1. Overturn the decision of the Building.Inspector.
2. The Petitioner seeks by Special Permit pursuant to Zoning By-Law, Sections 240-44.A, to
construct a dock, pier and walkway which will serve seven (7) Principal Lots on the private road right of
way.
C. FACTS & PROCEDURES:
In the Appeals before the Board, the applicants are seeking to construct a community dock at the end of a
private road right of way.

Hi Richard,
I went out to 871 Bumps River Rd yesterday. I met COMM Fire out there as well. Without more detail on the actual
complaint I am not sure I can address all of the issues of concern but I offer the following information:
• The house appears to consist of multiple units.
• The dwelling has power.
• The dwelling is occupied.
• Some windows were open. '
• There were air conditioners in at least three windows on three sides of the house.
• The upper rear unit contained furniture but did not appear to be used/occupied -guessing owner's quarters?..
• The far lower right side unit has a large dog (inside- large water bowl outside).
• A bicycle with a Dunkin Donuts Strawberry Coolotta was parked in front of the left side lower level unit.
• There was a white Toyota sedan in the front driveway. — PrV, fy, Ah C-10n i-Ji-52-
• There was dark Chevy 44 pick up in the side driveway(dog owner). wn-, Aft-4 S on 9-,1-- 59
• There is a red truck with a flat tire and expired reg parked on the side of the primary driveway.
• An RV is parked in the T section of the main drive.
• The house has not been maintained but is not in a dangerous state of disrepair.
If I remember correctly, I believe that I was previously informed that the owner, Willie Nelson passed away last year and
the son reportedly informed us (as a result of a previous complaint)that he is cleaning out the property However, that
does not appear to be accurate. It really seems that dwelling has multiple occupants living independently-the number of
actual units is in question. I did not see trash or garbage as was noted in a previous complaint. After my inspection
yesterday, I submitted a request to the PD to run the plates in an effort to find if the vehicle operators are in fact tied to this
property. I am waiting for that feedback.
In the meantime, it should be noted that squatter complaints (if valid) involve trespass. That is a nuance addressed more
appropriately by the pd. It should also be noted that if the deceased owner's son is cleaning the property and readying it for
sale (or his own use)there is no violation or requirement to make the place pretty and neat. That being said, if there are
multiple units, (subject to confirmation)we will pursue enforcement with the appropriate party. Until, it is definitively known
who is on site and how or why, our hands are tied. COMM Fire will check the property for me when they are in the area
and advise me accordingly. I will report any updates as obtained. Please advise.

I received a call from Councilor Will Crocker who had a call from a constituent on a problem property at 871 Bumps
River Rd. He did not know the details but he thinks that there are squatters on the property and was not sure if it is on
our list of problem or abandoned properties. I can have Robin look it up and reply on this matter to him if you would

Dear Mr.Nelson:
Recently at the end of Powers Drive a stairway was installed which did not have the benefit of
proper permitting. The permitting for this was a subject that was recently before the June 7,2006,
meeting of the Zoning Board of Appeals, at which time the Board upheld my decision not to issue
the necessary permits. Since my actions have been upheld the stairway must be removed. This
office has no idea who installed the stairs. Therefore we are notifying all abutters listed with the
Zoning Board of Appeals. This corrective action must be accomplished by July 3,2006. If this
structure is not removed by then,this office will take the necessary steps to have it removed and
seek monetary compensation from the individual owners listed with the Zoning Board of Appeals.
This office looks forward to your anticipated cooperation.

Dear Mr.Nelson:
Recently at the end of Powers Drive a stairway was installed which did not have the benefit of
proper permitting. The permitting for this was a subject that was recently before the June 7, 2006,
meeting of the Zoning Board of Appeals, at which time the Board upheld my decision not to issue
the necessary permits. Since my actions have been upheld the stairway must be removed. This
office has no idea who installed the stairs. Therefore we are notifying all abutters listed with the
Zoning Board of Appeals. This corrective action must be accomplished by July 3, 2006. If this
structure is not removed by then,this office will take the necessary steps to have it removed and
seek monetary compensation from the individual owners listed with the Zoning Board of Appeals.
This office looks forward to your anticipated cooperation.
