From information submitted it appears the applicant is seeking to modify the two non- conforming undersized lots and to"hold as a buildable lot for a single family dwelling". The size of each lot is to remain the same as what was originally approved. The change in the lots is only in shape-a common boundary is being re-aligned. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on November 14, 1995. A Public Hearing was before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on _ December 13, 1995, at which time the Board found to overrule Building Commissioner's decision. Board members hearing this appeal Ron Jansson, Emmett Glynn, Elizabeth Nilsson, Robert Thorne "= ( and Chairman Gail Nightingale. A buildable Lot 4 was owned b the Williams. They in turn conveyed Lot 5 to Mr. McGraw, which was also a buildable lot. Mr. Williams transferred a 1,099 Sq. Ft. piece of land to Mr. McGraw to make his lot, Lot 5A and Lot 4B. This new C3 lot remained a total of 19,623 Sq. Ft. In turn Mr. McGraw transferred to Mr. Williams a 1,099 Sq. Ft. L piece of land to make his lot, Lot 4A& Lot 5B. This lot remained a total of 35,104 Sq. Ft. The total acreage for each lot remained consistent as they transferred an equal amount of land. All this was � done by Mr. Williams to correct an error by the abutter, Mr. McGraw. Q Attorney Alger stated that although there was a change in the configuration of the land by this exchange of the land, the new lot is still buildable because it is no more non-conforming than Lot 4 was originally when it was considered a buildable lot. The lots are identical in square footage from before the swap. The lot appears to be in conformity with regards to the lot shape factor. There is sufficient area for the house. The lot was non conforming before only with regards to total area and the total area has remained the same and therefore the lot should still be a non conforming buildable lot. The lot became non-conforming in 1985 when the Zoning Bylaws of the Town changed. Public comments: Mr. Williams, the owner of the lot stated he was told by the Planning Department that everything was OK. The property is located at Lot 4A& Lot 5B Haviland Way, Centerville. The lot contains .81 acres or 35,104 Sq. Ft. 2. The property is located in an RC Residential C Zoning District which requires one acre of upland. 3. Lot 4 (now known as Lot 4A) was created on June 2, 1984 and approved June 18, 1984 and recorded with the registry of deeds (Book 386, Page 27). 4. In 1985, Zoning in the Town of Barnstable in the RC Zoning District changed to upgrade the zoning to one acre of size and as a result the lots in issue are grandfathered. 5. The petitioner conveyed out a portion of his Lot 4 to Lot 5 in exchange fora similar size portion of land. The lots conveyed were Lots 4B and Lots 5B and each has the similar size of 1,999 Sq. Ft. 6. An ANR plan was endorsed by the Town of Barnstable Planning Board and recorded at the registry of deeds under Book 517, Page 72. 7. The transfer of these lots did not alter or increase the non conformity of the lots as required under Section 4-4.2(5) Nonconformity's-Merged Lots which states"...No lot so merged, or portion thereof,may be changed or transferred in any manner that will increase the degree of nonconformity unless a special permit has first been obtained ..." There has been no change in the size of the non conformity of the lots. Decision: Based upon the positive findings a motion was duly made and seconded to Overrule the Building Commissioner's Decision.
