Town of Barnstable BUILDING DEPT. - 367 Main Street Hyannis, MA 02601 JAN 19 2021 Re: Determination of Buildability of Undersized Lot TOWN.OF BARNSTABLE Lot 2 on Plan Book 228, Page 157 35 Kay Avenue Centerville, MA 02632 Assessor's Map 248, Parcel 236 Dear Mr. Florence: have been asked to render an opinion whether the lot shown as Lot 2 on the plan recorded in the Barnstable County Registry of Deeds in Plan Book 228, Page 157 constitutes a buildable lot for.zoning purposes. In response to the request, I have caused the records atthe Barnstable County Registry. of Deeds to be.researched. have also reviewed the Town of Barnstable Zoning Ordinance. Based upon my review of the results of the search of the records at the Barnstable County Registry of Deeds and the Zoning Ordinance it.is my opinion that Lot 2 on Plan Book 228, Page 157 constitutes a buildable lot for zoning purposes. This opinion is based upon the following: 1. The lot located at.35 Kay Avenue, Centerville, Massachusetts was . established on a plan of land.dated April 25, 1969. The plan is recorded in the Barnstable County Registry of Deeds in Plan Book 228, Page 157. It is shown as Lot 2 on said plan. A copy of said.plan is attached hereto as Exhibit 1. 2 Lot 2 is currently located in the Residence RB Zoning District. According to information.supplied by Town Staff, at the time Lot 2 was created, Lot 2 was in the Residence RB-1 Zoning District...The district had a Ninimurn Lot Size requirement'of 10,000 square feet of area and a lot Width requirement of 100' 3. According to the plan recorded,in Plan Book 228, Page 157, Lot 2 Mr. Brian Florence January 7, 2021 Page 3 contains 14,990 square feet; has in.excess of.100' of width; and has frontage on Kay Avenue,_a town way, 4. Lot 2 met the Minimum Lot Size and Width. requirements for Lots located in :Residence RB-1 Zoning District when it was created in 1969 ' 5. In 1970, the area was re-zoned to Residence.RB Zoning District. The Minimum Lot Size and Width requirements remained the same. 6. In 1985, the Minimum Lot Size requirement for lots located in the Residence RB Zoning District was increased to 1 acre. It was this zoning change that made Lot 2 a nonconforming lot. At the time of this zoning change, Lot 2 was owned by Peter Garry and Thelma T. Garry, having been acquired by a deed dated May 9, 1969 recorded in Book 1436, Page 249. As demonstrated in the following paragraphs, Lot 2 has remained in separate ownership from all abutting lots since May 9, 1969. 7; Peter Garry and Thelma T: Garry conveyed Lot 2 to the Garry Family Trust by deed dated September 12, 2008 and recorded in Book 23203, Page 88. The Garry Family.Trust conveyed Lot 2 to the Dow Family Nominee Trust,the current owner, by deed.,dated March 26, 2020 and. recorded in the.Barnstable Registry of Deeds on June 26, 2020 in Book 33020, Page 89. The beneficiaries of the Dow Family Nominee Trust are James L. Dow- 50% and Jennifer K. Dow- 50% (father and adult daughter who will eventually be sole owner). . 8. Locus is abutted by the following five parcels: Lot 2 on the plan recorded in Plan Book 597, Page 86 located at 21. Kay Avenue (Parcel 056 001 on . Assessor's Map 248); Lot 1 on the plan recorded in Plan Book 228, Page" 157'located at 88 Elliott Road (Parcel 055 on Assessor's Map 248); Parcels A and B on the plan recorded in Plan Book 237 Page 67 located at 102 Elliott Road (Parcel 238 on Assessor's Map 248); Lot 4 on.the plan recorded in Plan Book 142, Page 117_located at 80 Elliott Road (Parcel 251 on Assessor's Map 248); and Lot 5 on the plan recorded in Plan Book 251, Page 90 located at 395 Strawberry,Hill Road (Parcel 253 on Assessor's Map 248). Hinckley by a deed dated December 5, 1967 and recorded in Book 1385, Page 1160. Aurelia D. Hinckley conveyed said parcel to:Matthew Needham and Jennifer Hinckley, the current owners, by deed dated April 10, 2005 and recorded in Book 19729, Page 20. A deed to clear and confirm title between Aurelia D. Mr. Brian Florence January 7, 2021 Page 3 Hinckley and Matthew Needham and Jennifer Hinckley dated.June 2, 2005 was recorded in Book 19901,,Page 299. 10. 88 Elliott Road (Parcel 055, Assessor's Map 248) was conveyed by Phebe E. Rhames to Maryanne M. Johnson by a deed .dated September 13, 1975 and recorded in Book 2241, Page 042. Maryanne M. Johnson conveyed said parcel to Maryanne M. Based upon the foregoing, it is my opinion that Lot 2 as shown on the plan recorded in Plan Book 228, Page 157 was held in separate ownership from all abutting lots at the time of the zoning change in 1985 which made it nonconforming and it has remained in separate ownership since that change. At the time of the zoning change in 1985, Lot 2: (1) Was not held in common ownership with any adjoining land; and (2) Had greater,than 5,000 square feet of area and 50 feet of frontage;and (3) Conformed to the existing zoning when.created; and (4)_Has been separately..owned:at the time of every zoning change which made it nonconforming: Lot 2 meets the provisions of Section 240-91 of the Zoning Ordinance and is a legally, grandfathered buildable lot for zoning purposes.
