Pursuant to this statute, an employee is defined as"...every person in the service of another under any contract of hire, ; express or implied,.oral or written." An employer is defined as."an individual,partnership,association,corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer,or the . receiver or trustee of an individual,partnership, association or other legal entity, employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to bean employer." MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage requlred." Additionally,MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance ofpublic work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building.permit. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." _ Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. In preparing this letter we have examined title to Lots 57, 58, 59 and 60 as they appear on a Plan recorded at the Barnstable County Registry of Deeds in Plan Book 223, Page 139 from 1968 to the present. Lot 59 (51 Limerick Court),which is the subject matter Lot, was acquired by Robert Doherty and Patricia Doherty, husband and wife, from Copley Tpke. Trust by deed dated September 2, 1970. Title to this property remained in the Doherty's until they deeded the Lot to Elaine Porter on June 15, 1972. Elaine Porter deeded the premises to Richard and Eleanor Craven in November 1972 who in turn deeded the property to Elaine Kaplan in August 20-1. Kaplan deeded the premises back to the Cravens in February 2005; however, the Court has voided that conveyance leaving title to the premises in Kaplan. Lot 57 (72 Donegal Circle) was deeded by Barnstable Bldg. Co., Inc. to Marion Wolsieffer in July 1971. Marion Allen formerly Wolsieffer deeded the premises to Michael and Leslie Curran in April 1973. There were various conveyances between members of the Curran family in March 1983 and December 1983 until William Curran deeded the premises to Thomas F. Daley, IV in April 2004. Title remains in Thomas Daley, IV. Page 2 James Milano August 3, 2005 Lot 58 (84 Donegal Circle) was deeded by Copley Tpke.Trust to Barnstable Building Co., Inc. in March 1972. Barnstable Building Co., Inc. deeded the premises to David Fraser who held title until September 1999 when he deeded the premises to Thomas and Judith Chamberlain. Title remains in the Chamberlains. Lot 60 (39 Limerick Court) was deeded by Copley Tpke. Trust to Centerville Construction in August 1970. Centerville deeded the premises to Daniel and Mary Sullivan in September 1970. The Sullivans deeded the premises to Leo and Kathleen Fleming in August 1983 and Leo and Kathleen Fleming deeded to Kathleen Fleming in March 1993. Kathleen continues to hold that title. Based upon the record, the subdivision was approved by the Planning Board in September 1968. The proponent of the Plan was Copley Turnpike Trust. All of the lots referenced above were deeded out by the Developer, Copley Turnpike Trust, within the zoning freeze period afforded to subdivisions under G.L. 40A§6. The most recent date upon which any of these parcels were held in common ownership is March 19, 1971 when Copley Turnpike deeded its interest in Lot 57 to Barnstable Building Co., Inc. (at that time Copley still held title to Lot 58). Since that time, all lots have remained in separate ownership. Lot 59, the subject matter lot, has been held in separate ownership from all abutting parcels since September 21, 1970. It is my understanding that the minimum lot size requirement prior to a 1985 zoning change in this RC District was 15,000 square feet. At that time (and since that time), this lot was not held in common ownership with any adjoining property. In addition, as previously stated, the lot was held separately from adjoining land during the zoning freeze protection period afforded by the subdivision plan approval. Given these circumstances, it is my conclusion that this parcel would be entitled to a Building Permit, given the grandfather provision of both 40A§6 and our local By-Law Section 4-4.2.
