Crossen, Building Commissioner RE: Bell Tower Mall 1) Just prior to 1984, a subdivision plan was filed for a multi-lot residential subdivision on the site. In 1984, the BB district requirements changed, apparently due to an earlier effort by McDonalds to locate there. In 1984 the BB district, which previously allowed everything that the B district allowed, was changed to allow only office use and banks. 2) In 1987, a building permit was issued for a strip mall as we now know it. The building was built over a laid-out proposed way and over approved lot lines. Later, the Planning Board had to rescind the earlier subdivision plan due to this construction. . 3) I understand some form of grandfathering was the justification for this action. I do not see the connection as the construction in ignorance to the definitive plan of 1986 can in no way depend on a zoning freeze to justify the uses in that building now. It just does not make any sense. _ 4) Based on this and a discussion with Bob Smith, I think there is a zoning problem with most of the uses in that structure. Please advise.
