Section 2403.8.1 (which refers you to section 503)requires a minimum of a 20-foot wide fire apparatus access road. Section 2403.8.6 requires a 12 foot wide fire break on all sides of the tent unless otherwise approved by the fire code official (which in this case would be the building official due to this being referenced in the building code.) Section 2403.8.2 requires that tents shall not be located within 20 feet of lot lines, other tents,parked vehicles, or internal combustion engines. Table 2403.12.2 requires a tent with an occupancy load of between 1000 and 1999 to have a minimum of 5 means of egress with a minimum width of 120 inches. There'is now language in the new Massachusetts Fire Code, 527 CMR 1 which also addresses access. Section 10.15.2 states that the AHJ shall be permitted to regulate all outdoor events such as carnivals and fairs as it pertains to access for emergency vehicles; access to fire protection equipment;placement of stands, concession booths,and exhibits; and the control of hazardous conditions dangerous to life and property.. I wanted to begin discussions now to give Best Buddies adequate time to make adjustments to the layout of the tent in order to be compliant with both building code and the fire code. DORAN At a regularly scheduled hearing of the Zoning Board of Appeals, held on May 4, 1989, notice of which was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of the Commonwealth of Massachusetts, the Petitioner, Stephen W. Doran, through attorney Howard C. , Cahoon, Jr. , requested. a Variance pursuant to Section 2-3. 1 of the Town of Barnstable Zoning Bylaw to allow two soft drink vending machines in a commercial parking lot located on Assessor's M_ap--206,-Lot-94,�Craigvi-l-le Beach Road, (� Centerville, MA in an RC zoning distri"ct. In support of the petition, Mr. Doran presented evidence that the following conditions applied which would warrant the grant of a Variance: C In 1964 the Zoning Board of Appeals granted a use Variance on this property located directly across from the Town Parking lot at Craigville Beach to allow a commercial parking .lot. The lot has been paved and is used as a parkinglot from May through Labor Day. The petitioner is presently seeking a Variance to allow the placement of two soft drink vending machines on the lot. The lot has a unique shape having apporximately 200 feet of frontage on Craigville Beach Road tapering to approximately 100 feet and running approximately 700' to the creek , certain topography of the lot in terms of being flat and covered with asphalt would also deem it to be unique. The lot presently cannot be used for any purpose other than parking which creates a hardship to the petitioner. The placement of soft drink vending machines on the lot would allow the petitioner a fuller use of the lot and enable him to increase the income potential . 7 I/ The proposed placement of the ma-ch-ines on the lot will not create any substantial detriment to the area and will not substantially derogate from the intent and purpose of the Bylaw. FINDINGS OF FACT Based on the evidence submitted the Zoning Board of Appeals made the following findings of fact: 1 . The lot is a flat, paved, parking lot and has a unique shape; 2. a literal enforcement of the Bylaw would involve substantial hardship to the petitioner in that he would not be allowed to use the parcel to its fullest extent and would be deprived of the income from the proposed vending machines, and by "implication, he would not be as .competitive as other areas that do have machines; 3 . to grant relief would not be detrimental to the neighborhood affected, for in derogation of the spirit and intent of the Zoning Bylaw. DECISION Based on the information given and the findings of fact, at a meeting held on May 4, 1989, by a motion duly made and seconded the Zoning Board of Appwals voted to grant the Variance being sought. The vote was as follows : AYES: JANSSON, MCGRATH, BURMAN, MORIN NAYES: LALLY In granting the Variance, the Zoning Board of Appeals imposed the following conditions , the violation of which shall result in the revocation of the Variance being granted: .1 . DORAN At a regularly scheduled hearing of the Zoning Board of . Appeals, held on May 4, 1989, notice of which was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of the Commonwealth of Massachusetts , the Petitioner, Stephen W. Doran, through attorney Howard C. Cahoon, Jr. , requested a Variance pursuant to Section 2-3 . 1 of the Town of Barnstable Zoning Bylaw to allow two soft drink vending machines in a commercial parking lot located on Assessor's Map c206,Lbt`-94�-, Cra i gv i 1 1 e Beach Road, Centerville, MA in an RC .zoning district. In support of the petition, Mr. Doran presented evidence that the following conditions applied which would warrant the grant of a Variance: In 1964 the Zoning Board of Appeals granted a use Variance on this property located directly across from the Town -Parking lot at Craigville Beach to *allow a commercial arkin lot. The lot has been paved and is P 9 . p i used as a parkinglot from May through Labor Day. The petitioner is presently seeking a Variance to allow the placement of two soft drink vending machines on the lot. The lot has a unique shape having apporximately 200 feet of frontage on Craigville Beach Road tapering to approximately . 100 feet and running approximately .700' to the creek, certain topography of the lot in terms of being flat and covered with asphalt would also. deem it to be unique. The lot presently cannot be used for any purpose other than parking which creates a hardship to the petitioner. The placement of soft drink vending machines on the lot would allow the petitioner a fuller use of the lot and enable him to increase the income potential . The proposed placement of the machines on the lot will not create any substantial detriment to the area and will not substantially derogate from the intent and purpose of the Bylaw. FINDINGS OF FACT Based on the evidence submitted the Zoning Board of Appeals made the following findings of fact: 1 . The lot is a flat, paved, parking lot and has a unique shape; . 2. a literal enforcement of the Bylaw would involve substantial hardship to the petitioner in that he would not be allowed to use the parcel to its fullest extent and would be deprived of the income from .. the proposed vending machines, and by implication, he would not be as competitive as other areas that do have machines; 3 . to grant relief would not be detrimental to the neighborhood affected, for in derogation of the spirit and intent of the Zoning Bylaw. DECISION Based on the information given and the findings of fact, at a meeting held on May 4, 1989, by a motion duly made and seconded the Zoning Board of Appwals voted to grant the Variance being sought. The vote was as follows : AYES: JANSSON, MCGRATH, BURMAN, MORIN NAYES: LALLY In granting the Variance, the Zoning Board of Appeals imposed the following conditions, the violation of which shall result in the revocation of the Variance being granted: 1 . No. more than two (2) soft drink vending machines shall be located in the non-travel portion of the parking .lot; 2 . the vending machines shall be for containerized soft drinks only; 3 . the units involved shall be effectively camouflaged and secured to the premises, so that they are as aesthetically pleasing as possible and do not present a detraction or safety hazard from Craigville Beach Road; 4. the machines shall be properly secured so that there will be no vandalism. Any person aggrieved by this decision may appeal to the Barnstable Superior Court, as prescribed in Section 17 of Chapter 40A of the General Laws of Massachusetts by filing a Complaint in said Court as well as a notice of action with . the Barnstable Town Clerk, within twenty (20) days of the filing of this decision with the Barnstable Town Clerk's Of 'ce.
