DaLuz Building Commissioner Town of Barnstable Town Office Building 367 Main Street Hyannis, MA 02601 RE: Lot 13 on Plan in Book 386 Page 27-28 8 Haviland Way, Barnstable (Centerville) Barnstable County, MA Dear Joe: It is my understanding that Floyd Silvia has applied for a building permit on Lot 13 which is being sold by R. Arthur Williams and Betty L. Williams . I have been asked to write a letter concerning the buildability of the lot as concerns zoning. On July 31, 1984 the Barnstable Planning Board, under a subdivision control plan, approved the subdivision of land for plan entitled, "Plan of Land in Barnstable (Centerville) ,, Mass. for R. Arthur & Betty L. Williams" , which plan- was dated June 2 , 1984 and recorded in Plan Book 386 Page 27 and 28 . Therefore, as of July, 1984 the land shown on the above plan was protected under the local and state zoning by-laws for a period of eight (8) years . Lot 13 is located on a corner of Haviland Way, formerly Wayside Drive, and Hillside Drive. It is abutted by Lots 11 and 12 on the same plan. Lot 14 was sold in 1986 to Keith Robert Williams which deed is in Book 5060 Page 292 . I believe a house is located on that lot. Lot 11 was sold to the Vista Circle Realty . Trust by deed dated November 1, 1988 and recorded in Book 6504 Page 88. R. Arthur Williams and Betty L. Williams do not own any contiguous ,,land to this property. When the subdivision plan was approved the zoning was RC with 15,000 sq. ft. area. During the protection period of the subdivision plan both Lots 14 and 11 were transferred and have been held in single ownership and therefore, Lot 13 remains as a buildable lot. Mr. Joseph D.
