Dear Mr.Zdanowicz:
First,may I apologize for not responding sooner.The office has
been inundated with all kinds of issues.
As for the question concerning the Ark Club an appeal was filed
with the Barnstable Superior Court by Edward and Virginia Faria against
the Board of Appeals on August 26,1981.On January 29,1982 the Court
found for the Board of Appeals upholding their decision.
Prior the the Club filing an application with the Board of Appeals
1 inspected the structure.The foundation and deck had been standing
for many years.I had given the Club members instructions as to what
had to be done structurally to the existing foundation.In addition,I
also informed the Club to keep in mind the time constraints accompanying
a Special Permit and to document their activities,dates and names of
those working at the site from August 17,1983 to June A and to the pre
sent day.
Traffic concern is certainly a legitimate issue.As a matter of
fact this issue can best qualify as a Cape Cod concern.However,the
Commonwealth of Massachusetts Department of Public Works granted a per
mit for an entrance on Route 28 in April,1983.
I mentioned to Mrs.Haggerty when she came to the office that when
an appeal has been filed in the Courts the clock stops until a decision
has been rendered.Since this permit was challenged from the onset,I
can assure you that the Club has kept me appraised of their activities to
protect their permit.

permit issued by the Board of Appeals.
