DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two- family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the buildingpermit. Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. A cursory observation by the town building inspector'also revealed other substandard work. For example, the collar ties connecting the peaked roof above the addition are higher than the allowed maximum to prevent bowing of the roof. Also noted was the danger to the health of the occupants due to the absence of finished flooring.over the subfloor. The finished flooring cannot be installed until the severe crowning of the,subfloor is corrected and other major defects(walls, cabinets, electrical, heating, plumbing e.g.)are corrected. September 10, 1995 ADDENDUM TO THE ATTACHED DOCUMENT Since the attached 'STATEMENT OF FACTS' was written in late November of 1994 (almost ten months ago)virtually every one of the ridge shingles has blown off. We have collected .them as evidence of faulty application. Also, rain water has entered through the peak of the new roof necessitating the installation of a tarpaulin by the owners to help prevent additional damage. The improperly constructed cricket actually collects water and debris instead of diverting them as it should. Erosion of the soil under the undersized concrete pad at the foot of the stairs leading from the deck continues to worsen,,as predicted. In the ensuing seven-plus months, numerous instances of fraud, deception, theft of property, cheating and sub-standard work resulted in the contract being breached.and the subsequent dismissal of the.builder. The date of notification of the dismissal was Tuesday, October 4, 1994. It should be noted that several weeks earlier, (on Thursday, July 28) the builder was told to remove his tools and materials from the property for failure to show up for work and observe the terms of the contract. He came to the house that same evening and entreated us to let him complete the job, promising to work uninterruptedly until everything was finished to our satisfaction. Since we had advanced another $10,000.00 and feared losing that money if he were to walk away,we relented and agreed that he could resume work. From then on, matters only worsened as the following facts will bear out. We have received a demand for payment of$8,350..52 from the builder in a letter dated October 25. That was followed by a letter from Don Weber, a lawyer retained by the builder, dated November 7, demanding the same amount. We reject these demands without restriction and petition for a judgement again the builder based upon the following irrefutable facts. The contract clearly states that the builder will "Construct new kitchen addition as Ve owners (sic) .plans:" This provision has been violated in several instances. STATEMENT OF FACTS 11-25-94 At the outset, the layout lines, when checked by the owners prior to the.forms for the foundation being installed, showed a length of 24 feet'while the plans called for a length of 26 feet. When this was brought to the builder's attention he feigned surprise, stating that he was working,from an initial sketch and not from the plans. (It must be noted that the builder was in possession of a set of plans well in advance of the time this proposal was submitted.) The second contract violation centered on the excavation and pouring of the basement area. While the contract drawn up by the builder specified "... new 8X16" keyed concrete footing." none was installed. Rather than the full 14'X26' basement room we contracted for, the builder provided less than half that area with the remaining space being a virtually useless shelf. Despite his failure to abide by the provisions of the agreement, the builder is now attempting to extract additional payment for concrete work. (Photos of this area as well as photos of other examples of the builder's work will support this declaration.) We had specified two basement windows. in' addition to the access doorway from the existing basement into the new space. When the foundation was poured, no provision was made for the windows, necessitating the concrete having to be cut out after curing, a needless expense. The builder attempted to have the excavation backfilled without any water-proofing tar- based product having first been applied. When questioned about this, he claimed the excavation contractor arrived too early and he had no chance to apply the waterproofing material. The excavator faulted&the builder, stating he came only after being told the foundation was prepared for backfilling. The roof construction is perhaps the best example of the builder's deviousness. The roof shingles according to the-contract_"... will match existing house roof shingle's." (sic). The existing shingles are a much heavier grade than those installed by the builder. The new shingles, Bird Wind Seal 80, put on by the builder do not match the existing roofing material in weight or quality. In addition, the builder failed to install the felt underlayment on the roof. This serious omission not only violates the terms of the contract, since the plans clearly specify application of the 15# felt, but serves to void the warranty of the manufacturer in the event of product failure. The terms of the warranty are printed-on each bundle of the Bird 80 shingles along with instructions for installation. A call to the Bird offices confirmed the fact that the warranty would not be honored. , Within days of the claimed completion of the roof,- rain poured down the inside wall where the new addition meets the existing structure., hen confronted with the problem, the builder said he expected it to happen since he did not install flashing along the edges. 2 i STATEMENT OF FACTS 11-25-94 That same wall, after the corrections were made, leaked even worse when it rained again. The builder claimed that all roofs leak, stating that he had worked for Cazeault Roofing and "their roofs always leaked." After three repair attempts, that area appears now to be holding back rainwater from entering the house, at least for the time being. Just as bad, if not worse, were the leaks over the door leading to the deck. During a particularly heavy downpour, rain cascaded down the interior wall (see photos of damage) and soaked gypsum board and trim. The builder attributed the condition to "condensation." claiming that any sheet rock installer will attest to that phenomenon. The first attempt. to rectify the damage was short-lived; the leaks reappeared when the next rain came. The application of a sticky tarlike adhesive under the leading edge has not yet been tested under severe weather conditions but our confidence in its ability to withstand heavy rain and wind is low, at best. The transition from the existing house to the new addition, in terms of the flooring is sub-standard by any reasonable measure. The rise in the sub-floor is so significant that merely walking from room to room calls attention to the deficiency. (Photos.) The builder was asked several times during the discussions we had with him prior to the awarding of the contract whether he could guarantee the evenness of the floors from old to new. He assured us over and over that the floors would be level throughout. His exact words were: ' "My floors are always level I pride myself on that." The new oak flooring in two areas of the addition would, to.quote the builder, be finished "like a bowling alley." He later refused to have that work done unless we agreed to pay for a sub-contractor he would provide. The cabinet installation is amateurish and unacceptable. When asked during installation if he squared the base cabinets with each other at the point where two right angle sections meet, or squared them with the wall, he stated they were squared with each other. "That is the only way'to do it," he told us. However, a roofing square placed in the corner where the two base cabinet sections meet reveals just how out-of-square the two sections are. (Photos.) The longer section measures 119'/4" from the inside corner to the end. It is almost 3" off at the end. The shorter length of base cabinets is 57" from the inside corner to the end. This section is more than '/2" out at the end. Because of this inappropriate installation, the vinyl sheet goods to be laid over the sub-floor will look crooked since a block design is imprinted on the face. Where the cabinet backs meet the walls, they do not fit flush. Tight against the walls at the bottom, they are severely open at the top, as the photos clearly show.. 3 . STATEMENT OF FACTS 11-25-94 The countertops the builder ordered were delivered weeks after the promised delivery date. The walls behind the range were so bowed that the backsplash would not lie flat. The builder applied a series of clamps to force the backsplash against the walls, but this procedure did not work. He then tore out a portion.of the sheetrock, shaved down the bowed stud, and attempted to patch the area. The result is a seriously botched job; an ugly depression in a most noticeable part of the wall. (Photo.) During the installation of the countertops, a screw was driven from below through the cabinet base and penetrated the laminate, causing a hole in the material. This defect will become worse as the tear widens, we have been informed. The walls around the kitchen are in very poor condition. In the bay window area, the walls below the sills are rippled. The builder said the painter would sand the high spots down; the painter said the corrections could not be made without damaging the gypsum board. It remains unresolved. The dining room walls are bowed where the new work meets the old. A level placed across the transition will rock noticeably and the poor workmanship is apparent from any place in the room. Installation of a chair rail and the hanging of wall coverings cannot be accomplished due to this unsightly condition. (Photos.) The doors to the dining room closet have been hung in such a way as to reveal a serious gap where the two panels meet. (See photos.) In both the kitchen and dining room pantries, shelf cleats were nailed to the studs. Cleats in the.kitchen pantry were 12" long; in the dining room the cleats were 20" in length. To these, 10" particle board was affixed, drastically undersized for the depth of the closets. The builder, when asked why the shelves were so shallow said the lumber yards on the Cape carried nothing else. The shelves were torn out and replac4vith adequate sized plywood by us. (See photos.) The back door leading to the deck will not stay shut. The least rising of the wind causes the door to .open. This condition is the result of two serious defects. First, the door is improperly hung and the strike plate does not match the latch. Second, since its installation, the deadbolt apparatus has been missing. (Photo.) The key broke off in the lock when the builder tried to correct a non-functioning deadbolt. He removed the operating parts and never replaced the pieces, even though he had the door painted and stained. The door must be covered with a heavy quilt to keep the wind from blowing through the cracks where the frame and door meet. (Photo.) In addition, heavy object propped against the door are necessary to keep it from blowing open. The door now in place is,the second one installed. Despite instructions to the contrary, the builder hung 4 STATEMENT OF FACTS 11-25-94 the first door in such a way that opening it from the deck side would result in it hitting against the base cabinet. The new deck has posed problems from the outset and is another example of ways in which the builder tried to cheat us. When the deck was about to be constructed, we met with the builder and went over the dimensions. He said he wanted to be sure we were in agreement. The dimensions,-according to the contract, were for a main deck of 22'X 10' and a secondary, step-down deck of 22X6 . When the deck framing was completed and the fir decking was about to be installed, we noticed that the lower deck seemed less than the six foot width the contract called for. A measurement confirmed our suspicions: the secondary deck was only five feet wide. We stopped the carpenter and alerted him to the shortage. He admitted he knew what the dimensions should have been, but stated that the builder told him to "make it five feet." The deck rails badly cupped and separated after installation. This was called to the builder's attention. He acknowledged the unacceptable quality and said he would replace the pressure treated rails with another species of wood. He said pressure treated wood often reacted that way when used as deck railing but he had hoped it would not be the case on our deck. For the bay window area, the plans are clear. A flush header was specified but not constructed. Instead, the builder installed-a drop header. The result is a particularly, unattractive alcove in a place which should have been an inviting, open dining area. The space behind the header is of no use whatever and robs the room of its symmetry and design. Plumbing and electrical work remain to be completed.. (Photos.) Fixtures are left hanging and chandeliers have yet to be connected. The toe kick heater under the sink is not connected and the cutout has yet to betaken care of. There is still a noisy air lock in the pipes. From the time the openings were`cut for the basement windows until the windows'were actually installed,- many weeks passed. During that time, several rainstorms occurred and the new cellar addition was flooded to a depth of three or four inches. The water ran into the existing basement area, damaging furniture stored there. Eventually, after repeated complaints, the builder placed a sump pump to extract the water. The smell of a damp cellar has never left. The windows were put in with no regard for sealing the kerfs left by the large circular saw used in cutting the openings. The spaces remain unsealed to this date. (Photos.) 5 STATEMENT OF FACT 11-25-94 The screens for the kitchen windows, which were to be included as per the agreement are not in place. All windows include screens with no grills. Only two of the tight required screens were delivered; each of the two screens has holes, making them unacceptable. Poor craftsmanship is evident in virtually every aspect of the project. Beyond the serious shortcomings outlined in preceding sections of this declaration, a series of additional deficiencies may be listed. (See photos.) Among these were the necessity to cut back the header in the kitchen in order for the cabinet doors to open fully without hitting the header edge; mismatched baseboard; mismatched door trim (one door frame higher than the adjoining one); ill-fitting window sills and window trim; gaps behind the backsplashes; unsightly seam in a prominent spot on.the backsplash; and poor nailing of the sub-floor. (The plans specified %" subflooring. The builder installed '/a" plywood.) Personal property was taken from the job site without permission. Initially, we discovered one of the workers throwing an extension cord into the builder's truck. When asked if the cord belonged to us, the worker said it did but wondered if we minded him borrowing it for use at another job. He was told we minded his not asking first.. When the builder was informed of this, he said he always instructed his help to not use any tools or equipment belonging to the homeowner. That same day`another worker was stopped as he was putting the same extension cord in his truck. A commercial push broom was taken from our house and, despite repeated promises to return it, more than ' two weeks went by before we saw it again-- with the handle missing. We had to buy a new handle at personal expense for our broom. A sledge hammer belonging to us was taken off ourproperty. The builder repeatedly denied any knowledge of its whereabouts. Later, perhaps a week or so, the sledge hammer was brought back. It was mistakenly thrown in with his other tools, according the builder, even though it was in our garage, in a corner, far from any of the tools used by the builder and his crew. At the outset of the project, the builder was asked on several occasions to set a.date when we could accompany him to the vendors he did business with to select cabinets and appliances. It was our stated intention to buy everything through him in order to get the job completed in a timely manner. We had told him before signing that we were expecting company from Europe in July and wanted the house to be ready when they came. He assured us that, while it would be tight, he could do the job. With that assurance, we signed. We never could pin the builder down to a time for shopping for the cabinets and appliances. Eventually we decided to take the allowances and shop on our own. It became increasingly clear that, because he had contracted with at least two other clients, we would be getting short shrift from him. At one point he recommended that we visit Cloutier Supply in Hyannis and select our vinyl sheet goods for the kitchen floor. After spending considerable time on two visits with a sales representative, we 6 STATEMENT OF FACTS 11-25-94 learned that the builder had no standing with the firm and any floor covering we chose would have to be paid for by us at the full retail price. We shopped elsewhere for a better deal and told the builder of our experience with Cloutier. He passed it off as of no importance despite our telling him of our discomfort with the embarrassing spot in which we found ourselves. A major aggravation throughout this trying period was the failure of the builder to show. up. There were periods when no work was done for days, even weeks, on end. Often, when the workers did show up (seldom did the builder accompany them except for brief flurries when he felt extreme pressure) they would work for an hour or two and then take .off without any notice. On many occasions,,a worker would appear, pick up a tool, and disappear. The workers, in addition to the builder, were a journeyman carpenter who has either quit or was fired shortly after we terminated our relationship with the builder, and a young, inexperienced laborer who often was left unsupervised to do skilled work beyond his level of competence. Twice he sawed into live electric wires with a reciprocating saw, one being the 220 volt line to the electric stove.. The builder refused to install the molding on the top of the cabinets which came with the delivery. He claimed that the molding was not a part of the cabinetry. We learned later that he had installed crown molding for another customer; even though those cabinets were purchased without the builder's involvement, just as ours had. This builder would not answer phone calls or'respond to his pager. We have been told by people who worked for him that he habitually avoided answering his phones and did not return calls. While working on our project, he contracted with a customer in our neighborhood for a room addition. She was told that our job was "on hold until late August„ so he was free to undertake her project, an inexcusable lie. At about the same time, he contracted to build a complete house in West Barnstable, promising the owners an October completion date. He became increasingly surly and rude, telling us at one point that we had a "jinxed house" and that he regarded our project as "the job from Hell." When we observed that he did not keep his promise to stick with the job until completion, he adamantly stated that "It was never my intent to work on this house a direct contradiction to his statements made at the time of his presentation to us,when he was bidding on the job. The problems with subcontractors were constant. The painter, the sheet rockers, the plumber, the concrete pourers,.all came to us insisting on payment for their work.. The STATEMENT OF FACTS 11-25-94 builder was never present when subcontractors were working. On one occasion, a truckload of gypsum board and other drywall materials was delivered. The driver asked for a check which he had been told was to be available for him. There was no check and we had no idea where the'builder was. After paging him unsuccessfully, the driver agreed to unload the material. He left and was back within five minutes saying unless he got paid, his instructions were to retrieve the load. We advanced the money to save further delays and left a message on the builder's answering machine, demanding repayment. He later called and promised to come to the house within ten minutes. He never showed up that day at all. The builder arrived the following day with cash and . paid us back, but only after much haranguing and,threatening language was directed at him. CONCLUSION It is difficult to express with words the frustration and anger"we feel over,the experience of these past seven-plus months. We have living with us a 92-year old relative who had to be removed from our home for a month and placed with other caretakers since we were without kitchen facilities. While the weather was mild, it was possible to cook outdoors on a gas grill. As the days got colder, that option was removed. We also take care of a grandson, who is just now approaching his first birthday. He stays with us four nights a week and the upset in our home caused by the non-caring and cavalier attitude of the builder has added to the burden of providing the care and attention.he needs. There is no question that much has been done to us. We have been victimized-by a non- principaled, unethical charlatan. The offended party in this action is most certainly us, the owners, who entered into an contract in good faith with a man who purported to be a skilled craftsman having the best interests of his clients uppermost in his mind. Instead we have encountered the worst sort of tradesman, one whose lack of conscience fosters deception and fraud in the greedy pursuit of money; one who treats those who have trusted him with contempt and ridicule. We are determined to right this wrong. Much is owed us; much,can never be repaid. Precious time has been lost forever. Undue stress and tension have been heaped upon us and our family and what was to have been a'pleasurable experience with a happy outcome has become instead a living nightmare fraught with deceit and, often, despair. 8 STATEMENT OF FACTS 11-25-94 What remains for us at this point is an unwavering faith in our system of laws and regulations designed to protect people from unscrupulous contractors like Michael L. Gardner. We are convinced that reasonable men and women, when presented with the facts and evidence, would concur that the builder is guilty of breaching the contract, fraud, deception, and sub-standard work.
