DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two- family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes, bylaws, rules and regulations. The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection proc d re eme is and that he/she will comply with said procedures and requirements. Signature o o wrier^t Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. • HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the.provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner engages a person(s)for hire to do such work, that such Homeowner shall act as supervisor." Many bomeowners who use this exemption are unaware that they are assuming the responsibilities'of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results.in serious problems,.particularly when the homeowner hires unlicensed persons. In this case, our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities, many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. Anderson RE: Complaint—Junk Yard-auto repair LOCUS: 218 Five Corners Road, Centerville PARCEL: 168-108 PRESENT: Jeff Lauzon,BI,Martin MacNeely, COMM Fire & R. Anderson, ZO Received complaint via town email concerning the property located at 218 Five Corners Road, Centerville. This property has a history of complaints with a former owner. s An exit order was issued. A later notation on the jacket indicates the offending apartment was removed in 2007. This owner purchased,it as a SF in 2009. Reported to the site today—found property to be a small ranch near the corner of the intersection with Falmouth Rd. No one was home— a black boxer in house did not bark. Found yard to be cleared (clear cut complaint) and remnants of tree trucks still evident. A large chain hangs from a wood beam over the driveway—presumable for auto repair. Two cars were parked on the right side of the driveway(one had plates—the other was obviously a collectors' vehicle and did not have plates). An unregistered recreational camper was parked in the yard and further back on the left side was a temporary hoop structure. This structure contained a riding mower and some misc. mechanical parts and parts. A noticeable odor of oil was noted near.this unit: A pile of used tires was stacked to the rear of the hoop structure. A considerable landscape buffer remained between this property and the property directly abutting it to the rear. No one was able to see the house behind us. The side yard is fenced. A barrel and some misc. debris were noted under the deck. The driveway has a camper propped up on 4 barrels and cinder blocks. 'A small vent style window was opened by the door—no power to the unit. A peek into the garage revealed a room full of mechanical equipment, tools and parts. Although, the intensity may exceed the normal scope of the average homeowner it does not appear to exceed the scope of a typical "motor head" or.hobbyist. It is very difficult to determine exactly how the tools and equipment are being used. A business would likely be operating at this hour(10AM). It should.be considered that the noise emanating from both the tinkering and.social activity may be what is really driving the complaint as there is still a thick natural buffer and screen in place. See photos Jeff s camera. I will ask Cynthia Martin;Haz Mat Specialist to check the site as a precaution. r Msage Page 1 of 2 Anderson, Robin From: Perry, Tom Sent: Monday, October 15, 2012 7:59 AM To: Anderson, Robin Subject: FW: Town of Barnstable , -----Original Message----- From: Geiler, Tom Sent: Sunday, October 14, 2012 11:04 AM To: Perry, Tom; McKean, Thomas Subject: Fw: Town of Barnstable Property address of complaint and additional info. The address is; 218 Five Corners Road, Centerville MA 02632 The number of vehicles differs from day to day, at times.there are over ten. There is a vehicle that doesn't seem to be used, parked at the back corner of the property line (not easily seen from the road, but seen from our yard). The other corner has a tent like structure for storage, with old tires stacked behind it. There is usually some type of RV parked in the back yard, as well. The backyard was once filled with trees. The.individual then moved in, took down all'plant life and parked vehicles in the backyard. I've let our backyard grow-in;and be a wooded area to separate us from that situation. Once I can afford to, we'll put up a fence and do our best to plant additional year-round. Until that time, I wish he would at least make attempts to respect that this is a residential area. We've been very patient, hoping eventually he would put up a fence or change his ways. Instead he made it very clear he does not respect our feelings on the situation, and'has made absolutely no attempt to understand. I appreciate this very much. 10/15/2012 Message Page 2 of 2 Thank you, James Rogers Subject: Town of Barnstable Date: Fri, 12 Oct 2012 10:27:33 -0400 From: email@town.barnstable.ma.us To: jamesrogers53@hotmail.com w f Response from Regulatory Services: f Auto repair and maintenance as a business is prohibited in residential districts. The surrounding neighborhood has always been pleasant, and it seems to be a safe and comfortable area to raise a family. ` A couple of years ago, somebody purchased the home behind us. The resident brought down every tree and shrub in the backyard, and began to use it as a place for automobile storage. A tent like structure 10/15/2012 I, Message Page 2 of 2 was placed on the property line, and soon after automobiles were parked at the property line as well. My wife and I work during the week, and try to enjoy the backyard on the weekends. Besides an unleashed pit- bull (owned by this individual) continuously coming into our yard, looking at RVs, trucks, and old cars....we are also listening to the sounds of a mechanics garage. The Backyard experience has been ruined since, and my wife is afraid to even go in the backyard at this point. We've done our best to communicate these issues to the neighbor, but have only been met with hostility, and a refusal to listen, understand or respect our feelings and thoughts on these issues. I'm writing this quick email, after witnessing more of the same before I head to work this Friday.morning. I once looked forward to the backyard on Saturdays, and raising a family to enjoy the same thing. Instead, I've needed to allow my backyard to become a wooded area in order to separate us from the individual living behind us. Could somebody please forward my email to the appropriate department, and/or send me information on steps I can take to improve our living situation? I truly appreciate any help you could provide. Two of the five, a rusted SUV and red truck, appeared unregistered. The property was unmanicured and appears unsightly with fallen, cut up pine trees, a leaf burn pile with a whole desk laying on top of it, a tent like storage structure and the five vehicles. On 3/31/2011, 9:20am the property owner, Brian Pickering called this office. I explained the complaint. Mr.Pickering stated that he works on his own vehicles, and does not run a business. Waste oil is collected and disposed of at the town "dump". He stated that there in only one unregistered vehicle and that he plans on disposing of the unregistered SUV once he strips it for useable parts. He is now aware that only one unregistered vehicle is allowed on the property. As an aside I inquired about the desk, Brian stated he was planning on burning it to get rid of it. I suggested that a leaf burn permit is for leaves, not furniture. He stated he would dispose of it otherwise. Informed Brian that I would return to verify unregistered vehicle status in a couple of weeks. There was however.an additional registered but undriveable Jeep now on the property. The total number of vehicles on the property is now at six. In addition to these motor vehicles, there is also a small flat trailer and a towable RV parked in the yard. Mr. Pickering was called on April 26th to inform him that a re-inspection had taken place as planned, and that the Police were contacted regarding questions around the registered but expired inspection stickers on the vehicles. Mr. Pickering contacted Tom McKean regarding this and was informed by Tom that there was a violation of 59.3 re: maximum number of motor, vehicles based on his three bedroom house.
