A copy of the pertinent portions of this Plan showing what was then called Wayside Drive, and the abutting lots numbered 12, 13 and 14, is enclosed for your reference. You will note in the upper right-hand corner of the Plan as approved a"marginatreference" to a modification in Book 6821, Page 335. This modification merely authorized and effected the change of name from Wayside Drive to the current name,Haviland Way. The premises are also the subject of an "Approval Not Required" Plan dated October 21, 1988,which was endorsed"Approval Not Required Under the Subdivision Control Law"under date of December 22, 1988,by the Barnstable Planning Board. I have enclosed a copy of this Plan for your reference as well. While I did not participate in the preparation of the Approval Not Required Plan, I believe a comparison of it with the original Subdivision Plan indicates that the latter was created in order to delineate the "Substitute Way 10' Wide" which is located along a portion of the westerly boundary of Lot 10 and which does not affect our locus, Lot 11. On June 24, 1986, the Land Court in Boston determined that as of November 4, 1982, at I0:00am,R.Arthur Williams and Betty L.Williams,husband and wife,were the owners of fee title to a large tract of land known as Lot 2 on a Plan recorded in the Barnstable County Registry of Deeds in Book 419, Page 46. 1 enclose herewith for your reference, a copy of this plan which is Confirmation Plan of Land in Barnstable No. 39705-A, which is dated November 1975 and November 12, 1981, and which was filed in the Land Court on October 13, 1977, and January 20, 1984. Our locus is located in the vicinity of the notation reading "Town of Barnstable Drainage Easement" which lies slightly northeasterly of the terminus of Oxner Road as shown on the Ralph Crossen August 24, 2000 Page 2 Confirmation Plan. Lot 11 was initially created pursuant to the subdivision process which commenced on September 23, 1983,with a preliminary Subdivision Plan being filed with the Town of Barnstable Planning Board. On June 2, 1984, a definitive plan was created by the surveyor and on June 18, 1984, the Planning Board of the Town of Barnstable voted to approve the Subdivision Plan which was subsequently endorsed on July 30, 1984 and recorded in the Barnstable County Registry of Deeds in Book 386,Pages 27 and 28. Our concbrn lies with the sheet of this Plan which was recorded on Page 27. A Road/Development Covenant was'entered into between R. Arthur and Betty L. Williams and the Town of Barnstable Planning Board which was recorded on July 20, 1984, in Book 4218, Page 29. A full Discharge and Release of this Road Covenant was recorded on November 21, 1984, in Book 4325, Page 240. On or about February 28, 1985, the Town of Barnstable voted to increase the lot size requirements for the then RC zoning district in which the premises lie. As a result, lot size was increased to a minimum of one acre (43,560 square feet). Lot 11 is bounded, as appears from the enclosed ANR Plan, on the west and northwest by Lot 12, on the northeast by Lot 14, on the east by Lot 13, and on the south/southeast by Haviland Way. 1. Lot 11 was conveyed out from the subdivision owners to Betty L. Williams, Trustee,Vista Circle Realty Trust,by deed dated November 1, 1988,and recorded in Book 6504,Page 088, which was well within the eight-year"grandfather period"following subdivision approval on June 18, 1984. Thereafter, as appears from the following recitation and the enclosed copies of the deeds,no adjacent lot was held by Betty L.
