Mr. Gerald Ott presented his petition before the Board and requests a special permit to allow the extension of a non-conform%T-W.ffiffroW. use as the Craigville Sub & Pizza Shop, located on CraigviIle•Beach-Rd., The petitioner desires to construct a S' x 24' addition to his existing restaurant - 'to be a waiting room E for patrons - this addition is necessary so that patrons may have a waiting area in which to sit to. be out of the weather - this is to be an enclosed deck with permanent -benches - no tables - there is to be no. serving of food or beverage - this will not -increase the seating capacity of the restaurant. The present building is about 40 x 40. In addition to the available parking spaces,, the petitioner has signed a tease for a period of one .year- from the owner of the General Store, Mr. Roberts - this wilt give him an additional 14 parking spaces for a total of 40 spaces. The petitioner has. a year..round beer and wine license, but he does not have to ear before the Selectmen, since he is not adding additional seating appear g or serving areas. The Board took the matter under advisement and the hearing was closed. According to past Zoning Board activities, the restaurant use dates back to 1947 and has a history as a legal non-conforming use. The Building Department records indicate the restaurant has a capacity of 70 seats. The applicant sought a modification of the existing Special Permit to expand the restaurant structure to accommodate a new commercial oven. The work was initiated and then stopped by the Building Department when it was noticed that no permits were issued for the work. The applicant was before the Site Plan Review Committee of February 03, 2000. A site plan (No. 08- 2000) for the improvements was found approvable and the applicant was referred to the Zoning Board for necessary relief. Zoning History: The Board files that relate to this site and use are as follows: • Appeal No. 1973-12-The grant of a Special Permit for the expansion of a non-conforming use, the restaurant, by a permanent enclosure of an 8'x 29' patio area and a 10'+/-addition to rear of structure. • Appeal No. 1982-80-The grant of a Special Permit for the expansion of a non-conforming use with the addition of a 34`x 13 ' greenhouse structure for restaurant seating. • Appeal No. 1984-94-The grant of a Special Permit for expansion of a non-conforming use to enclose a deck measuring 5'x24'to be used as a waiting area only-no addition seating. • Appeal No. 1985-123-The grant of a Special Permit to allow a 6'x 14'addition to the kitchen area and a 4'x9' stairs. No additional seating. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on February 16, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices ; sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened April 12, 2000, at which time the Board granted the requested modification. z Town of Barnstable-Zoning Board of Appeals Decision and Notice Craigville Pizza and Mexican-Appeal Number 2000-28 Modification of Special Permit 1982-80 Hearing.Summary: Board Members hearing the appeal were Gail Nightingale, Gene Burman, Richard Boy, Tom DeRiemer, and Chairman Ron Jansson. The owner, Antonios Revis, represented himself before the Board. Mr. Revis explained that in installing a new oven a"bump out"-to the side of the building was necessary. He stated that when he started the work he was unaware that he needed to go to the Zoning Board of Appeals for permission to put in the new oven as it increased the footprint of the building. .He is seeking to modify the.existing Special Permit to allow this expansion. Public Comment: Michael Dwyer, and Domenic Quintiliani, direct abutters, spoke in opposition. They expressed concerns that Condition#5 of Appeal Number 1982-80 that required "a 5 ft wide buffer of evergreen trees"was never met, possible increase the amount of business and the need for more parking, the dumpster location and trash, and the existing parking situation that tends to block the private driveway. No one else spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of April 12, 2000, the Board unanimously found the following findings of fact as related to Appeal No. 2000-28: 1. The applicant, Craigville Pizza and Mexican, is seeking a Modification of Special Permit 1982-80. The property address is 618 Craigville Beach Road, Centerville, MA as shown on Assessor's Map 246, Parcel 029. The site is located in the RF Residential F Zoning District and AP Aquifer Protection Overlay District. 2. The applicant is seeking a modification of Condition#1 of Special Permit Number 1982-80 to allow a small expansion of the structure. All other conditions of Special.Permit Number 1982-80 shall remain in effect. All conditions of any and all other Special Permits on the site shall remain in effect. 3. The concerns of the abutters have been addressed. 4. The applicant is seeking approval for a"bump out'addition. 5. The proposal was found approval by Site Plan Review on February 3, 2000 for this addition. 6. The relief may be granted without being substantially more detrimental to the neighborhood affected and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in Appeal No. 2000-28, subject to the following terms and conditions: 1. This is a modification of Condition#1 of Special Permit Number 1982-80 to allow an addition to the existing building, as shown on the plan submitted to the Board. 2. All other conditions of all former Special Permits issued shall remain in effect. All conditions of Appeal Number 1973-12, Appeal Number 1982-80,Appeal Number 1984-94, and Appeal Number 1985-123 shall be complied with. 3. The property shall be surveyed -as soon as possible-within 30 days after the signing of this Decision by the Clerk that no appeals of this Decision have been filed, but in no event later than 90 of this Decision. 4. After the surveying of the property, the"5 foot buffer zone of evergreen trees" cited in Condition#5 of Special Permit Number 1982-80 shall be implemented. 5. Signs will be erected inside and outside the restaurant telling people they are not to parkisM in the driveway leading to the abutters property or otherwise obstructing their ability to enter their property.
