The Appellant received a Cease & Desist Order dated March 4, 2021 from the Sign Enforcement Officer which states the Appellants are in violation of the Sign Code because the displayed gas price signage was using intermittent LED lighting. The subject property is located at 1617 Falmouth Road, Centerville, MA as shown on Assessor's Map 209 as Parcel 085. It is located in the Highway Office (HO) and Residence C (RC) Zoning Districts. Appeal This matter involves an appeal of the Notice of Zoning Violation and Cease, Desist, and Abate dated March 4, 2021. In the Notice, it states that the Appellant is in violation of Part 1 of the Town of Barnstable General Ordinances, Chapter 240-61 Prohibited Signs (B) and ordered the Appellant to cease and desist all functions associated with the following: On February 25, 2021, the Sign Code Enforcement Officer observed that the gas prices were changing on the free standing sign for Garrett's Family Market. The changes in prices were displayed using intermittent LED lighting. The Notice states this is in violation of Chapter 240 Section 61 (B) which reads: Any sign which incorporates any flashing, moving or intermittent lighting. 'Background MPG Corporation and 1617 Falmouth Road Series of PB&C, LLC., as co-applicants, applied for and were approved for a Modification of Special Permit 2018-007 in order to modify the site plan from the prior Special Permit in accordance with Section 240-93, Section 240-94 and Section 240-53. The modification includes moving the building back further on the lot, reducing the building size by approximately 400 square feet, adding additional parking spaces and adding a fifth fuel pump island. The subject property is located at 1617 Falmouth Road, Centerville, MA as shown on Assessor's Map 209 as parcel 085. It is located in the Highway Office (HO) and Residence C (RC) Zoning Districts. The subject property is 1617 Falmouth Road, across from the Bell Tower Mail and Centerville Plaza, Centerville. The parcel contains approximately 1.23 acres. The surrounding area is a combination of various sized lots and mostly commercial uses. In 2018, the Applicant was granted Special Permit No. 2018-007 pursuant to Chapter 240-93 Nonconforming buildings or structures not used as single or two-family dwellings and Chapter 240-94 Nonconforming Use. Numerous site improvements were also proposed. As the Board may remember, the Applicant was granted the Special Permit without the proposed drive through. Procedural Review This appeal was filed with the Town Clerk's office and the Planning and Development Department, Zoning Board of Appeals Office on April 7, 2021. The Cease & Desist Order is dated March 4, 2021, and the Order was sent Certified Mail on March 5, 2021 to the Appellants Legal Representative. Please note March 61h and March 7th are weekend days, The Appeal is dated April 7, 2021. findings The Board should make findings when either voting to uphold or overrule the Building Commissioner's determination. It is the Board's responsibility to determine if the Building Commissioner properly determined that the Appellant's intermittent signage violates the Zoning Ordinance. Should the Board with to uphold the Building Commissioner's decision to order a Cease and Desist of intermittent lighting on the gas pumps, the Board should consider the following findings: 1. The Board affirms the Building Commissioner's finding that the gas prices were changing on a free standing sign using intermittent LED lighting in violation of Section 240-61 of the Ordinance. Should the Board wish to overrule the Building Commissioner's Decision to order a cease and desist, below are draft findings for the Board's potential consideration. 1. The Board finds that the gas prices changing on a free standing sign using intermittent LED lighting is not in violation of Section 240-61 of the Ordinance. Procedural Information . ..... ..... I just wanted to let you know that I went by Garrett's a couple of different times and noticed that the free standing changeable sign is blinking with price changes. Our sign ordinance (240-61 B) prohibits flashing and movement. The changeable feature was to remain static and utilized only when the gas price changes. I think it is now toggling between the prices of the various grades of gas. Can you have it adjusted so that it is a static sign. I know a lot of discretion was afforded to the applicant during the review and reconstruction phases but I don't remember this nuance being part of that approval or the ZBA's. Please advise.
