Town of Barnstable Attention: Building Commissioner Brian Florence 367 Main Street Hyannis, Ma. 02601 , * Hi Brian Attached please find a permit application for an existing sign that Cape Commerce Nominee Trust Bruce Macgregor trustee re-lettered, located at the southerly end of the Residences at Trade winds property (see yellow highlighting on attached site plan) across from Covell Beach. We found out today that the original permit expired sometime in 2012. Cape Commerce Nominee Trust purchased the Development rights from Trade Winds Development-A, Inc. sometime around November 2016. Trade winds Development-A conveyed to Cape Commerce Nominee Trust Sub phase 2B which Included Building F, units F1, F2, and F3 as described in the Master deed. Also conveyed were the Declarants rights including the exclusive right to place sales signs on the property. All of the above documents are referenced on the attached site plan and recorded at the Barnstable Registry of deeds. Units F1, F2, and F3 are nearing completion and none of the units are sold. Part of the delay has been attributed to the inability of the existing Homeowners Association to obtain a Certificate of Compliance from the Conservation Commission due to some mulching in the resource area. The Homeowners Association has completed a landscape plan and the issue should be resolved within the next couple of weeks. Cape Commerce Nominee Trust would like to keep the marketing sign in place until the units are sold. The sign is 6 feet wide by 4 feet high including a 2"border around the perimeter . The border is constructed of plastic board and 4"x4"plastic posts. The original plan should still be on file at town Hall as just the letters changed.(see attached pictures). I have not included all the building plans in the enclosed package as that would be too cumbersome, and you have all the building plans in your own files. Ultimately, a final expiration date was imposed (June 30, 2012) and printed on the temp permit because the applicant sought to extend the permit numerous times. At this juncture, the subject sign has become an unpermitted unauthorized and•unapproved billboard for the Tradewinds. The construction is over (as confirmed by Chief Local Lauzon).. Recently, the appropriate parties were notified by Jeff verbally that it was time to remove the sign and reminded that the permit had long ago expired. Now comes, Doug Lebel seeking to retain the sign nevertheless and in fact had not long ago refaced it (without the required permit). The following sections of the zoning and. administrative codes (attached below) apply to this situation. Mr. Lebel was again made'awarei of the situaton and advised.to seek zoning relief. He clearly stated that he would not. After consulting with the Building Commsioner, I told Mr. Lebel the proper avenue was to in fact submit a new permit application as just suggested by the Building Commissioner: It was during this interaction at the counter that Mr. Lebel admitted that he refaced the original sign text board and attached it to the same posts (which he also stated had -not been touched). Mr. Lebel identified the sign as 24 sq. ft. I reviewed the original permit information (issued for 32'sq.) and asked again about the refacing of the original text board. He once again confirmed that he simply refaced the existing but insisted.it was only 24 sq. ft. He refused to pay the required corresponding fee of$75.00 but instead offered $50.00 for a 24 sq. sign. I said I would attach it to the application and make the BC aware. 240-63 Signs in Residential Districts 1. In residential districts, only the following signs are permitted: A. One sign displaying the street number and identifying the premises not to exceed two square feet in area. The street number must be approved by the Engineering Department j in conformance with the Town's regulations governing numbering of buildings.[I I u Editor's Note:See Ch. 51, Buildings,Numbering of. B. One sign no larger than four square feet in area shall be allowed which displays the name of the house or the name of the family residing therein. C. One sign not to exceed two square feet in area shall be permitted for a professional office or home occupation for which a special permit or variance has been granted by the Board of Appeals. D. One temporary sign not to exceed foursquare feet in area advertising property for sale, lease or rent. Such signs must be removed within 10 days of transfer of title or signing of lease or rental agreement. E.- Where a legal nonconforming business exists within a residential district, one sign may be permitted by the Building Commissioner if it is determined that the appearance, placement, size and lighting of the proposed sign will not be detrimental to the residential character or visual quality of the area. In no instance shall such signs exceed eight feet in . height or eight square feet in area. 1. Permits may be posted at construction sites as required by state or Town regulations, except that in no instance shall they be attached to trees or utility poles. I G. One identification sign not to exceed 12 square feet in area may be" ermitted at any public entrance to a subdivision or multifamily development. There is a small hanging sign.at the entrance. A 12 sq.may be proposed for consideration. H. Illuminated signs within residential zones require the approval of the Building Commissioner, and may be permitted if the applicant can demonstrate that the proposed illumination will not intrude upon adjacent residential areas,will not be illuminated ' except during actual hours of business, and will not cause traffic hazards.
