My client recently filed for a building permit and was informed that he needed a letter of buildability for this property. For the reasons set forth below, I respectfully disagree that such a letter is needed for this property. The lot was created prior to subdivision control laws. It is my understanding that Attorney Sarah Alger submitted a letter of buildability for this property in late 2007. A building permit was issued on February. 5, 2008. For personal reasons, the holder of the permit,Hugh Sirhal;requested and received.'several`extensions. The fifth extension of this permit expired on September 30, 2010. Mr. Sirhal was able to commence execution of the building permit by the installation of a. foundation. That structure remains on the lot today along with a silt fence required by the Conservation Department. Although the original building permit has expired,the owner executed the pennit by installing the foundation and the lot has been improved. On November 27, 2017, a disposal system construction pen-nit was issued and remains valid until November 26,2020. 1 have enclosed a copy'of the approved application. I have also enclosed a copy of a print-out from the On-line Permit Center. On July 22, 2019, Michael J. Moynihan purchased the subject property. He has owned an abutting property, 33 Park Avenue, since 2001. Despite the fact that 1410 Bumps River Road and 33 Park Avenue are abutting properties in the same ownership, there is not merger as 1410 Bumps River Road is not a vacant lot. In the seminal case, Citation Insurance Company vs.Brenda Gomez-et al 426 Mass. 3-79 (1998),the court held that a lot with a concrete bunker was not considered to be a vacant lot due to the fact that it has a permanent structure on it.
