I live in Centerville, in the same house that my family has owned since 1963. I, along with my family am interested in reopening the general store located at 628 Craigville Beach RD.We are going to sign a lease with the current owners with an option to buy.We need the business to produce a three year successful profit in order for the bank to give us financing to buy the building.The lease,we are signing is for the entire property including the store,the two bedroom rental unit upstairs and the parking behind the building.The building is zoned as non- conforming.Currently the store is only allowed:to operate seasonally. I found this out while applying for a business certificate from the town.They suggested that I write this letter of intent, requesting you to grant us permission to operate the store annually. We plan on keeping the store as a general store.We want it to have that warm, homey,quaint, small town feel.We believe that the building with its red and white attributes define what people expect a general store to look like.We intend on having a new sign installed with the stores name`:Bud's General Store"on it.We have no intention.of using any neon lighting in the store or anywhere else on the property,whereas these-features don't represent that country store feeling that we intend to have. . Police rousted thirty-five people from the building,then arrested nine residents"found in violation of the Town of Barnstable anti-noise ordinance"and alleged alcohol violations. All nine were handcuffed,placed in a prisoner transport van and booked. Some of the nine were of legal drinking age. As far as I know the store has been continuously operated and there has continued to be a residence there as well. The nearly 100-year-old building is up for sale as owner Tom Roberts heads into his 37th summer season at the landmark store. "I had a lot of fun. My kids grew up here," says Roberts who will turn 78 in June. Not much has changed at the store since he took ownership in the early 1970s. Roberts sells ice cream, soda, candy, groceries and coffee along with beach paraphernalia including chairs,umbrellas, sunglasses and those must-have Cape Cod souvenir trinkets and treasures. "Some people come back every year. They came here when they were 5 years old and now they're 30," says Roberts. Tourists aren't the only folks with fond memories of he little country store. "A lot of people say they would hate to see it go. They've been coming here longer than me," says Roberts,who adds even his kids are reluctant to see him sell the property. "They've got their jobs. One again we were told that were six individuals were staying at that residence. It would appear however that it may be used as a "flop house" for Irish kids arriving in country with nowhere else to stay (conversation with one of the individuals sent on his way). One of the occupants reports they pay$2000 a month to rent the property but he doesn't know who the landlord is. There are two small bedrooms on the second floor,each with two beds/mattresses, unknown where the other two occupants would be sleeping.. The entire building is a complete shambles, with trash, old food, empty beer cans and alcohol bottles everywhere. This is a nonconforming(mixed use)property (Craigville General Store) in a single family residential zone. The street file indicates there is a two bedroom apartment on the second floor. • Reported to site approximately'6:30 PM. • Walked around site. Found nonconforming sign to be removed. • Found handwritten sign in window box stating closed—reopen 2012. • Found three vehicles in rear of building. • Noted taxi dropping off two'young adults, male and female: • Walked to front of building—couple apparently entered side door. • A young male responded to our knock on the apartment entrance. • We discussed reports of overcrowding,party activity and being mindful of residential uses surrounding this structure. • Requested permission to inspect living conditions. • Team was admitted for an inspection • A very narrow staircase is located directly behind this access door. • A primitive lav was on the right side and door inside of that area opened into a makeshift tool shed accessible from outside./ • The stair treads barely accommodated my feet and are extremely tiny and dangerous but are likely original at 100+years. • The first floor hallway spills into the former general store area, kitchen and storage areas. • The large room off the official front door(and formerly the public area of the general store) was set up with two mismatched couches in questionable condition, an area rug and commercial coolers. • Beer cans and bottles were strewn about. • Upstairs contained two small bedrooms, a lay. Living room and a kitchen. • Personal belongings consisting of clothing, suitcases, and books were littered 'about on the floors of all areas. • The kitchen sink was full of dirty dishes. • The oven light was on but no one was cooking—tenants advised that it stays on. • Although it was stifling hot upstairs no one opened any of the windows. • The placed smelled of stale beer and dirty clothes. • The two bedrooms contained a twin bed each and mattresses on the floor. • The bedroom on the right side was.missing a ceiling fixture and the bare wires and singed insulation were exposed. • I contacted the electrical inspector by Nextel at the request of local inspector Jeff Lauzon. • Upon Bill Amara's arrival, it was determined that one wire was indeed live. • After a search of the premises, wire nuts and tape were located. • Bill installed the wire nut and trimmed and secured the remaining wire. • The names of the tenants in residence are as follows: o Sean Creedon o Cian O'Hanlon o Airling Hartaett o Conor Owens o Niall Lynch o Tim Murphy • Bill installed the wire nut and trimmed and secured the remaining wire. • I requested contact info for the property owner. Jan Lundberg returned my call late Friday and left a message on my VM but I was out of the office when the call came in. Spoke to Jan Lundberg at 10:30 AM on Monday 612112011. Advised she needs an electrician, and get a handle on how many people are actually residing there. She needs Health to inspect and determine legitimate number occupants. She may have already sacrificed the commercial use on the first floor as she admitted she told the tenants they could use the first floor for residential (sleeping?)purposes. Later she tried to back track and say that she told them they could sleep upstairs in the "alcove". She claims she rented to five male students. Both the police and I have been informed by the occupants that there are 6 tenants. In addition I told Ms Lundberg to get an electrician to not only replace and repair the light fixture in bedroom but to check out wiring to make sure it is to code for habitable space as it is obvious that the wiring is very old. Advised her that the insulation where the light fixture was had been singed indicating a problem. I did not believe the tenants removed it or damaged it but that it actually fell just as they claimed as no other damage was noted i.e. holes in walls or other destruction. Advised once the permit is pulled and the work is performed the electrician will request an inspection. The proposed use is not allowed in the zone in which it is located. The primary issue is whether this is a lawfull pre-existing non conforming use. To this issue I offer the following: The property and this building is now in an RB zoning district which does not allow the Uses being proposed. This building has been operated for approx. 100 years as a seasonal General Store business on the lstfloor and a two bedroom housing unit for the owner and or the building manager on the 2°d floor. At the outset of this operation (approx.100 years ago)there was no zoning regulations restricting either Use. Eventually the zoning was changed to an RB district which does not specifically allow a business use (General store) or a residential apartment. However, since both Uses were in existence when the district was zoned for RB ( and also when my client purchased the property in 2011)they automatically and legally became pre- existing non- conforming Uses.As such both are allowed to continue regardless on a change in ownership so long as either use is abandoned.As of this date neither use has been abandoned. To confirm the above I attach hereto.a December 2,2011 letter from the then Building Commissioner Thomas Perry which states that the General Store is a pre-existing non-conforming use. For the past three seasons the General Store and housing unit were not open due to major water damage three years ago requiring substantial reconstruction to the Roof and the interior space.A building permit was obtained and the work was completed. The owner is requesting to expand the existing pre-existing non- conforming Use of the Grocery Store to include Expresso and Cappuccino (which are part of the Coffee Use) and Gelato (which is part of the Ice Cream Use) and continue to sell sandwiches and other groceries.Although they are new specific categories within the existing Uses they are basically an expansion of the existing general Use. The only variance is that they will be prepared on site and how the Uses are they are delivered. To this issue, there has been seating on the first floor for two customers. The Owner is seeking to increase the seating capacity to a maximum of 12. We understand that a victualler's license will be required for the above and plan to seek that license upon your approval of#1 above 3. There will be no stove top. There will-be an electric Micro Wave oven, an electric Confectionary Oven, an electric Crock Pot and Soup Kettle. 4 No alcohol will be served or sold. 5. There will not be a bedroom on the first floor 6. Common Victualler License As indicate above, upon approval from the Building Commissioner and the Site Plan Review Committee the owner will apply for a common victualler's license and appear before the Licensing Authority. 7. Interior Grease pit and trap will be installed. 8. The kitchen Sink will contain 3 bays and a mop sink. 9. Exhaust Hood will not be required as there wi11 be no stove top 10. Septic System and flow Based on the most current public information the property is expected to be connected to the new sewage system by March of 2022 and will no longer be on a septic system. The General Store does not open for business until May of 2022 which is after the sewage connection. This should solved the issue of the septic system and flow. 11. The dumpster shall be no less then 10 feet from the building and will be screened. 14. The living unit on the second floor is self contained with two bedrooms and full bath for the building manager or owner when either is on site managing the operation of the business.
