The facts regarding the subject lot and the adjoining lots are as follows: The Locus lot is shown as Lot 4 on a Land Court Plan 10433-D,registered in the Barnstable County Registry of Deeds Land Registration Office(1982). The lot is therefore shown on a plan recorded prior to the change to acre zoning in 1985. The lot appears on tax Map 186,as Parcel number 64-4. Lot 4 is abutted on the north by Hayward Road,on the west by lot 3 and Web Foot Path on the same plan, on the south by lot 3 and on the east by lot D on Land Court Plan 13466-B. Lot 4 does not"abut" lot 2 anywhere on the plan and only meets the Shack parcel, lot 2 Land Court Plan 13466-C at a single point,therefore I have not discussed the title histories to these two lots. Lot 4 has for the past 20 years contained a garage. The application seeks to reconstruct the garage in a better location and reconfigure the common driveways. The Conservation Commission has granted its approval for this reconstruction. 1. The title history for Lot 4 is as follows: Constantine and Penelope Pappas received a deed for lot 4 on January 12, 1984 as document#337,516. Constantine and Penelope Pappas deeded lot 4 to just Constantine Pappas on March 19, 1987 as document#427,843. On January 24, 1994 Constantine Pappas deeded lot 4 to Christopher J. Pappas, Trustee of Hayward Realty Trust as document# 605,217, and he still hold title today as Trustee. None of the abutters are beneficiaries of the Hayward Realty Trust. 2. Lot 4 is bounded on the East by Lot D on Land Court Plan 13466-B (Assessors parcel 58). Title history for lot D is as follows: Charles F. and Ursala K. Lanigan received a deed dated July 19, 1980 as document#268,355. On July 30, 1997 Charles and Ursala deeded the property to just Charles at document#700,742. Charles still owns this lot of record today. 3. Lot 4 is bounded on the South by Lot 3 on Land Court Plan 10433-B. The title history for Lot 3 (Assessors parcel 64-3)is as follows: Jeffrey A. Sollows received title to Lot 3 by a deed dated January 28, 1982,document#291,215. Sollows sold the lot to Douglas W. Lebel on April 25, 1983 as document#309,480. Douglas Lebel lost the property to a foreclosure deed dated March 11, 1991 recorded as document#525,243 to the Seaside Mortgage Trust. Seaside Mortgage Trust conveyed the property to Laurie P. Snowden-Lebel on May 17, 1993 by-document # 582,475. She still holds title to this day. Therefore, since at least January 28, 1982 (the deed out of lot 3)title to Lot 4 and all of its abutting lots have been and remain separate. Mr.Shack feels,as the immediate abutter to the east, that the land involved may not comply with zoning by-law, Article 3,Chapter 3,Paragraph J,Subparagraph C.Lot 3 on the petitioner's plan,which is available for your review at the Conservation Commission and the Planning Board,is a porkchop lot,which in total has a shape number of 54,The calculations on the.plan on that portion of the lot,excluding the tail,indicates a shape number of 21,74,which we have serious reservations about.Even if this calculation is correct,that shape area,according to the by-law,must contain 70%con tiguous upland,which it,in our opinion,does not. We also believe that if this project is to proceed ^s planned,a tremendous amount of fill will have to be ^dded to the property to construct a,dwelling and to install the septic system,in a.ccordance with Title 5 provisions. The Order of Conditions that is sbout to issue concerning this project,has not,in our opinion,taken into consideration the leaching area as shown on the plan, which based on the,petitioner's own designation is within 8Q feet of wetlsnd on Lot 4 adjoining the same to the north.We.haye some reservations about thst designated a,res since it is our belief that the soft,rush Joseph-D,DaLuz, Building Conmiissioner -2-June 29,1982 growth located on the lot for many years was removed,prior to the commencement of this project,which would make the leaching area substantially closer to wetland. The fill required by this project will cause in our opinion flooding and substantial storm damage to the adjoining land owned by Mr.Shack and since the leaching area and septic system will have to be installed on filled land, at a,n elevation much higher than the adjoining land, sufficient safeguards must be taken to protect the abutter*s land and to prevent any health hazard during flooding. Mr,Shack is bringing this information to your attention as the enforcing agent for the zoning by-laws so that when you make your determination on issuance of foundation permits and the ultimate building permit,you will be aware of the potential risk and violation that could occur,especially the setback requirements due to the building's close proximity to the ^^deli^n^the lot.
