Findings and Discussion When Appellant was considering purchase of the property, he hired'a designerto design a dormer to add habitable space to the attic. In reliance on the designer's plans; Appellant acquired the property.. A building permit was obtained, reflecting plans to construct a dormer. . But it was later discovered.that the plans were not correct. ,(See Exhibits 1=13, 1-C, 2). What was actually constructed is shown in the photographs in Exhibit 1-C and.2. The finished height will not comply with 780 CMR 51.00, R305.1. "The [BCAB] may grant a variance from any provision:of[780 CMR] in any particular case; may determine the suitability-of alternate materials and methods of construction,°and may provide'reasonable.interpretations of the provisions of[7.80 CMR];'provided, however,that [BCAB] decisions shall.not conflict with the general objectives set.forth.in" G. L. c.`143! § 95.3 In:.exercising its powers under this section, the [.BCAB] may impose limitations both as to time-and use, and*a:continuation of any use perrriitted maybe conditioned upon compliance with regulations made and amended from time to time thereafter." The Chief:Local Inspector did not oppose allowing the'requested relief because he concluded the.dimensional non-conformities did not pose significant hazards. The BCAB acknowledged the overall life safety improvements (e.g. improved windows; adequate emergency escape and rescue opening windows; improved access to the,.upper.level) and the hardships,now, to correct what amounts to a 6" deviation at the low end of the dormer. In sum, the.BCAB found that:granting a,variance with-respect to this particular building and its circumstances:would not conflict with the general objectives set forth in G. L. c. 143, § 95.
