It is improved with a 20,028 sq. ft. retail shopping center(known as the Centerville Shopping Center), a 4,364 sq. ft. bank and the Centerville Post Office. The site is located in an HB Highway Business Zoning District. The applicant is requesting permission to replace the sign face of an existing roof sign previously used by "Village Video". The new sign is for a business called"Business Center of Cape Cod". Section 4-3.3(12)of the Zoning Ordinance specifically prohibits roof signs. The applicant is, therefore, seeking a Variance to Section 4-3.3(12)to allow the replacement of a sign face on an existing roof sign. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 19, 1999. A 90 day extension of time for holding the hearing and a 60 day extension of time for holding the hearing and for filing of the decision was executed between the applicant and the.Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened July 14, 1999, at which time the Board granted the requested Variance with conditions. Hearing Summary: Board Members hearing this appeal were Gail Nightingale, Richard Boy, Tom DeRiemer, Dan Creedon, and Chairman Emmett Glynn. Raymond Glaser represented himself. Mr. Glaser submitted a letter from Marcel R. Poyant, owner of the subject property,to show standing before the Board. He also submitted a copy of his temporary sign permit issued by the Building Department. Mr. Glaser is seeking a Variance to legalize his roof sign. As to Variance conditions, Mr. Glaser explained that he wants to replace the sign face on the existing roof sign used by the previous tenant. To move the sign down to the cutter line would be a financial hardship as it would be quite expensive to move. Plus, Mr. Glaser indicated it would be aesthetically unpleasant. His sign would be lower than all the other signs-the other signs in the shopping plaza are uniform in height. His sign would look out of place hanging from the cutter. Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-83-Glaser Variance to Section 4-3.3(12)Prohibited Signs-Roof Signs Gloria Urenas reminded the Board that the Town is in the process of changing/updating the sign regulations in the Zoning Ordinance. She is in agreement that this sign would not be aesthetically pleasing if it were moved to the cutter line as it would be the only sign in the plaza that was not a roof sign. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of July 14, 1999, the Board unanimously found the following findings of fact as related to Appeal No. 1999-83: 1. The applicant, Raymond W. Glaser d/b/a Business Center of Cape Cod, is seeking a Variance to Section 4-3.3(12)of the Zoning Ordinance. 2. The property address is 1660 Falmouth Road/Route 28, Centerville, MA as shown on Assessor's Map 209, Parcel 013. 3. The owner of the subject property is Marcel R. Poyant. The applicant is a tenant. A letter was presented to the Board to show standing. 4. The property consists of a 4.60 acre lot and is improved with a 20,028 sq. ft. retail shopping center (known as the Centerville Shopping Center), a 4,364 sq. ft. bank and the Centerville Post Office. 5. The site is located in an HB Highway Business Zoning District. 6. The applicant is requesting permission to replace the sign face of an existing roof sign previously used by "Village Video". The new sign is for a business called "Business Center of Cape Cod". 7. Section 4-3.3(12)of the Zoning Ordinance specifically prohibits roof signs. The applicant is, therefore, seeking a Variance to Section 4-3.3(12)to allow the replacement of a sign face on an existing roof sign. 8. There is a hardship in the shape of the plaza which is a topographical feature unique to this mail. There is a hardship in the lack of visibility. The store unit is far from the roadway and its distance and location makes it impossible to see. 9. If the Zoning Ordinance is literally enforced, it would mean a substantial hardship to the applicant as he would have to move the sign down. If the sign were to be moved down it would be the only sign at the lower location and would not be aesthetically pleasing to the entire mall. 10. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner. 11. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: A motion was duly made and seconded to grant the requested Variance, subject to the following condition: 1. The proposed sign shall be the same size and be in the same location as the previous sign upon the roof. The Vote was as follows: AYE: Gail Nightingale, Richard Boy, Tom DeRiemer, Dan Creedon, and Chairman Emmett Glynn NAY: None x 2 Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-83-Glaser Variance to Section 4-3.3(12)Prohibited Signs-Roof Signs Order: Variance Number 1999-83 has been Granted with Conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Appeals of this decision, if any, shall be made pursuant to MGL Chapter 40A, Section 17, within twenty (20) days after the date of the filing of this decision. Applicant's Address: q�1648 Falmouth Road(Rout—a 28)Centerville,MA-Store No. 4 Centerville Shopping Plaza Assessor's Map/Parcel: 209-013 Zoning: HB Highway Business Zoning District Applicant's Request: Variance to Section 4-3.7,Signs in a Highway Business District to permit an oversized sign Background Information: The petition is for a Variance from Section 4-3.7,Signs in a Highway Business District to permit an oversized sign. The locus is a 4.60 acre parcel that is developed with a multi unit shopping mall known as the Centerville Shopping Plaza. The exact locus is Store Number 4 located in the corner of the"L"shaped mall. The applicant is seeking a variance to permit a roof sign larger than that permitted under zoning. Store frontage of the unit is 15 feet. Under the ordinance,only a 15 sq.ft. sign would be permitted. The applicant is seeking a sign of 19 sq.ft.,4 feet larger than permitted as of right. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 20, 1995. A Public Hearing of the Zoning Board of Appeals was duly advertised and notice was sent to abutters in accordance with MGL Chapter 40 A. The Public Hearing was opened on April 19 at which time testimony was given and a decision to grant the appeal was reached by the Board. The petition was heard by Board members Ron Jansson,Richard Boy,Dexter Bliss,Emmett Glynn and Chairman Gail Nightingale. Attorney Peter O'Keefe represented the petitioner Kathy Shoud for her new business Roasters,Inc. scheduled to open next week. The store will provide food on site and for take out. Attorney O'Keefe cited that the size of the sign is regulated by frontage. (Section 4-3.7(3)). In this case it would allow only a sign of 15 square feet. The applicant is seeking a larger sign of 19 sq.ft.be placed in the exact location of a previous sign along the roof line. Section 4-3.3 12)prohibits rooftop signs. The hardship circumstance is the shape of the unit as shown in Exhibit B. It is a pie-shaped corner unit, unique to the mall,and creates the hardship in being the only store not rectangular. A second hardship is that of visibility. This store unit is the furthest from the roadway and its distance and location make it impossible to see. It would be the smallest sign in the entire mall. If the Zoning Ordinance is literally enforced it would mean a substantial hardship to applicant. Attorney O'Keefe stated that this relief could be granted without substantial detriment to the neighborhood or without derogation from the spirit or intent of the Zoning Ordinance. All of the mall tenants have larger roof signs. One also existed for the previous tenant. The intent is to replace what was originally there. Maintaining what previously existed corresponding to what exists would be more esthetically pleasing and create a balanced visual line. S Zoning Board of Appeals-Decision and Notice Appeal No. 1995 46 Roasters,Inc. Mr.Po ant,Real Estate Broker and owner of the property, Y p p riy,explained he had leased this unit to Roasters, Inc. He spoke in favor of the petition and hoped that the Board would see in their wisdom to grant this request. No one spoke in opposition. Finding of Facts: Based upon the testimony given during the Public Hearing on this appeal,the Board unanimously determined following findings of facts: 1. The subject property is located in a BB Highway Business Zoning District and the applicant is seeking a variance to Section 4-3.7(3)and Section 4-3.3 (12)that regulates signs within this district. 2. The request is for a variance to permit an oversized sign for the store measuring 19 square feet when zoning only permits a sign of 15 square feet. The sign is to be located where a previous sign once existed. 3. All signs in that mall are located on the roof area. To have a single sign below the roof line would detract from the established visual line and would not be noticeable within the shopping plaza. 4. There would be a financial hardship to the owner should she not be able to have a sign located in harmony with all existing signs. 5. Granting this relief would not be a detriment to the neighborhood nor would it derogate from the spirit or intent of the Zoning Ordinance. Decision: Based upon the positive findings a motion was duly made and seconded to grant the sign Variance with the following conditions: 1. The sign is to be 19 square feet. 2. The sign will be in the same location as the previous sign upon the roof. 3. This variance is granted as to Section 4-3.7 and 4-3.3 (12). Staff suggests the applicant submit authorization from the property owner to seek the zoning relief that is the subject of this appeal to show standing before the Board. Background: The property consists of a 4.60 acre lot commonly addressed as 1660 Falmouth Road, Centerville. It is improved with a 20,028 sq. ft. retail shopping center(known as the Centerville Shopping Center), a 4,364 sq. ft.bank and the Centerville Post Office. The site is located in an HB Highway Business Zoning District. The applicant is requesting permission to replace the sign face of an existing roof sign previously used by "Village Video". The new sign is for a business called"Business Center of Cape Cod". Section 4-3.3(12)of the Zoning Ordinance specifically prohibits roof signs. The applicant is, therefore, seeking a Variance to Section 4-3.3(12)to allow the replacement of a sign face on an existing roof sign. Staff Review: Apparently, the new sign is already in place. Was the applicant given permission to replace the old roof sign prior to the Zoning Board of Appeals hearing? The applicant should be prepared to address this question before the Board. Staff suggests the applicant provide illustrations of the proposed sign for the Board's review. Section 4-3.24(2)of the sign regulations-New Signs at Sites of Illegal or Non-Conforming Signs-states: "No sign permit shall be granted for a new sign to be located on a building or on a lot where one or more illegal or non-conforming signs exist until all signs on the building and/or lot are either removed or brought into conformance with these regulations." ram, Town of Barnstable-Planning Department-Staff Report Appeal Number 1999-83-Glaser 0 Variance to Section 4-3.3(12)Prohibited Signs-Roof Signs o i The application states that the need for the Variance is to prevent a hardship of not conforming with all the other signs in this shopping center which are also roof signs. A review of Zoning Board of Appeals records indicates that only Store Number 4 of this shopping center was granted a Variance to allow a roof sign (Appeal No. 1995-46). Unless a Variance is granted to permit a roof sign, the other signs on this building are classified as non-conforming by Section 4-3.24. It appears the applicant may also need a Variance from this section of the Zoning Ordinance. Staff suggests the Board could approve the applicant's request without having to re-advertise for additional relief, should the Board find to grant the requested Variance. In Appeal Number 1995-46, the applicant had applied for a Variance only to Section 4-3.7 Signs in a Highway Business District to permit an oversized roof sign. The Board granted a Variance to both Section 4-3.7 and Section 4-3.3(12)of the Zoning Ordinance(see attached copy of Decision and Notice). Variance Findings: In consideration for the Variance, the petitioner must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the requested Variance, they may wish to consider the following condition: 1. BB Highway Business Zoning District Applicant's Request: Variance to Section 4-3.7,Signs in a Highway Business District to permit an oversized sign Background Information: The petition is for a Variance from Section 4.3.7,Signs in a Highway Business District to permit an oversized sign. The locus is a 4.60 acre parcel that is developed with a multi unit shopping mall known as the Centerville Shopping Plaza The exact locus is Store Number 4 located in the corner of the"L"shaped mall. The applicant is seeking a variance to permit a roof sign larger than that permitted under zoning. Store frontage of the unit is 15 feet Under the ordinance,only a 15 sq.ft.sign would be permitted The applicant is seeking a sign of 19 sq.ft.,4 feet larger than permitted as of right. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 20, 1995. A Public Hearing of the Zoning Board of Appeals was duly advertised and notice was sent to abutters in accordance with MGL Chapter 40 A. The Public Hearing was opened on April 19 at which time testimony was given and a decision to grant the appeal was reached by the Board. The petition was heard by Board members Ron Jansson,Richard Boy,Dexter Bliss,Emmett Glynn and Chairman Gail Nightingale. Attorney Peter O'Keefe represented the petitioner Kathy Shoud for her new business Roasters,Inc. scheduled to open next week The store will provide food on site and for take out. Attorney O'Keefe cited that the size of the sign is regulated by frontage. (Section 4-3.7(3)). In this case it would allow only a sign of 15 square feet The applicant is seeking a larger sign of 19 sq.ft.be placed in the exact location of a previous sign along the roof line. Section 4-3.3 12)prohibits rooftop signs. The hardship circumstance is the shape of the unit as shown in Exhibit B. It is a pie-shaped corner unit, unique to the mall,and creates the hardship in being the only store not rectangular. A second hardship is that of visibility. This store unit is the furthest from the roadway and its distance and location make it impossible to see. It would be the smallest sign in the entire mall. If the Zoning Ordinance is literally enforced it would mean a substantial hardship to applicant. Attorney O'Keefe stated that this relief could be granted without substantial detriment to the neighborhood or without derogation from the spirit or intent of the Zoning Ordinance. All of the mall tenants have larger roof signs. One also existed for the previous tenant. The intent is to replace what was originally there. Maintaining what previously existed corresponding to what exists would be more esthetically pleasing and create a balanced visual line. He spoke in favor of the petition and hoped that the Board would see in their wisdom to grant this " request. No one spoke in opposition. Finding of Facts: Based upon the testimony given during the Public Hearing on this appeal,the Board unanimously determined following findings of facts: I. The subject property is located in a BB Highway Business Zoning District and the applicant is seeking a variance to Section 4-3.7(3)and Section 4-3.3 (12)that regulates signs within this district. 2. The request is for a variance to permit an oversized sign for the store measuring 19 square feet when zoning only permits a sign of 15 square feet. The sign is to be located where a previous sign once existed. 3. All signs in that mall are located on the roof area. To have a single sign below the roof line would detract from the established visual line and would not be noticeable within the shopping plaza. 4. There would be a financial hardship to the owner should she not be able to have a sign located in harmony with all existing signs. 0 S. Granting this relief would not be a detriment to the neighborhood nor would it derogate from the spirit or intent of the Zoning Ordinance. Decision: Based upon the positive findings a motion was duly made and seconded to grant the sign Variance with the following conditions: 1. The sign is to be 19 square feet. 2. The sign will be in the same location as the previous sign upon the roof. 3. This variance is granted as to Section 4-3.7 and 4-3.3 (12).
