I This office represents Arthur and Meryl Frank , owners of Lot 13 , Elliot Road , Centerville , Massachusetts , as shown n o copy: of attached subdivision plan recorded in Plan Book � 305 , Page 44 . I have examined the title to Lot 13 from the date of this subdivision plan to the present , and I find no instruments of record altering the boundaries of this Lot 13 ; no deeds , no boundary agreements , no easements , or any other instrument . As you know , there was a new subdivision plan recorded in Plan Book 347 , Page 71 which shows a different northeasterly distance for Lot 13 , therein designated Lot 13A I have attached 1 a copy of the pertinent portion of this plan . To change the ' size or dimensions or configuration of Lot 13 , however , a deed of the portion by which the lot was reduced on the new plan would- have had to have been executed and recorded by the owner of record of Lot 13 . There is no such deed . To t-he extent that the revised northeasterly distance. does not change the size , dimensions or configuration of Lot 13 on the original subdivison plan but merely reflects a remeasure- ment at this course on the same angle as the original plan , all of the setback requirements in the Barnstable Zoning By-Law are still met , whether reliance is on the old or the new plan . May 13, 1987 Mr. Joseph DaLuz Building Inspector Town of Barnstable Hyannis, Massachusetts 02601 Re: Hirsch - Frank - Elliott Road, Centerville Dear Joe: I represent Mr. and Mrs. David Hirsch, the owners of Lot 12, Elliott Road, Centerville. This lot abuts Lot 13 owned by Arthur Frank. Mr. Frank was formerly represented by Attorney Richard Cohen and later by Attorney Elizabeth McNichols. Ms. McNichols told me that as of yesterday she no longer represented Mr. Frank and thought he had consulted Attorney Edward McLaughlin but I have been unable to verify this. Mr. Hirsch and I believe that the proposed construction on Lot 13 infringes onto Lot 12. Our belief is based on the following: Lot 12, containing 35,177 square feet and Lot 13, containing 20,240 square feet, are both shown on a plan filed in the Barnstable County Registry of Deeds in Plan Book 305 Page 44. On this plan the common boundary line between the Southwesterly side of Lot 12 and the Northeasterly side of Lot 13 is given as 155.79'. This is an obvious ,scrivenor's error and the correct length of this line is 139.34'. There is another later plan of these two lots filed in Plan Book 347 Page 71. Both plans show the same configuration, the same total square footage and the same compass courses on all lines. The only difference in the two plans is that the line labeled as being 155.79' in length on the earlier plan is correctly labeled as being 139.34' on the later plan. Using a scale of I" = 40', which is the scale on both plans, it is apparent that this line is exactly the same on both plans, except for the labeling of the length. The site plan prepared by Ellis and Thulin dated December 9, 1986 purports to show Lot 13. However, if you overlay the site plan on the subdivision plan, it is apparent that the site plan includes a portion of Lot 12, which is owned by Mr. and Mrs. Hirsch. I enclose copies of portions of the two recorded plans and the site plan for your information. r i Mr. and Mrs. Hirsch hope that the matter can be resolved amicably, but in view of the apparent discrepancy between the plot plan and the recorded plan, no foundation and/or building permit should be issued.
