The Route 28 project is underway and construction will start after the first of the year. The telephone company will start their work next month. The Route 28 project involves the intersections of Route 28&Phinneys Lane and Route 28&Old Stage Road. The Town is working to improve that area during the „ 4 same time frame as the State so the repaving of Route 28 will overlap and be paid by the State. As to curbcuts along this section of Route 28,the MA Highway does not agree with the driveways being limited to right in and right out only because the configurations do not work. The only approach that MA Highway will agree to(in an effort to limit left hand tums and not allow people to illegally tum Into the site)is t through the use of a median in the center of the roadway. In looking at this section of Route 28,the use of a Median is not practical. The State does not have a problem with the"theory",of right in right out however, r they are concerned with the geometry of driveway and the turning movements. There is a problem with the .2 r IEI��i 1 Town of Barnstable-Zoning Board of Appeals-Decision and Notice _° Appeal Number 1998-103-Morin a. Variance to Section 3-3.6(6)Bulk Regulations Town's ability to enforce only right in and right out turning movements because people go over the curb and they do not obey the signs. No matter how good the Town's intentions,.people ignore signs. The Board again addressed the issue of the.modification of Appeal Number 1990-40. The 1973 Belfer vs. Building Commissioner of Boston Case involves a variance being tolled because an appeal was taken on that r� variance. There Is reference in the Belfer Decision to Woods vs. Newton(351 MA 98)which may apply to i this[Morin]appeal. The Board asked Assistant Town Attorney Ruth Well if she could address the issue of I tolling of time. The Variance granted in 1990 had specific conditions put upon the granting of the Variance Which made the applicant unable to exercise the grant of the Variance until those specific conditions were l fulfilled. She reported to the Board that she needs to look at the facts In this appeal and the case of Belfer €f vs. BuNding Commissioner of Boston before she could advise the Board. It was unanimously decided to continue Appeal Number 1998-102 and Appeal Number 1998-103 to December 16, 1998 at 7:00 PM. Board Members hearing these appeals on December 16, 1998 were Ron Jansson,Tom DeRiemer, David Rice,and Chairman Emmett Glynn. Attomey Patrick Butler represented the applicant,Jacques Morin,who was present. c} Upon opening these appeals,Chairman Emmett Glynn explained that there are only four Board Members resent tonight who had previously heard-these a p p i' P 9 P y appeals. Under MGt.Cha ter�40A,a positive vote of at least four out of a five member board is needed to grant the relief being sought. The applicant was given the opportunity to have his appeals heard this evening by the four member board,or the option of asking for a , continuance to a date when the original five members hearing these appeals would be present. Attorney Butler elected to proceed with a four member board. d. Prior to this continuance,a memorandum regarding the issue of the tolling of time,dated December 11, 1998, from the Legal Department was submitted to Board along with a memorandum from Attorney Butler also dated December 11, 1998. Board Member Ron Jansson stated he reviewed both memorandums,and after reading the supplied information-in his opinion-the original Variance expired. It was decided that the Petitioner would proceed onto Appeal Number 1998-103 and then go back to Appeal Number 1998-102. Attorney Butler reminded the Board of his memorandum of September 9, 1998 which gave Variance Conditions. He reviewed his memorandum and displayed a conceptual drawing of the proposed building. ' Y The applicant is seeking a Variance to the bulk regulations,to allow for aside setback of 10.44 feet to the west and 11.50 feet to the east and to allow for a rear yard setback of 10.66 feet. The lot is small and Sri triangular in shape and adjacent to Route 28. The site is located in the newly developed HO Highway Office .::w. Zoning District. i The foundation that is currently in the ground,was built in accordance with a foundation permit issued by the Town in 1992. A six year time period,has transpired since the foundation was'poured pursuant to a valid building permit. In that time period,changes have occurred in ADA Regulations and Code Requirements. This building now requires an elevator and the entire property must be handicapped accessible which impacts the layout of the building. These structural changes affect the rear and Side setback requirements.This Is the only relief they are seeking. i i4 is As to Variance Conditions,Attorney.Butler,stated the uniquely shaped nature of the lot-'an inverted triangle' together with the location of the existing foundation to the near of the lot is a unique condition that exists that l affects the locus but not the zoning district in which it is located. Under the HO Highway Office Zoning District,the proposal meets the FAR(Floor/Area Ratio),the parking requirements,and all other requirements of the district with the exception of the side and rear yard setback requirements. He stated the building height conforms to'Zoning and the Association does not want to see a third floor. Affirmative Fair Marketing and Lottery All LAU projects must have an affirmative fair marketing plan approved by DHCD. There shall be a specific prohibition of discrimination on the basis of race, creed, color, sex, age, disability, marital status, familial status, sexual orientation,national origin, veterans status, or any other basis prohibited by law in the leasing or sale of units, except for exempt age-restricted developments. The three basic elements of an affirmative fair marketing plan are: • affirmative fair marketing in compliance with all applicable,fair housing laws • local preference(if any) • the buyer/tenant selection process. Affirmative Fair Marketing The goal for each marketing plan is to achieve a percentage of minority ownership or tenancy in low or moderate income units equal to the greater of. (1) the percentage of minority households in the municipality; or, (2)the percentage of minority households in the HUD area in which the municipality is located. The goals will be established using the 2000 Federal Census until new census data become available and are listed in Appendix C. All LAU projects shall have a DHCD-approved affirmative marketing plan which outlines the steps that will be taken, including advertising and outreach to minority organizations,to seek to achieve the minority participation goal. Affirmative fair marketing of all the affordable units shall provide suitable opportunity for low and moderate-income households, especially minority households, to enter the lottery. Typically, ads are placed in local and regional newspapers, and newspapers that serve minority groups and other protected classes. Notices should be sent to local fair housing commissions, area churches, local and regional housing agencies, local housing authorities, civic groups, lending institutions, social service agencies, and other non-profit organizations. Local employers may be contacted. All projects shall be listed on the Citizen's Housing and Planning Association(CHAPA) website (www.chapa.org/housing_lotteries.htm), and at the Massachusetts Affordable Housing Alliance (MAHA) (notices to be sent to: chassan@mahahome.org). Projects located in the Boston-Cambridge-Quincy MSA shall be posted on the City of Boston's Metrolist (Metropolitan Housing Opportunity Clearing Center), at Boston City Hall, P.O. Box 5996, Boston, MA 02114-5996 (617-635-3321). Handicapped-accessible units should be posted on the Mass Accessible Housing Registry sponsored by the Citizens' Housing and Planning Association (see www.chapa.org for more information). Local Action Units Page 28 4. Local Initiative Program Guidelines LIP requires that marketing occur during a period of at least 60 days and that advertisements will run a minimum of two times. See Appendix F for more information. I i Local Preference I A project's marketing plan may include local preference for up to 70 % of the LAUs, supported by a reliable determination of need for such a preference. The community may determine categories of local preference provided they are reasonable and do not have a discriminatory or unlawful effect. Need should generally be established by a housing needs study. If the percentage calculation of local preference units does not produce whole number,DHCD will round down. For example, if there are 11 affordable units, a 70% calculation is 7.7 units. DHCD will allow,7 units to be set aside for local preference. No Durational Residency: A community may not choose residents based on durational residency requirements or residency preferences based on how long a person may have resided in, or in some cases worked in, a community. Durational,residency requirements and residency preferences for obtaining certain government benefits, such as subsidized housing, have been held to be unconstitutional unless they are justified by a "compelling governmental interest" and unless they are the least burdensome means of serving that interest. It is unlikely that any plan that includes durational residency requirements or preferences could meet this very stringent legal test. Local preference, so long as not durational, may be included in a resident selection plan in accordance with these Guidelines. Larger Households Preference Within an applicant pool first preference shall be given to households requiring the total number of bedrooms in the unit based on the following criteria: a. There is at least one occupant and no more than two occupants per bedroom. b. A husband and wife, or those in a similar living arrangement, shall be required to share a bedroom. Other household members may share but shall not be required to share a bedroom. Local Action Units Page 29 Local Initiative Program Guidelines c. A person described in the first sentence of(b) shall not be required to share a bedroom if a consequence of sharing would be a severe adverse impact on his or her mental or physical health and the lottery agent receives reliable medical documentation as to such impact of sharing. Within an applicant pool second preference shall be given to households requiring the number of bedrooms in the unit minus one,based on the above criteria. A"household" shall mean two or more persons who will live regularly in the unit as their principal residence and who are related by blood,marriage, law or who have otherwise evidenced a stable inter-dependent relationship, or an individual. Lottery drawings shall result in each applicant being given a ranking among other applicants with households receiving preference for units based on the above criteria. Household size shall not exceed state sanitary code requirements for occupancy of a unit(See 105 CMR 400). If a project includes units accessible or adaptable for occupancy by physically disabled persons in conformity with requirements of M.G.L. c. 22 §13A and the Architectural Access Board,preference i for those units shall be given to such physically disabled persons. Initial Unit Sales/Mortgage Standards i Prior to the sale of a unit,DHCD will review and approve the terms of the buyer's mortgage . financing. DHCD requires LAU buyers to have 30-year level payment, amortizing- mortgages and a down payment of at least3%. Project sponsors are encouraged to work with local banks to provide competitive.financing to potential first-time homebuyers. (Note: LAU loan requirements differ from the LAU pricing policy,which assumes a 5% down payment.) New mortgage loans for LAUs must meet the following minimum standards: • The loan must have a fixed interest rate through the full term of the mortgage. The loan must have a current fair market interest rate. The Certificate must be recorded along with the deed and the LIP Deed Rider. " In order to prepare the Certificate, DHCD requires the following documents no less than 2 weeks before the loan closing date: • A copy of the LOAN COMMITMENT LETTER from the buyer's lender including interest rate, points, length of loan, and annual percentage rate. • A copy of the PURCHASE AND SALE AGREEMENT for the unit. • Contact information for the loan CLOSING ATTORNEY including name, address, phone and fax numbers. DHCD will mail and fax the Resale Price Certificate to the buyer's closing attorney. In addition, DHCD shall provide the deed rider for use at the closing. The closing attorney will record the deed, Deed Rider, and Resale Price Certificate and, within 10 days,. submit a copy of both signed documents, with recording information, to: LIP, 100 Cambridge Street, Suite 300, Boston, MA 02114, attn: Elsa Campbell. H. Term of Restrictions; Use of DHCD Documents The term of affordability for the project should generally be the longest period permitted by law. The model LIP Regulatory Agreement and Deed Rider, which constitute "affordable housing restrictions'.' as defined in G.L. c.184 §§ 31 and 32, provide for affordability in perpetuity. A shorter term of affordability will be approved only upon a showing that a longer term is infeasible or not in the public interest. The term of affordability for LIP purposes will in all cases be no less than the term specified in a comprehensive or special permit issued for the project, many of which require perpetual affordability. For new construction LAU projects, DHCD requires a Regulatory Agreement be executed among DHCD, the Municipality, and the developer. Any modifications to DHCD's model regulatory agreement proposed by a developer or municipality must be shown in redlining against DHCD's model document when submitted to DHCD for review. I stated that he was more than welcome to call the State Fire Marshal's Office for interpretation if he disagreed with my interpretation. Mr. Morin stated that he had been in touch with the Building Commissioner and is meeting with him next week to set a course of action to correct the issues. The door has a lock, lockable from the first floor side, creating an entrapment hazard. Compliance Officer Regan issued a violation to Mr. Morin. Page 2 FINDINGS The Commission has considered.the Applicant's request for a Jurisdictional Determination for the proposed subdivision, and based on consideration of such application and upon the information presented at the public.hearing and submitted.for:the record, makes.the:following findings pursuant to Sections 12 and 13;of the Act , f G1. Section 22(b)of the Cape Cod Commission Act exempts from,-,Commissiori review any development which prior to July 1, 1989 has received certain local permits.- The project did'not receive any local permits prior to July 1, 1989. Therefore, the project is not exempt under Section 22(b) of the Act. G2. The Comprehensive Permit application was originally filed in August 3, 2000 and sought to divide the property into 168 multi-family condominium units. The Barnstable Zoning Board of Appeals did not approve this request, but instead approved 44 multi-family or single-family homes. The Barnstable Zoning Board of Appeals decision was appealed to the Massachusetts Housing Appeals Committee (HAC). The HAC encouraged both parties to mediate the dispute, which resulted in the proposed project. G3. The Comprehensive Permit application will divide the property into 21 lots, 20 of which will be developed with single-family residences. The remaining lot will be left undeveloped under the Comprehensive Permit application. G4. Section 130) of the Cape.Cod Commission Act states that."For the purposes of sections twenty to twenty-three, inclusive, of Chapter 40B of the General Laws, the commission shall be considered a local board."As such,the Commission may comment in a similar manner to'.other..r' local boards on the 40B portion of..the,project.-This portion.of the.project is"'not subject{to mandatory DRI review because of this provision of Section 130) of the Act G5. The DRI Enabling Regulations, Barnstable County Ordinance 90-12, Section 3(d), requires- DRI review of "any development which proposes to divide land into thirty or more residential lots." The approximately 7.4-acre lot left undeveloped following the Comprehensive Permit application will be subdivided into 29 lots under the town's prevailing zoning and subdivision control laws, one less than the DRI threshold of Section 3(d). As part of the mediated settlement,. the Town of Barnstable has created a new zone district(Private Housing Initiative-Affordable Housing Development) that is applicable to the new 29-lot subdivision that will create lots of similar size to the surrounding neighborhoods_ . G6. The Commission does not.have.mandatory jurisdiction to review the project as a Development of Regional Impact as it does not qualify as a DRI under Section 3(d) of the Enabling Regulations.
