dooley on several occasions and we are addressing it. I would remind Ms. Dooley that during one of our discussions we agreed that the rental season is all but over and I assured her then that we would have a conclusion to this prior to the next rental season. I have also explained to Ms. Dooley that Legal, Planning and I are actively working on what started out as an AirBnB complaint. When I explained that addressing AirBnB was not so cut and dry the complaint morphed into a Bed and Breakfast complaint. Any enforcement action that we take has to be taken with one goal in mind... a successful court challenge. The Town could throw a frivolous complaint into the court system and lose but that solves nothing and could result in an approval for your neighbor. Our efforts need to be thoughtful and accurate,flip-flopping on charges may work in complaints and public opinion but it won't work in court. I understand that you (collectively) have not been privy to staff discussions or inter-agency communication and cannot know of our efforts... but please understand that this is a priority for us and we are working on it. Also understand that that assumptions, innuendo and numerous complaints serves no useful purpose. As your zoning enforcement officer I have a responsibility to respond to your request for enforcement under the General Laws of the Commonwealth. M.G.L. c. 40A § 7 provides that: ... If the officer or board charged with enforcement of zoning ordinances or by-laws is requested in writing to enforce such ordinances or by-laws against any person allegedly in violation of the same and such officer or board declines to act, he shall notify, in writing, the party requesting such enforcement of any action or refusal to act, and the reasons therefor, within fourteen days of receipt of such request. While the "officer or board" is required to notify you within 14 days of their "refusal to act"there is no provision or requirement for notification otherwise. Nevertheless, we have notified you of our intent to act by telephone and while there may be no requirement for notification of our intent to act please accept this written correspondence as our intent to act on Ms. Dooley's written request for enforcement. We have already taken several steps to do so. There is no requirement under the GL for further notification or updates and I explained that to Ms. Dooley however we will do our best through myself or Robin Anderson to keep you apprised of our efforts. In your letter you allege that because the owner is allowing Cape League Baseball Players to stay in the home there is a continuing a violation of the Town's zoning ordinance for which a cease and desist order was issued. Further,that the owner is ignoring a directive from the Zoning Board of Appeals (ZBA). Based upon your assumptions you ask that I"enforce the directives issued by you and the Board of Appeals It appears from your letter[para. 3]that the basis of your argument is.that because the owner is receiving compensation in exchange for housing; she is continuing to violate the RC zoning districts prohibition of bed and breakfast facilities. In your own words however you state that the owner receives"reimbursement"for allowing Cape League players to stay in the home as guests. The practice of"reimbursing"host families is consistent with my understanding of how many of the Cape League's teams provide housing for their players for the summer.baseball season. For example,I reference the Hyannis Harbor Hawks website which reads: PERKS.-Host brothers and sisters are given on field access after home games,priority for bat boys/bat girl opportunities,families receive a stipend to help with some of the costs of adding a family member for the summer. I would disagree that these host families are receiving compensation in exchange for housing, but rather that they provide free housing to players and are reimbursed for a portion of some of the costs associated with hosting,a player, not all. In speaking with two of the teams' managers I have been informed that the"reimbursement"that is received doesn't even`cover food costs and that the hosts are in fact volunteering to house players as guests in their home for the summer to play ball. After an investigation and a careful review of the facts.1 have found'that: 1. My October 16,2018 order to cease and desist use of the property as a bed and breakfast as defined in the-zoning ordinance has been and continues to be complied with. 2. No decision was ever made with respect to Zoning Board of Appeals(ZBA)variance request number 2019-001. The matter was withdrawn from consideration by the applicant before the ZBA made a decision. This is a violation of the zoning laws in this RC designated area which does not permit this type of business. In October, you issued a Cease and Desist Order. After receiving this order, the owner, Donna Starr, promptly applied for a variance to the Zoning Board of Appeals. At their January meeting, the Appeals Board denied her application. In May of this year, a large number of overnight visitors with their cars have been observed on and around this property. At first, we thought these visitors might be family. In a conversation with one of the visitors, Richard Dooley who lives next door to 31 Babbling Brook, learned that this young man, Alex Garbrick, is presently a student at Morehead State University and is affiliated with the Cape Cod League. His car with Pennsylvania license plates is always parked on the street. Three additional cars with plates from Georgetown, Ontario, Virginia and Massachusetts are parked each night. These cars would appear to be the property of Ben Abram, from Georgetown, Ontario, Kyle Witten from Manassas, Virginia and Kyle Murphy from Billerica, Massachusetts. All of the young men are affiliated with the Hyannis Hawks and the Cape Cod League. According to its website, the Cape League reimburses host parents up to $900.00 per season per player. The League also requires that a host family provide lodging to only one player at a time. It appears that Donna Starr has taken what should be a good will gesture from a town resident and turned it into another way of monetizing her home. It is'our concern and one shared by our neighbors that this flagrant flouting of two town directives by Donna Starr will continue. After the baseball season is over, additional guests will arrive. A revolving door of transients will appear, our children and grandchildren will have to be on alert, our property values will decrease, and this residential neighborhood takes on the character of a commercial property. We ask that you enforce the directives issued by you and the Board of Appeals.
