The property was purchased thirty five (35) years ago and has been owned by the petitioner's family since that time. The existing older dwelling is located on one end of the lot which has never previously been formally subdivided. A plan for it's subdivision was prepared prior to the adoption to one acre zoning but was never recorded. A literal enforcement of the provisions of the Zoning Bylaw will involve substantial financial hardship to the petitioner whose mother owns the property, upon which she wishes to be able to fulfill her enduring dream of building a small home of her own. The lot proposed by the petitioner for subdivision is located directly across the street from an affordable housing project recently given approval pursuant to Massachusetts General Laws, Chapter 40B by the Zoning Board of Appeals . The lot is larger than the lots in the immediate area upon which dwellings have already been or will be constructed and there is no additional land available for acquisition to develop or add to the lot. The subdivision of this lot along with the construction of a single family dwelling similar to those existing in the neighborhood upon, the proposed lot will not result in substantial detriment to the public good or substantially derogate from the intent or purpose of the Bylaw. FINDINGS OF FACT Based on the evidence submitted the Zoning Board of Appeals made the following findings of fact: With respect to this particular parcel of land, owing to the larger area of the lot, the inability of the petitioner to acquire any additional land, the prior approval by the Zoning Board of Appeals of a comprehensive permit for affordable housing across the street, 'and not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of the Bylaw would involve substantial hardship to the petitioner. The grant of a variance allowing the subdivision of the existing lot into two parcels to enable the petitioner to build one additional single family dwelling upon the premises may be granted without substantial detriment to the public good and .without nullifying or substantially derogating from the intent or purpose of the Bylaw. Based upon the above findings, the Zoning Board of Appeals , at a meeting held on March 9, 1989, voted to grant the Variance being sought. The vote was as follows: AYES: JANSSON, NIGHTINGALE, WIRTANEN, LALLY, BOY NAYES: NONE In granting the relief sought, the Zoning Board of Appeals imposed the following conditions , the breach of which shall invalidate the variance being granted: The lot shall be subdivided as set forth in the subdivision plan entitled "Plot Plan of Land in Barnstable, Centerville, Mass. , for Clair Price" , dated: February 21 , 1980, Drawn by: Baxter & Nye, Registered Land Surveyors, Osterville, MA.
