In.the Notice of Intent and in his presentation to the Commission at the hearing stage, whether through ignorance or with intent, Mr. Gaspard made a number of misrepresentations to the, Commission concerning the status of his property, the wetland resources on that property, the true details of the planned.expansion, and compliance with Massachusetts environmental regulations. As a result of the misrepresentations, the Commission-failed to consider the applicability of key regulations and approved the project to go forward in direct contravention of the Wetlands Protection Act, including, the Rivers Protection Act, M.G.L. Chapter 131, section 40,.implemented by 310 CMR 10.00, and without considering the Endangered Species Act, M.G.L. c. 131A, implemented by 32.1 CMR 10.00. 1) Rivers Protection Act=A. In Mr. Gaspard's Notice of Intent("NOI") and also during his-presentation at the Conservation Commission hearing, Mr. Gaspard represented to the Conservation Commission that the Massachusetts Rivers Protection Act does not apply to the project. A copy of Mr. Gaspard's Notice of Intent is affixed as Attachment A. Mr. Gaspard failed to notify in Section B(1)that the Project is located in a Riverfront area. In fact,the Notice of Intent described the site as follows: "The site is directly adjacent to an , extensive marsh system that was formerly a cranberry growing land area now over grown with a thick common reed community. ... The old-ditches within this wetland are still visible and appear on the USGS map for the area but are not rivers due to the former cranberry irrigation function. No flow was,observed in the ditch nearest the site." In fact, a perennial stream has existed adjacent to the Property since at least the 1893, according to the United States Geological Survey("USGS")map of the area. See Attachment B. There is no indication of any cranberry growing on the 1893 USGS map only a naturally occurring perennial stream entitled to the protections of the Rivers Protection Act. For some period after World War II, the area of the perennial stream was used for cranberry.growing, and the upper reaches of the perennial stream was diverted and connected to cranberry trenches. The cranberry operations ceased many years ago and the stream in the vicinity of the Project has continued to flow in the same location and with the same approximate flow as it.did historically before the cranberry operation. See current USGS map and Land Court Plan affixed as Attachment C. 2 f The issue of the Rivers Protection Act was raised at hearing, but was not specifically addressed in.the Order of Conditions. However, from discussions at the hearing, it appears that the Commission found that the Act did not apply to the Project based on 310 CMR 10.58(2)(a)(1)(d), which provides: Man made canals (e.g.,the Cape Cod Canal and canals diverted from Rivers in Lowell and Holyoke) and mosquito canals.associated with coastal.Rivers do not have riverfront areas. The perennial stream in question does not lose its natural characteristic as a - perennial stream, subject to the Rivers Protection Act,just because the original stream bed has been altered. If this were the case there would be no protection for the Charles .River and other rivers and streams where the banks have been altered and/or filled. Likewise there would be no Rivers Act Protection for virtually all of the streams in Newton where the stream'beds were concreted to eliminate mosquito habitat when polio was epidemic. The language of the exception is clear: it applies only to purely man-made structures. Where a statute or regulation is clear and unambiguous, it must by law be given its common meaning and be construed narrowly. See_Gurley v. Commonwealth, 363 Mass. 595, 598 (1973)("Where the language of a statute is plain it must be interpreted in accordance with the usual and natural meaning of its,terms."). If the Rivers Protection Act was intended not to apply to all altered perennial streams and rivers,that would have been explicitly stated in the law and regulations. As it was not, this modified perennial stream should be provided the full protections of the Act. As documented in the photographs affixed as Attachment D, the stream flow continues to be extensive. 3 2) Rivers Protection Act-B. The Project Expands the Existing Structure Within the Riverfront Area in Violation of the Act. The existing structure at 356 Bay Lane is located within 200 feet of this stream and is therefore, subject to the Rivers Protection Act. While the existing'structure may be grand fathered under the Rivers Protection Act regulations and Barnstable regulations, the expansion proposed by Mr. Gaspard is not included within that grand fathering clause,.does not conform to the requirements of grand fathering as of right or the exemption that would permit the proposed expansion to occur within 200 feet of the Riverfront pursuant to 310 CMR 10.58(5), The engineering plans produced show that Mr. Gaspard intends to build his project beyond the boundaries of the existing footprint. For example, the plans depict that Mr. Gaspard will be adding a 2 foot extension addition to the entire length of the house; two new porches (37.5' x 7' and 14' 8"x 7') and a deck(12' x 20'9")to the existing structure. These activities occur within 200 feet of a Riverfront and are therefore subject to the Rivers Protection Act and the restrictions on redevelopment set forth in 310 CMR 10.58(5). The Project constitutes a degradation rather than "an improvement over existing conditions of the capacity of the riverfront area to protect the interests identified in M.G.L. c:131, § 40", and therefore does not meet the criteria set forth in 10.58(5)(a). The interests protected are the following: 1) protection of private or public water supply, 2)- protection of groundwater, 3) flood control; 4) prevention of storm damage, 5) prevention of pollution, 4 f 6) protection of land containing shellfish; 7) protection of wildlife habitat, and 8) protection of fisheries. The Project proposes construction closer to the stream than existing conditions, violating 10.58(5)(6) and (d). The expansion of the house and addition of porches and deck violates 10.58(5)(e).. Mr. Gaspard is not proposing an appropriate restoration of a degraded area to meet the exemption of 10.58(5)(f),and.any mitigation plan has to be reviewed in the context that the Property is designated Rare Species Habitat. Mr. Gaspard's current filing also fails to meet the criteria for an exemption under-10.58(5)(g). 3) Rivers Protection Act —C. The Wetlands Adiacent to the Project are F Estuaries and Need Protection of the Act.' In the Notice of Intent, Mr. Gaspard concedes that the Project includes land subject to coastal storm flowage but states "[t]idal flow is severely restricted from passing beneath Bay Lane" Project Narrative (NA-1). To the contrary, the tides are clearly evident and can freely flow under the bridge at Bay.Lane and substantial tidal influences are evident making the adjoining coastal zone estuarine system a resource warranting particular protection. According to the United States Environmental Protection Agency estuaries are exactly the type of resource area that the Rivers Protection Act.is seeking to protect. The tidal, sheltered waters'of estuaries support unique communities of plants and animals, specially adapted for life at the margin of the sea. Estuarine environments are among the most productive on earth, creating more organic matter each year than comparably-sized areas of forest, grassland, or agricultural land(1). Many different habitat types are found in and around estuaries, including shallow open waters, freshwater and salt marshes, sandy beaches, mud and sand flats,rocky shores, oyster reefs,mangrove forests, river deltas, tidal pools, sea grass and kelp beds, and wooded swamps. 5 f The productivity and variety of estuarine habitats foster.a wonderful abundance and diversity of wildlife. Shore birds, fish, crabs and lobsters, marine mammals, clams and other shellfish, marine worms, sea birds, and reptiles are just some of the animals that make their homes in and around estuaries. These animals are linked to one another and to an assortment of specialized plants and microscopic organisms through complex food webs and other interactions. The Conservation Commission failed to consider the impact of the Project on the surrounding estuary. 4) Endangered Species Act. In the Notice of Intent,Mr. Gaspard states that after having reviewed the 2003 Estimated Habitat Map of State-Listed Rare Wetland Wildlife published by the Natural Heritage and Endangered Species Program .("NHESP"), no portion of the proposed project is located in an estimated habitat of an endangered species. Contrary to this statement,review of the 2003 Massachusetts Natural Heritage Atlas, 11`h Edition, published by NHESP indicates that the area of the proposed project has been designated a Priority Habitat.of Rare Species. A copy of the applicable page from the.Massachusetts Natural Heritage Atlas (2003 ed.)is affixed as attachment E. As the Project is located within designated rare species habitat, a copy of the NOI should have been sent to NHESP for review and comment. _Mr. Gaspard's statement in the NOI indicates that-this did not occur. Additionally, since the proposed mitigation includes removal of vegetation in an area of protected habitat, the mitigation plan and methods of removal should also be submitted for review by NHESP. After raising this issue, The Barnstable Conservation Commission received a letter from NHESP dated May 24,2005, the day of the hearing, stating that the Notice of Intent had been submitted to NHESP and that it was near but not in protected habitat. The letter was executed by Thomas W. French, Ph.D., Assistant Director. When 6 I contacted, Dr. French stated that he.knew nothing of the Project and that the review would have been done by one of his staff whose name normally would have also appeared in the letter. When questioned how the determination corresponded to the NHESP Atlas, or whether he had reviewed the mitigation proposal, Dr. French stated that he would review the Project to determine whether the May 24, 2005 determination was correct. The NOI and mitigation plan have been submitted to NHESP for review. Until the review is completed, the superceding Order of Conditions should not be issued. 5) The Conservation Commission Hearing was Procedurally Flawed and Failed to Allow Public Comment or Review of Critical Portions of the Project. At the May 10,2005 Conservation Committee meeting, Mr. Gaspard's Project at 356 Bay Lane was conditionally approved based upon a misrepresentation of the wetland and environmental resources that are going to be affected by the Project and conditioned on Mr. Gaspard submitting detailed information regarding the proposed Project, including engineering plans,building plans, construction and mitigation plans.None of these'documents were subject to public comment. The construction drawings show that the living space in the new house is going to increase by more than 200%, the mitigation plans are inadequate,have not been reviewed by NHESP and are not commensurate with the size of the planned expansion. Allowing these critical documents to be submitted after the close of the hearing constitutes a denial of due process. The specific site is directly adjacent to an extensive marsh system that was formerly a cranberry growing land area now overgrown with a thick common reed community. The work site is a residential dwelling site with open areas and semi-formal landscaping. The driveway is partially paved and otherwise gravel surfaced. The:old.ditches within this wetland are still visible and appear on the USGS map for the area but are not rivers due to the former cranberry irrigation function. No flow was observed in the ditch nearest the site. Tidal flow is severely restricted from passing beneath Bay Lane. The 100 year coastal flood plain with base.flood elev. = 11 surrounds the project area. The bog and ditch wetland is distinctly defined and also incorporates a minor coastal bank(below the BFE)formation along the marsh edge on the lawn. The general land area of this neighborhood portion includes what may be considered discontinuous coastal bank segments due to the historic alterations relating to the driveway and house construction. The primary resource areas of note are the expansive, phragmites— populated bog area to the south and west, the 100 year flood plain and the minor coastal bank near the existing lawn edge. A series of flagged stations, 1 thru 7, delineate the edge of the top of the:bank of a small edge ditch and the minor coastal bank adjacent to and within the existing lawn area. With exception of the flood plain and any perceived, discontinuous coastal bank segments,the bog and the minor coastal bank represents the closest clearly defined wetland resources to the dwelling. The proposed project involves work on the dwelling. The Proposed Project. The specific work on the dwelling is listed on the plan and involves minimum excavation. The excavation is required for post support footings.. The support locations are shown on the plan. A short foundation wall is proposed on the driveway side of the existing garage. Minimal equipment is needed and, if necessary the post supports on the work limit side of the project can be dug by hand. The bulk of the project-related activity occurring at the site will be foot traffic and construction efforts around the building. Minimal vegetation will be disturbed in the course of the activity. All areas disturbed. shall be restored to a pre-construction condition. A work limit is shown on the plan. The work limit shall be designated and established with a silt fence or other guard as dictated by the Conservation Commission. We propose a properly dug in, staked, woven vinyl sheet silt fence. Hay bales are acceptable but may not be necessary due to the added grass varieties that occasionally arrive with the bales.
