The property is located in a RC Residential Zoning District which requires a minimum 20 foot front yard, 10 foot side yard and 10 foot rear yard setback. However, these trees are interspersed with open space, so the proposed garage addition would clearly be visible to the abutter to the east. The Board may wish to consider, as a condition of approval, that screening be required along a portion of the east side lot line to screen the proposed addition from the residence to the east. Staff suggests that screening consist of a solid wooden fence of not less than 5' in height. Gardner Property Address: 70 Birchill Road, Centerville Assessor's Map/Parcel: Map 189, Parcel 024 Area: 0.36 acre Zoning: RC Residential C Zoning District Groundwater Overlay: AP Aquifer Protection District Background: The property that is the subject of this appeal consists of a 0.36 acre lot in the village of Centerville and is commonly addressed as 70 Birchill Road. It is improved with a two-story, 2,132 sq. ft. single-family residence'. The property is located in a RC Residential Zoning District which requires a minimum 20 foot front yard, 10 foot side yard and 10 foot rear yard setback. The applicants are proposing to construct an 8 foot addition to the front and side of the existing attached garage. The garage is a one-story, one-car structure which measures approximately 12.7' wide by 26' long. The addition is needed to provide indoor access to an automobile for a handicapped resident. The proposed addition encroaches approximately 7' into the minimum 10' side yard setback required on the property. Currently, the garage is situated approximately 12.4' from the east side lot line. The applicants are seeking a variance to Section 3-1.3(5) Bulk Regulations, in order to allow construction of an addition to the existing attached garage that would encroach to within approximately 3' from the east side lot line (at its closest point). Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 26, 1999. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened March 03, 1999, at which time the Board granted the requested variance with conditions. Hearing Summary: Board Members hearing this appeal were Gene Burman, Ron Jansson, Thomas DeRiemer, Elizabeth Nilsson, and Chairman Emmett Glynn. Attorney John Alger represented the applicants, Charles and Mary Gardner. Charles Gardner was present. The applicants bought the property in 1965. Subsequently, they built their house and a sauna. They later learned the sauna was on the neighboring property because of an engineering error. Attorney Alger submitted a new plan showing the reduction of the garage and thus a reduction in the encroachment. The addition will add 8 feet in length and 6 feet in width to the existing garage. This is a problem in inclement weather. The property is well maintained and the addition is in keeping with the neighborhood. The fence and shed are currently over the lot line, and the applicant will bring them both into conformance. This, too, was done accidentally because of a mistaken belief as to where the property line was located. A letter was submitted to the file from William Holmes, the abutter immediately to the right. He has no objection to this project and has stated he will "deed him a small parcel" of his land, if the applicant needs it for this addition. Public Comments: Bob Stone, stated he was speaking for another abutter who did not want the applicant to encroach into her setback. John Hill, spoke in support of this appeal. No one else spoke in favor or in opposition to this appeal. Attorney Alger again stated the fence was mistakenly placed over the property line and the applicant will relocate the fence onto his property. In consideration for the Variance, this is a unique condition that exists that affects the locus but not the zoning district in which it is located because they are seeking an addition to allow access for a wheel chair bound individual where a literal enforcement of the Zoning Ordinance would involve substantial hardship. In view of the fetter of support from the direct abutter, the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Findings of Fact: At the hearing of March 03, 1999, the Board unanimously found the following findings of fact as related to Appeal No. 1999-28: 1. The petitioners are Charles I. and Mary A. Gardner with a property address of 70 Birchill Road, Centerville, MA as shown on Assessor's Map 189, Parcel 024. The site is 0.36 acre in the RC Residential C Zoning District. 2. The applicants have owned this property since 1965. 3. The property is improved with a two-story, 2,132 sq. ft. single-family residence. 4. The property is so configured that it favors the easterly portion of the property in that the structure is closer to the easterly portion of the site than the westerly side. This is a topographical feature that is found on the lot in view of the location of existing building. 5. One of the applicants has an infirmity which would require, from time to time, she be placed in a wheelchair to get to and from her home into the garage, go to medical appointments and such. 6. The garage is located on the easterly portion of the property. The garage as it currently exists conforms to the setbacks but is close to the easterly portion of the lot. 7. The property is located in a RC Residential Zoning District which requires a minimum 10 foot side yard setback. 8. The property is serviced by an existing driveway which goes directly to the existing garage. The garage is so configured that it can not be located any where else on the lot because the house is already built. 9. The Petitioner is seeking to expand the size of the garage to make it wider to provide for wheel chair accessibility from within. 10. There is no other area on the site where such a garage could be built that would not cause a violation of the side yard setback of the Zoning Ordinance. 11. These are unique conditions owing to topography not customarily found in this area. 12. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. 13. To deny the Petitioner the relief being sought would represent a significant hardship to the Petitioner in that they would not be able to fully utilize the garage for the purposes for which it is intended, that is to provide the occupants the protection from the elements and go directly from the house into the car. 2 Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-28-Gardner Variance to Section 3-1.3(5)Bulk Regulations-Side Yard Setback Decision: Based on the findings of fact, a motion was duly made and seconded to grant the requested variance subject to the following terms and conditions: 1. The proposed garage addition shall be built in accordance with the plan entitled, "Plot Plan Showing Proposed Garage addition in Centerville, MA, prepared for Charles I. and Mary A. Gardner, dated February 18, 1999."which shows an encroachment no greater than 5.5 feet from the side yard. 2. The height of the proposed garage addition shall be restricted to one story. 3. Prior to the commencement of the construction of the garage, the stockade fence to the rear of the property shall be relocated so that it exists only on the boundary lines of the lot in issue. . 4. The shed which is shown to encroach on the rear lot line must be moved and placed on the existing lot so that it meets and complies with the requirements of the Zoning Ordinance.
