The lot was originally laid but in a subdivision duly endorsed by the Barnstable Planning Board as an approval not required plan (ANR) on July 30, 1969 . The other plan is an "as built"which shows the foundation location only. Sitework on a proposed plan for a single family home is not scrutinized like a commercial job that has a siteplan compliance requirement. Generally one is free to modify greatly the siteplan for a single family job subject to conservation's order of condition. The only exterior look our guys do is to see if the road is protected enough to release the road bond. Much of there concerns center around potential civil action. However; I want to be sure that this project is not in violation of any state or local law or regulation before we close the books on this one. O f particular interest is the Holts position that the contractor or the contractors surveyor filed a false application or document in that the as built plans show a catch basin with a pipe leading from the basin, on land to the south of the Holt property. The Holts indicate that the pipe actually continues on to there property. They also contend that this constitutes a false document. My question to all of you is ; does this document exist in any of our files? If yes; does it indicate the pipe stopping south of the Holt property? If yes; does this constitute a false document? Said parcel is shown as Lot 26 and Parcel D on Plan of 'Land attached hereto as Exhibit A. The lot was originally laid out in a subdivision duly endorsed by the Barnstable Planning. Board as an approval not required plan (ANR) on Jufy 30, 1969 . At the time of the division and up to the present date the property has been located in an RD-1 Zoning District. At the time of the subdivision plan, the RD-1 zone required 20, 000 sq. ft. of minimum area and 125' of frontage. The Lot in question, per the plan, contains a total of 20, 900 sq. ft. and 125 feet of frontage. Mr. Iafrate purchased the property on June 27 , 1977 and has continued to own the property separate from adjoining land since that date. The Zoning was changed under Article 1 at the February 28, 1985 Town Meeting. to 43 , 560 sq. ft.
