On _..._..»............................ ....................................................................._._....... 19............ the Board of Appeals found The petitioner stated that while the area In which his parcel of land is located is now zoned for single family residences, there is in fact no land being used for that purpose. In. support of this argument, the petitioner presented to the board an enlarged plot plin of the area showing the various properties surrounding the parcel in question here. All of the eighteen properties shown on the plan extending for more than a quarter of a r: ile on either side of petttior.e. s land were being used for commercial or semi commercial purposes. It was the opinion of the petitioner that the purpose . of zoning is. to maintain the character of the area, and since this section is 100% business the granting of this variance would not create any change. The petitioner further stated that he has owned the land. since 1954. During that period of time he has continuously attempted to sell it for residence purposes. He has listed it with a number of real estate brokers and during that time has, not had one offer of purchase for that purpose. The petitioner has requested permission to use the land for other purposes and has been refused. Because of the impossibility to sell the land for the purpose for which it is zoned and the refusal of the town to allow other uses, a financial hardship has been created which the petitioner feels fall s within the meaning of the statute. In addition there is a hardship which is peculiar to this parcel in that it is the 6nly remaining parcel on the street which. would be subject to the residential requirement. The use of this parcel for parking of vehicles would, in the opinion of the petitioner, be in the best public interest. The traffic in the beach area is heavy and becomes increasingly so each year. Enclosed for your review is a copy of the relevant Town of Barnstable Assessor' s Map (Map 226) along with copies of two Certificates of Title as follows : 1 . Certificate of Title No. 55074 which pertains to Lot 140- 2 on Map 226; and 2 . Certificate of Title No. 55075 which pertains to Lots 140-1, 140-3 , ' 140-4, 140-5 and 140-6 . The lots in question were created by an ANR approved by the Barnstable Planning Board on February 27, 1985 . A copy of the approval is also enclosed for your review. My client, the owner of all of the lots in question, has been assessed by the Town of Barnstable as if all of the lots were "buildable" . In my opinion, I do not believe that Lots 140-3 , 140-4 , 140-5 and 140-6 are buildable as they have lost any protection which they might have had as buildable lots long ago. As a result, I have filed an Application for Abatement on behalf of my client with the Town of Barnstable Assessor' s Office for these four lots . However, they indicate that they need a letter from you indicating that these lots are not presently "buildable" . I I Accordingly, I am requesting that you provide me with a letter indicating your opinion that these four lots are not buildable, having lost any protection which they may have had as a result of the filing of the ANR.
