When Subdivision,No.405'Goldman'was ap proved'in 1978,the RD-1 required a minimum lot area of 20,000 sq.ft.and the RC required a minimum of 15,000 sq.ft. In addition, zoning only required look of the minimum lot area to be upland. Summery of Issues: f In 2001,Joanne.Goldman passed and in 2004, David Goldman passed and the subdivision lots.moved into the respective estates. To resolve the issues the Administrator of the Estates has.initiated action to; correct the undersized non-buildable checker boarded subdivision lots, resolve the road drainage problem, secure the release of the remaining lots under Covenant and action to complete and.close out the subdivision. ' 3 Ct Resolution of Issues: In early April of 2011,Attorney Philip M. Boudreau in concert with the Administrator initiated discussion with the Town staff to resolve the subdivision and bring it to completion.Plans were prepared to-address the drainage issue at the intersection of High Noon and Judith Eve. And about July 21�,work was started on the drainage improvements and completed early in August. Regarding that work, it appears that the work was initiated without prior notification to other owners of property in the subdivision. A complaint from one of the.owners was.registered with the staff. The concerns appear to be the lack of notification and for access to property/parking during construction. Although the actions now before the Board do not require a public hearing,the Applicant atahe request of the Town has voluntarily notified those owners in the subdivision of this action before the Board should they desire to participate. The two ANR plans submitted to the Board address the undersized non-buildable checker boarded subdivision lots, establishing the 1-acre lots that meet zoning as legal-created lots prior to the adoption of Resource Protection Overlay District.(2-acre zoning). Securing the release of the remaining lots under Covenant will rectify the"technical violation"and that release in combination with the ANR plans will allow the issuance of building permits to the new 1-acre lots shown on those ANR plans. In addition an "as-built plan" of the ways in the subdivision has been submitted,to the file. As-built plans are required of all subdivisions prior to any certification of completion. The proponents initially asserted that there were 9 lots undersized lots that were protected due to checkerboarding that occurred on February 28, 1985, the day that zoning increased to one acre. As we previously discussed, we raised questions about the validity of the attempted checkerboarding and concomitantly the. purported conveyances into separate ownership because they were between husband and wife and further,because the lots had not been released from covenant at the time of said conveyances. Arguments were made by the proponents defending the checkerboarding on the basis that the husband and wife hated each other(they subsequently divorced) and acted independently in business . matters, that the subdivision had, in fact, been completed but the steps had not been taken to release the lots from covenant and that there was no case law that that supported the proposition that a lot which was under covenant could not be conveyed for the purpose of obtaining grandfather protection. In the latest attached plan, the proponents are asserting that since the Town is contending that notwithstanding the fact that the lots are held in separate ownership;the initial conveyances were invalid,, then the 3 assembled lots should be treated as merged lots, which lots, each containing more than an acre of upland, are protected under the provisions of Section 240-91 G. As to the remaining lots, the. proponents indicate that they would have to seek variances or appeal the denial of a building permit. Another titillating zoning question to ponder over the weekend. Lots 1, 2, 3, 4, 5, 6, 7, 9, .10, 11, 16, 17 and 18 ' Facts: The definitive subdivision plan was endorsed on September 5, 1978, and recorded on September 7, 1978; and the related road covenant, dated September 5, 1978, was recorded on September 5, 1978,in Book 2777, Page 141 (a copy of which is annexed hereto). The plan ti contains 20 lots. David B. Goldman and Joanne S. Goldman initially took title to-the unsubdivided property*which comprises the subdivision in 1965 as Trustees for the benefit of their three named children, later taking title thereto as.tenants by the entirety in 1981. At the time of the approval of the definitive plan, the subdivision lay across two zoning districts, RD-1 and RC, and the contiguous upland requirement was 70%. All lots complied with the applicable zoning at that time. In 1983, the contiguous upland requirement was changed to 100%, rendering Lots 2 and 5 nonconforming. On February 28, 1985, applicable zoning was changed to require one acre of contiguous upland, rendering the balance of the lots nonconforming. I was able to find recorded releases from the road covenant for the following lots:"Lots 14 (1984), 12 (1985), 19 (1985), 8 (1986) and 15 (1992). I could not find recorded releases for Lots 13 and 20, but it is my understanding that those were issued by the Planning Board. Lot 13, 20 and 14 were conveyed to third parties prior to February 28, 1985. _According to the assessors' records, all of these.lots have been built upon. On February 28, 1985, Lots 1, 3, 5, 6; 7, 8, 9, 10; 11, 12, 15, 165 175 18 and 19 were conveyed by the Goldmans to Sandra.Crosby, who immediately conveyed Lots 1, 6, 8, 10, 15, 17 and 19 to David Goldman and Lots 3, 5, 7, 9, 11, 12, 16 and 18 to Joanne Goldman. Lots 2 and 4 remained in both Goldman's names, as tenants by the entirety. It should be noted that while all of the above three deeds were recorded on February 28, 1985, the deed to Sandra Crosby was dated and acknowledged on September 22, 1984, while the deeds from Sandra Crosby to the Goldmans were dated February,28, 1985. There is no record explanation to the delay in execution of the latter two deeds. Lots 8; 12 and 19 were conveyed to third parties in 1985- Lot 15 was conveyed to a third party in'l986. According to the assessors' records, all of these lots have also been built upon. R -Joanne Goldman died testate in 2001, being married to David Goldman at that time; and her Will has been challenged and has not been allowed by the Court. Because Lots 2 and 4 were held by the Goldmans as tenants by the entirety, Lots 1,2,.4 and 6 merged in David's name at Joanne's death. Lots 2 and 5 having previously been rendered nonconforming in 1983, it would , appear that Lots 1, 2, 4, 5 and 6 have been merged and constitute one lot for zoning purposes. David Goldman died in 2004 and his Will has also been challenged and has not been, allowed by the Court. Issues: , Separate lot status is claimed for the combined Lots 1, 2, 4, 5 and 6 (as one lot), as well as each of Lots 3, 7, 9, 10, 11, 16, 17 and 18. The Building Commissioner has determined that these lots were properly "checker boarded," provided (a) that the February 28, 1985, conveyances into separate ownership were not ' rendered ineffective for purposes of determining their separate ownership status because those conveyances amounted to a technical violation of the provisions of the unreleased road covenant, and (b)the circumstances do not suggest that either David nor Joanne retained the "master hand" and so actively and pervasively controlled the other so as to,render the checkerboarding } disregardable for grandfathering purposes. (a) With respect to the 1985 conveyances into separate ownership while the road covenant remained unreleased, the documentation in the planning.board's file indicates that the required work had been completed by October of 1979. (See letter of Frank Conery, R.E./R.L.S. . of October 29, 1979, certifying to this fact, annexed hereto.) The terms of the road covenant would appear to have been satisfied at that time as the covenant required only "the.construction of ways and the installation'of municipal services ... .in accordance with the applicable Rules and .Regulations" before separate'conveyance of the lots.(and not.the actual issuance of a release of the covenant by the.planning board). Accordingly, it is submitted that the conveyance of the lots into separate ownership was not in violation of the terms of the road covenant. More recently, the town's engineering department has determined that one or more of the installed drainage basins or leach pits has failed and the town is requiring repair/replacement of the same. In addition,the town has requested that final engineering plans be delivered to it prior to releasing the remaining lots from the covenant. The estates are willing to complete this work , to obtain a full release of the road covenant. (b) On the issue of control between David and Joanne, on information provided by the Court appointed Special Administrator of both estates and one of the Goldmans' daughters, - Lauren, it is apparent that both Joanne and David Goldman held other assets in addition to these lots in their individual names, apart from each other. The Goldmans also appear to have lived apart at various times-during their.marriage, David often using a condominium in Plymouth as his "retreat" from the marriage:. Lauren has also indicated that her parents were "legally separated," but we have not found a court order establishing this. 4 Additionally, Lauren has also informed us that her mother and father disagreed on what . was to.be done with their respective lots in the subdivision in question; and, ultimately, Joanne attempted to disinherit her daughter, Rebecca, of any interest in the Centerville property and to leave one of her lots to her sister. (Joanne's Will, a copy of which is attached hereto, purports to devise one of the lots held in her individual name to her sister,-Phyllis Erlichman,_and her remaining lots to one of the Goldmans' three children, Lauren.Goldman.) David's Will, a copy of which is attached hereto, purports to leave most of his lots to another of the Goldmans' three children, Rebecca Killion. It is submitted that the above information does not suggest that either.David or Joanne had exercised any significant control over the other with respect to financial decisions in general or the subdivision lots in particular. To the contrary, the evidence implies that both Goldman parents were acting quite independent of each other and that there was no "master hand" dictating the disposition of the lots in question.
