As quoted from the"law", an employee is defined as every person in the service of another under any contract of hire,express or implied, oral or written. An employer is defined as an individual,partnership, association, corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership, association or other legal entity, employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer. MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required. There is also an existing driveway ' According to assessor's records dated 12/15/99 Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 2000-04-Rudy Variance to Section 3-1.1(5)Bulk Regulations-Front Yard Setback on that side of the house (which is the one they currently use)which will lead directly into the new garage addition. Mr. Rudy submitted a letter, dated October 6, 1998, from the Barnstable Police Department which states the new driveway, located further south in the area of the proposed addition, provides for an increased line of sight and safety factor for vehicles traveling on Craigville Beach Road and exiting this site. As to Variance conditions, pursuant to MGL Chapter 40A, Section 10, Mr. Rudy explained the lot is'/< acre but the rear and south side of the house are either in wetlands or within the wetland's 50 foot buffer zone. There is a very steep slope on the side of the house. The.proposed location of the garage is the best place and takes into account all the wetlands. The applicant is also in the process of completing a new addition to the rear of the lot. That addition does not need zoning relief. The proposed garage was the subject of a Variance from the Conservation Commission because the rear corner of proposed garage is about 9-10 feet into the 50 foot wetland buffer zone. The Order of Conditions was approved in November(1999) and the applicant agreed to remove the existing garage and the existing driveway completely. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of January 5, 2000, the Board unanimously found the following findings of fact as related to Appeal No. 2000-04: 1. The applicant, Larry D. Rudy, is seeking a Variance to Section 3-1.1(5) Bulk Regulations- Front Yard Setback. The property address is 1259 Craigville Beach Road, Centerville, MA as shown on Assessor's Map 206, Parcel 055. The site is 0.74 acres in size and located in the AP Aquifer Protection Overlay District. 2. The property is improved with two structures; a one and three quarter story single-family dwelling with a living area of approximately 1,700 sq. ft. and a detached garage structure of about 360 sq. ft. 3. The property is located in an RD-1 Residential Zoning District which requires a minimum 30' front yard, 10' side yard and 10' rear yard setback. 4. The applicant is proposing to construct a new garage addition to be.24' x 24' on the southeast side of the existing residence. The proposed addition will encroach 9 feet into the minimum 30 foot front yard required off Craigville Beach Road. 5. The lot is surrounded by wetlands located to the rear and south of the subject site. 6. The property is located in an RD-1 Residential•Zoning District which requires a minimum 30'front yard, 10' side yard and 10' rear yard setback. The applicant is proposing to construct a 24' x 24' garage addition to the southeast side of the existing residence. The proposed addition will encroach 9 feet into the minimum 30 foot front yard required off Craigville Beach Road. The applicant is applying for a Variance to Section 3-1.1(5) of the Zoning Ordinance-Bulk Regulations, to permit the proposed addition to be located 21 feet from the front property line where a minimum 30'front yard setback is required. Staff Review: Vacant wetlands are located to the rear and south of the subject site. Single-family residences are located to the east across Craigville Beach Road. A 6.25 acre single-family residential lot abuts the property to the north. The properties that would be most affected by this proposal are the residences located across Craigville Beach Road. As.of this writing, staff has not received any letters in favor or in opposition to this request from any abutter. As part of this project, the applicant is proposing to demolish the existing garage structure, remove the existing paved driveway and landscape this area. The applicant has submitted a letter dated October 6, 1998 from the Barnstable Police Department which states the new driveway, located further south in the area of the proposed addition, provides for an increased line of sight and safety factor for vehicles traveling on Craigville Beach Road and exiting this site. Staff agrees with this assessment given the topography of the road and the location of the intersection of Horseshoe Lane with Craigville Beach Road. According to assessor's records dated 12/15/99 Town of Barnstable-Planning Department-Staff Report c Appeal Number 2000-04-Rudy Variance to Section 3-1.1(5)Bulk Regulations-Front Yard Setback The proposed addition is located within 100 feet of a wetland resource area and, therefore, falls under the jurisdiction of the Conservation Commission. The applicant has submitted a copy of the Order of Conditions approved on November 16, 1999. Staff suggests the applicant also submit elevations of the proposed addition for the Board's review. Variance Findings: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the requested Variance,they may wish to consider the following conditions: 1.
