The current exemption for"homeowners"was extended to include owner-occuRied dwellings of six units or less and to allow
homeowners to engage an individual for.hire who does not possess a license,provided that the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Persons)who owns a parcel of land on which he/she resides or intends to reside,on which there is, or is intended to be,a one or two-
family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one
home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form
acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section
109.1.1)
The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes,
bylaws,rules and regulations.
The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection
roced es and.requ ire and that he/she will comply with said procedures and requirements.

Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION.
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section
109.1.1 -Licensing of construction Supervisors);provided that if the-homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as
supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for'.
Licensing Construction Supervisors,Section 2,15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons.
In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately
responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner
certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and
adopt such a form/certification for use in your community,

Trust on a proposed project to construct a single family dwelling with garage, utilities,
and landscaping. Map 206 Parcel 85-2. The parcel is shown on Plan 138-45, Land of
Margaret Hamilton, dated September 12' 1957, ((
The parcel in question is significantly undersized based on current zoning laws. (plan
submitted to the Conservation Division states the parcel as 18,616 sq. ft.) We do not
understand why the Conservation Division is reviewing the project on property, which
has an opinion on record. by the Building Commissioner of the Town of Barnstable
requiring zoning relief (See enclosed letter,November 21, 1988.)
We have researched the 1988 opinion with the Planning Dept of the Town of Barnstable.
I met with Mr. Arthur Traczyk, Principal Planner, on July 10, 2001. He confirmed that
the parcel 206.85-2 is non-conforming and was in common ownership with other
contiguous property (Margaret Hamilton) during zoning changes.
We believe the said project requires significant zoning relief and would like to go on
record as requesting notification of any building permit requests on this parcel.
We would request that this non-conformance issue be fully resolved. We are in
opposition of this project as outlined in the notice.

In our research of the property, it has come to our attention that there is on record with
the town an opinion by former building commissioner, Joseph DeLuz, that the parcel is
not buildable. More recently, this opinion has been confirmed by Arthur Traczyk,
Principal-Planner, Planning Department. These opinions are enclosed. As cited, the lot
does not meet the separate lot exemption for nonconforming lots as per Section 4-4.2, 1)
A and D of the Barnstable Zoning Ordinances. Common Lot Protection, if any, would
have expired 5 years after 1958, the date of the change to a minimum lot size of 20,000
sq. feet.
It is our understanding that the review process by the Conservation Commission should
not proceed where a lot is determined to be unbuildable.

I have called Mr.Balsamo,explained our process and told him that we have no mechanism to trigger his

Dear Mr. and Mrs.Balsamo:
I have done a partial title on the property and based on the papers and documents.
you gave me,I believe the property was originally owned by Margaret Hamilton who in
1957 subdivided the parcel into Lots B and C on a plan in Plan Book 138 Page 45. At
that time the land was zoned RB-1 which required 10,000 square feet. Therefore,both
Lots B and C complied with zoning. I believe the zoning was increased in 1958 to
20,000 square feet. However; Mrs.Hamilton lived until 1985 and at the.time of her death
the property remained in her individual name. Under her will parcel 85-2 ,,which is Lot
C on the plan,was devised to her son who disclaimed and therefore passed to her
grandson Hayward Hamilton. I believe.that despite the subdivision in 1957, the title
remained in the same name until 1986 and therefore the lot is unbuildable without action
by the Board of Appeals. I do not believe there was any protection or grandfathering
other than protection from 1958 for five years. It is therefore my opinion that without
resorting to the Board of Appeals for a variance,this lot remains-unbuildable.

Dear Mr. Gatewood,
We are writing to express our opposition-to the proposed construction project described
in the notice of intent, abutter notification letter from S &T Trust dated 7/2/01. The said
project location is described as map 206 parcel 85-2. The parcel is shown on Plan 138-45,
Land of Margaret Hamilton, dated September 12, 1957.
In our research of the property, it has come to our attention that there is on record with
the town an opinion by former building commissioner, Joseph DeLuz, that the parcel is
not buildable. More recently, this opinion has been confirmed by Arthur Traczyk,-
Principal Planner, Planning Department. These opinions are enclosed. As cited, the lot
does not meet the separate lot exemption for nonconforming lots as per Section 4-4.2, I)...,
A and D of the Barnstable Zoning Ordinances. Common Lot Protection, if any, would.f
have expired 5 years after 1958, the date of the change to a minimum lot size of 20,000,
sq. feet. '
It is our understanding that the review process by the Conservation Commission should
not proceed where a lot is determined to be unbuildable.

the name of the late Margaret Hamilton lot "C" would not be buildable be-

located in a Residence D1 zoning district. My decision, however, could be
appealed to the Barnstable Board of Appeals.

to eliminate lot "C" file a new plan and have it recorded at the Barnstable
